JUSTIFICATION AND APPROVAL (J&A)

USTRANSCOM JUSTIFICATION FOR

OTHER THAN FULL AND OPEN COMPETITION

SDDC DESKTOP OFFICE INFORMATION SYSTEMS SUPPORT (SDOISS)

21-12

1. CONTRACTING ACTIVITY.

United States Transportation Command, Directorate of Acquisition, IT Programs & Support Services Division (USTRANSCOM/TCAQ-D), 508 Scott Drive, Scott AFB, IL 62225.

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

Surface Deployment and Distribution Command (SDDC) Desktop Office Information Systems Support (SDOISS) requires an exception to fair opportunity in order to continue operations in support of SDOISS until the follow-on requirement is awarded by the contracting office at Rock Island, IL. USTRANSCOM intends to modify the current Firm-Fixed Price contract, HTC711- 16-M-D019.

3. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS.

SDDC requires continued support for a network centric Hub with Global Spokes for surface deployment, distribution, planning, and operations management for all Government sponsored transportation movements. Support includes the workload and efforts for SDDC information technology onsite support and services primarily at Scott AFB, Tier I support for certain functions performed by headquarters staff for the benefit of worldwide SDDC locations and remote SIPRNET support for SDDC locations within the Continental United States (CONUS) that are using Scott AFB’s host base SIPRNET services.

The goal of this modification is to provide a continuation of services while the source selection for the follow-on requirement is completed by the contracting team at Rock Island, IL. The period of performance for this effort is 1 April 2021 - 30 September 2021. The estimated value for continued service is

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

The statuary authority permitting other than full and open competition is 10 USC 2304 (d)(1)(B) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF

THE AUTHORITY CITED.

In the wake of two attempted follow-on efforts that resulted in two protests, SDDC chose to pursue follow-on efforts from the contracting office at Rock Island, IL. To avoid a break in critical services, SDDC requested a continuation of services which would allow for continued SDOISS support. Due to the complexities involved in a contract transition, switching to another contractor who could provide the same or similar services, at this time, would interrupt services.

Any sort of gap in the continuity of these critical services would have a detrimental impact across SDDC and its worldwide activities. It is therefore necessary to provide continuous services from the incumbent contactor until a new, long-term contract is competitively awarded.

The current contractor has sustained SDOISS since 2016. The incumbent contractor is uniquely familiar with the customer’s enterprise environment, user population, and operational requirements with the current sustainment to the extent that award to another source at this point in time will result in disruption of SDDC customer services and unacceptable delays in information technology support of the SDDC headquarters and flag support population. The primary reason for pursuing this strategy is to reduce the risk of delay and mission disruption.

If current efforts do not continue as normal, SDDC Headquarters and the SDDC worldwide activities will be adversely impacted and the effect would disrupt their ability to support the warfighter and execute missions around the world. There is a dire need for continuity of their services to prevent mission degradation. Without SDOISS support, SDDC will not have tier one or tier two helpdesk or flag support. The lack of support could potentially create mission degradation through the adverse ability for employees to access mission critical programs, systems, software and hardware. Work stoppage for any mission critical employee would be detrimental, but as the liaison between the SDDC senior-level executives and their executive staff for all command, control, communications, and computer support could impact significant mission operations and significantly impact the warfighter. SDDC and the warfighter cannot afford a lapse in support and urgently request this extension.

6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICAL.

While circumstance do not permit full and open competition at this time, it is understood that the contracting office at Rock Island will solicit the consolidated SEITS effort as a competitive acquisition.

7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

The Contracting Officer will ensure the resultant award price is fair and reasonable per FAR

15.4. In the original award, prior to each option period initiation and subsequently prior to all extensions, rates were compared to the contractor’s proposal to the independent government cost estimate, compared to historical pricing, and any other price/cost analysis techniques deemed necessary.

8. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS OR A STATEMENT OF THE REASONS MARKET RESERACH WAS NOT

CONDUCTED.

Market Research was conducted as part of the initial re-compete effort for this requirement. No new market research was conducted as this action is being executed as only one source in the case of a follow-on contract for the continued specialized services to avoid unacceptable delay in fulfilling the agency’s requirement while the contracting office solicits competitive follow-on services.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION.

None

10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED AN INTEREST IN THE

ACQUISITION.

None, other than those that quoted on the re-compete efforts that was subsequently protested.

11. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE

OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED.

USTRANSCOM attempted to re-competed this effort twice and make an award based on competition. In both cases a protest was sustained leaving the agency to re-compete the effort again. SDDC sent the re-compete effort to Rock Island, IL. This performance for this requirement is essential until Rock Island can award a competitive award.
