Award of a contract on a sole source basis for maintenance and repairs to 754 USS Topeka’s No.1 and No.2 High Pressure Air Compressors (HPACs).
3. Description of Supplies/Services.
a. Maintenance, repair and overhaul of No.1 and No.2 HPACs onboard USS Topeka (SSN-754) in Pearl Harbor Naval Shipyard (PHNSY).
b. The total estimated dollar value: $297,260.00
c. Funding: FY-23, OM&N
d. Period or Performance: 02/21/2023 – 03/10/2023
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services willsatisfy agency requirements.5. Rationale Justifying Use of Cited Statutory Authority.
The maintenance, repair and overhaul of the HPAC requires an OEM representative to inspect, maintain, repair, and overhaul of the HPACs Nos. 1 and 2 onboard 688 class submarines, identified in Paragraph 3 above is supporting a mandatory work requirement onboard of 688 class submarines.
HPACs are integral submarine components as they provide high-pressure air throughout submarine and supporting multiple systems. Loss of HPAC capability would severely degrade and limit operational capability and maneuvers required of a Los Angeles Class submarine.
Per PHNSY Engineering & Planning Department (EPD), Curtiss-Wright Corporation is the Original Equipment Manufacturer (OEM) of the HPACs used on Los Angeles-Class submarines.

Curtiss-Wright was found to be the only vendor that can perform this type of work onboard Naval 688 class submarines. The repair of the systems requires OEM proprietary information (ex. Drawings, specifications, etc.). As the OEM, Curtiss-Wright, will be able to provide proprietary information to accomplish the work in accordance with (IAW) proprietary drawing and specifications.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
PHNSY Code 410.2 posted Sources Sought N32253-23-Q-0018 to the Government Point of Entrance (GPE), Sam.gov on 25 January 2023 for five days. On 30 January 2023, there were zero (0) responses received from potential vendors.
No potential sources submitted a capability statement or showed interest in the requirement published in SAM.gov.
Previous historical market research was conducted for the USS Columbia, (contract N32253-22-P-0106) for maintenance and repair the same model HPACs. The previous historical Market Research determined that the HPAC requirement was a sole source and there were no mandatory sources or small business concerns that could perform the HPAC maintenance, repair and overhaul requirement. Market research was also conducted via internet by PHNSY Code 420 on 25 January 2023. There were no other companies found with the capability to provide maintenance, repair and overhaul of the Class AA+ HPAC on Los Angeles Class U.S. Navy Submarines.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, PHNSY & IMF C410 has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, PHNSY & IMF C400 will assess whether competition for future requirements is feasible.
