About this file

This document is a Justification and Approval (J&A) Addendum for a sole source sustainment contract extension with Teledyne FLIR Defense, Inc. for the PAS-33 hand held imager - miniature long-range (HHI-MLR) systems. The original contract (N00164-20-D-JQ80) was awarded in March 2020 with a $5M ceiling for five years. The contract extension is justified because FLIR is the sole developer of these systems, which were created entirely at their expense, and the government lacks design specifications to enable competition.

The contract's utilization has been lower than initially anticipated, with actual expenditures of $1,030,366.23 through FY20-FY24, leaving a remaining ceiling of $3,969,633.77. Projections estimate $2.3M in expenditures for repairs and spare parts over the next five years. A synopsis was posted on www.sam.gov from February 6-21, 2025, which generated only one clarification inquiry. The Naval Sea System Command (NAVSEA) Naval Surface Warfare Center, Crane Division is the contracting activity, and while no immediate plans exist for successor technology, sustainment of the current system remains required.

J&A No. CR-20128.1 Code: JXQ

N00164-20-D-JQ80

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

ADDENDUM

1. Contracting Activity

The Naval Sea System Command (NAVSEA) Naval Surface Warfare Center, Crane Division (NSWC-CR), Expeditionary Contracts Division (Code 0231).

2. Description of the Action Being Approved

The purpose of this Justification and Approval (J&A) Addendum is the extension of the existing firm fixed price contract N0016420DJQ80, a sole source sustainment contract awarded to Teledyne FLIR Defense, Inc. (formerly FLIR Systems, Inc.) (FLIR), 25 Esquire Road, North Billerica, MA 01862 in support of the PAS-33 hand held imager -miniature long-range (HHI-MLR) systems.

3. Description of Supplies/Services

NSWC Crane J&A number CR-20128 was approved on 26 MAR 2020, by the Competition Advocate for the Contracting Activity, M. Kelly Siffin. Award was a Firm Fixed Price (FFP) contract with FLIR.

. The original ordering period was for five (5) years with a $5M ceiling.

Failure rates were not as high as anticipated, thus the ceiling has been underutilized.

Projections based on utilization over the last 5 years expect $2.3M in expenditures supporting repairs and spare parts over the next 5 years. An extension to the ordering period for this contract action will allow for continued support fielding existing equipment under the existing contract ceiling.

The original J&A conditions still exist with FLIR being the only responsible source. The Government does not own design specifications adequate to allow for competition. These systems were developed solely at FLIR’s expense. As such, FLIR is the only contractor possessing the capability to provide the required supplies/services. A synopsis was posted to www.sam.gov on 06 FEB 2025 through 21 FEB 2025. The only response received was independent market research. The response was a clarification inquiry on whether this was a new contract or an incumbent performing these services, in which the Contract Specialist’s response answered the inquiry and no further communications were received thereafter.
