About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition to issue an undefinitized task order to Teehee Engineering, Inc. under a NAVFAC Southwest MACC contract for building flood damage repair at Naval Base San Diego. The scope of work includes repair of a fire standpipe, fire main, and fire panel, as well as carpet and drywall replacement, and mold remediation due to a fire main break that caused excessive flooding in Building 62. The estimated value of the task order is $425,000, with a 90-day period of performance. The J&A cites the statutory authority of 10 U.S.C. 3204(a)(2) and FAR 6.302-2 for unusual and compelling urgency, as the flood damage poses fire safety risks and potential health hazards that require immediate remediation. A related special notice indicates NAVFAC SW's intent to sole-source award this 90-day, firm-fixed-price contract to Teehee Engineering, Inc. under FAR 13.106-1(b)(1)(i) based on their capability to immediately respond to this urgent requirement.

DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING SYSTEMS COMMAND SOUTHWEST
750 PACIFIC HIGHWAY
SAN DIEGO CA 92132-5190
IN REPLY REFER TO
N6247320D1010 J&A No. 24-03-4
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Systems Command Southwest (NAVFAC SW), Facilities Engineering Acquisition Department (FEAD) San Diego, California.
2. Description of the Action Being Approved:
Request authority to issue an undefinitized task order to Teehee Engineering, Inc. (Cage Code: 3ENP4) for building flood damage repair under NAVFAC SW Southern California and Arizona Installations Indefinite Delivery Indefinite Quantity Multiple Award Construction Contract (MACC) N62473-20-D- 1010 without affording fair opportunity to the other MACC awardees, pursuant to the authority in Section 4 of this Justification & Approval (J&A).
3. Description of Supplies/Services:
The proposed task order will remediate flood damage at Building 62 at Naval Base San Diego (NBSD).
The scope of work includes repair of fire standpipe, fire main, and fire panel, as well as carpet and drywall replacement, and remediation of any mold growth within those spaces affected by the fire main break flooding the building on June 23, 2024.
The estimated dollar value of this contract action (including options) is approximately $425,000 based on the Independent Government Estimate (IGE) utilizing historical data and input from subject matter experts, and based on the current, undefinitized scope of work. The performance period to complete the required work will be 90 days. The IGE and period of performance for the required work are described below:
PERIOD PERIOD OF
PERFORMANCE FFP - Recurring COST FFP &
IDIQ Combined
BASE 06/26/24 – 09/24/24 $424,228.37 $424,228.37
TOTAL $424,228.37
The task order will be funded by Fiscal Year 2024 Operations and Maintenance, Navy Funds.
4. Statutory Authority Permitting Other Than Full and Open Competition:
The proposed sole-source action will be conducted without providing for full and open competition pursuant to the statutory authority of 10 United States Code (U.S.C.) § 3204 (a)(2), as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(A) Exception to the fair opportunity process and FAR 6.302-2, Unusual and Compelling Urgency.
5. Rationale Justifying Use of Cited Statutory Authority:
A fire main broke on Sunday night, June 23, 2024 and caused excessive flooding from the second floor to the first floor of Building 62 at NBSD. The workspaces at Building 62 affected by the flooding are occupied by military and Government civilian personnel. The broken fire standpipe and fire panel can cause fire safety issues, and wet carpet and wall moisture can create mold rapidly, which poses a significant health and safety risk to all personnel within the affected and adjacent areas of Building 62.
Due to the time sensitive nature of the fire safety hazards and harmful mold growth, there is insufficient time to fully develop a scope of work and conduct a fair opportunity or full and open competition without incurring unacceptable delays and risking serious injury to the Navy’s personnel, property and mission.
Pursuant to the authority of 10 U.S.C. § 3204 (a)(2), as implemented by FAR 6.302-2, this J&A requests the authority to award a one-time sole source task order to Teehee Engineering, Inc., without affording fair opportunity to other MACC awardees based on unusual and compelling urgency. Teehee Engineering, Inc. is capable of performing the work and able to complete the work within the required time due to their current mobilization on other Navy projects located in close proximity to the affected facilities at NBSD.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
Due to the extreme urgency of this project as noted above, the Government would incur unacceptable delays and would be seriously injured if the agency complies with the standard procedures to solicit to all MACC awardees, and adhere to the time periods and other procedural requirements specified for soliciting the required work in FAR 5.203 – Publicizing and Response Time. The planned contract action covered by this J&A meets an exception to the synopsis requirements per FAR Part 5.202(a)(2). The approved J&A will be made publicly available in accordance with FAR 6.305(b).
7. Determination of Fair and Reasonable Cost:
The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A to be fair and reasonable.
8. Actions taken to Remove Barriers to Future Competition:
This contract action is a one-time, sole-source procurement for urgent flood remediation due to recent fire main break in Building 62 that caused unusually excessive flooding. There are no future requirements associated with the work covered by this procurement and NAVFAC Southwest will continue to promote full and open competition and fair opportunity for future requirements.
