JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center Indian Head Division (NSWC IHD), Contacts Code 026.
2. Description of the Action Being Approved
This action will award a modification to contract N0017421D0025, on a sole source basis to increase ceiling to add additional items to include the Bio Safety Enclosure (BSE) Technical Data Package (TDP) and Universal Mobile Tester (UMT) in support of Joint Biological Point Detection Systems (JBPDS) and Enhanced Maritime Biological Detectors (EMBD) to:

3. Description of Supplies/Services.
N0017421D0025 is a sole source contract for the purchase of parts for the J PDS and EMBD systems. This modification is for the purchase of the BSE TDP for EMBD, which is the shell of the detector that houses all components that make up EMBD, and the purchase of the Universal Mobile Testers (UMT). The UMT is essential to installing EMBD in the fleet, with it being a system that is used to test single components or legacy parts as a whole to ensure the parts are working as designed before installing onboard ships.
This modification will increase the value of the contract from $5M to $8M.

4. Statutory Authority Permitting Other Than Full and Open Competition
This acquisition is being conducted under the authority of 10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
Currently the fleet uses JBPDS and EMBD parts provided by Chemring Sensors and Electronic Systems (CSES). The Government purchased JBPDS through a full rate sole source production contract awarded in Fiscal Year (FY) 2010. The Government requires the purchase of the TDP as CSES is no longer manufacturing the BSE.
CSES has agreed to sell the Government the TDP. With the purchase of the TDP, the Government will own the unlimited rights to the TDP to procure the BSE for all future requirements. The BSE and UMT are propriety to Chemring, with ownership of all TDPs for these items, which is why the Government can currently only procure from CSES.
In order to support the Navy capability for threat detection and meet requirements for repair of JBPDS and EMBD Line Replaceable
Units (LRUs), the procurement of EMBD UMTs from CSES is required.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
To further broaden market research and to satisfy the requirements of DFARS PGI 206.302-1(d), a Sources Sought notice was posted on SAM.gov website on 08/22/2024. The posting yielded one (1) response, who was the intended sole source contractor.
As required by FAR 5.203, a pre-solicitation notice was publicized on the SAM.gov website on 10/29/2024. Zero (0) responses were received.
7. Determination of Fair and Reasonable Cost
The Contracting Officer has determined the anticipated cost to the Government for the supplies covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, with the Government gaining ownership of the TDP, NSWC IHD Contracts Department will be competing follow-on efforts for future requirements.
