J&A Number: CR-19219
Code: WXS
P.R. Number: N00164-19-R-WS45
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center
(NSWC) Crane Division, Code 0242.
2. Description of the Action Being Approved
Award of a Firm Fixed Price (FFP) indefinite delivery indefinite quantity contract on a brand name only basis for
EA-18G aircraft RF cables and connectors. Items are for the
Fleet Support Team (FST) to provide immediate support for the AN/ALQ-218(v)2 Tactical Jammer Receiver and provide sparing.
3. Description of Supplies/Services
The required supplies covered under this Justification and
Approval (J&A) are for Times Microwave brand name only parts needed to support the ALQ-218 platform for current fleet needs and provide sparing. As lead time increases to the with currently no sparing in supply, mission capability and capacity will be severely degraded when one of these cables or parts do not meet system specifications. The parts to be procured and delivery requirements are listed under Attachment 1.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
The estimated requirements under this J&A are valued at a maximum of over and will utilize Aircraft
Procurement Navy funds (APN 1, Combat Aircraft
NCH 53.6-2 (MAR 2013)
Procurement) and Operations & Maintenance, Navy funds

4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. § 2304(c)(1), One source or limited sources.
5. Rationale Justifying Use of Cited Statutory Authority
These cable sets are used to stimulate the EA-18G’s Airborne
Electronic Attack (AEA) Suite currently installed in approximately 150 jets. The AEA suite incorporates these cables and parts at the system level and must be brand name only Times
Microwave Inc. parts due to the specific electrical characteristics these items require to achieve full system performance. Various cables and connectors are matched sets, meaning the phase matching and electromagnetic performances are matched to each other. The Government does not own the complete data package to these products. In addition, they are also installed on the current EA-18Gs in theatre and are being installed by Boeing, the manufacturer of the EA-18G.
Consequently, if the Government were to try to purchase any other type/brand of cables and connectors it would require a complete modification/redesign of the interconnection of the EA-
18G AEA Suite and all Weapon Ready Assemblies (WRA). This would result in an increase cost and schedule delay to the Government of an estimated and years respectively. See attachment

6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
A Request For information (RFI) was posted on the Federal
Business Opportunities (FEDBIZOPS) website on May 1, 2019, and no other potential sources expressed an interest. A formal synopsis of the procurement was also posted on FEDBIZZOPS on May
20, 2019 and there were no responses to it. An amendment to the synopsis was posted on May 13, 2019, clarifying that the
NCH 53.6-2 (MAR 2013)
solicitation would be issued as a brand name only rather than a sole source direct to Times Microwave. The amendment also stated that the procurement would be a commercial buy using FAR
Part 12 procedures and the solicitation would be posted to
FEDBIZOPS. No responses to the amendment have been received.
No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any other items other than the Times Microwave brand name parts to provide the required supplies and services.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. The Contracting Officer will utilize informal cost data, comparison to similar items, past procurement history from Boeing to Times Microwave, and Times
Microwaves commercial price list to determine the prices paid by the Government for the supplies covered by the J&A to be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC Crane Division has no plans at this time to compete future purchase orders/awards for the types of supplies covered by this document. If another potential source emerges, NSWC Crane
Division will assess whether competition for future requirements is feasible.
