About this file

This document is a justification and approval for a sole source award of a contract by the Naval Sea Systems Command to Silver Ships, Inc. for United States Marine Corp Assault Amphibian Safety Craft. The contract awarded to Silver Ships, Inc. on August 26, 2022 is for $12,600,405 to procure safety craft that are nearly identical to craft previously delivered under contract N00024-14-D-2215 with minor modifications. The justification cites the Navy's assessment that only Silver Ships, Inc. can meet the requirement based on its experience and expertise in manufacturing this type of vessel. A synopsis was posted on SAM.gov on April 14, 2022 to solicit capability statements from other potential sources but none were identified that could satisfy the requirement.

DEPARTMENT OF THE NAVY

NAVAL SEA SYSTEMS COMMAND

1333 ISAAC HULL AVE SE IN REPLY TO

WASHINGTON NAVY YARD DC 20376-0001

J&A Number: 21,806 Code: SEA 02223 P.R. Number: N00024-22-NR-68058

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Naval Sea Systems Command (NAVSEA), Shipbuilding Contracts Division (SEA 022).

2. Description of the Action Being Approved.

Award of a contract on a sole source basis for United States Marine Corp (USMC) Assault Amphibian (AA) Safety Craft;

sling set; spares; engine diagnostic laptops; inspection & trials;

logistics engineering & management; crew familiarization; shipping and a technical data package to Silver Ships Inc. (SSI) 9243 Bellingrath Road; Theodore, Alabama; 36582-2710.

3. Description of Supplies/Services.

This procurement is for AA Safety Craft from SSI as identified in NAVSEA Contract N00024-14-D-2215 as 11m Surface Support Craft (SSC) USMC Variant , with minor modifications. A base award with two options shall be awarded

. The craft under this action will be nearly identical to the 11m SSC USMC Variant delivered under Contract N00024-14-D-2215. The configuration will incorporate minor changes due to obsolescence and any required operational capability improvements for safety or suitability. The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The US Navy and Foreign Military Sales Boats and Craft Program Office (PMS 300) maintains in depth knowledge and insight into performance characteristics of vessels available in the marketplace. The program office routinely attends boat shows and stays current with the capabilities of different boat yards. Based on its knowledge and expertise, PMS 300 has determined that only SSI’s 11m SSC USMC Variant boat will meet this requirement and that there is no other responsible source that will satisfy the agency requirements.

In accordance with DFARS 206.302-1, a synopsis was posted on SAM.gov on 14 April 2022, which encouraged responsible sources to submit a capability statement, proposal, or quotation, within 15 days of posting.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The Contracting Officer will use the Independent Government Estimate developed by PMS 300 and pricing data submitted by SSI along with historical information to determine a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSEA has no plans at this time to compete future contracts for these types of supplies/services covered by this document. If another potential source emerges, NAVSEA will assess whether competition for future requirements is feasible.
