DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID:___36C244-20-AP-2658___

1. Contracting Activity: Department of Veterans Affairs, VISN 04 Chief Logistics Office for all medical centers located in the VISN 4 catchment area. 2237# 595-20-3-039-0048

2. Nature and/or Description of the Action Being Processed: Due to the COVID-19 Pandemic, VISN 4 has an urgent requirement for 25,000 face shields and 96,000 masks in order to protect our employees and veteran patients.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

A National Emergency has been declared by the President of the United States related to the Covid- 19 Pandemic. This acquisition is in support of the VA’s mission to care for potential veteran patients impacted by the Coronavirus and to protect VA personnel. The current Covid-19 Pandemic has placed a remarkable strain on the availability of face shields and masks, not only nationally, but internationally as well. Demand has increased markedly; however the impact of the pandemic has delayed and even halted manufacturing, significantly slowing supply chain response times.

4. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;

(x ) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;

( ) (6) National Security per FAR 6.302-6;

( ) (7) Public Interest per FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Multiple vendors were contacted, including several SDVOSB vendors were identified utilizing the VABIT tool in eCMS, including After Action Medical and Dental Supply, Diversity Supply Group and Corps Medical Supply. None of the vendors had any stock available for immediate shipment, and several did not respond to the requests.

6. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The quote submitted with the package was significantly less than other informal quotes, and pricing is determined to be fair and reasonable considering historical (compared to recent contract awards) pricing and scarcity of the items required in these times of a National Emergency.

7. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Multiple vendors were contacted regarding this requirement. Research will continue to be conducted during this national emergency to identify other potential sources for the needed PPE supplies.

8. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Competition before Making subsequent acquisitions for the supplies or services required:

In the future, should circumstances allow, competition will be sought to the maximum extent practicable.

11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
