INSTRUCTIONS TO OFFERORS

1.0 PERIOD FOR ACCEPTANCE OF QUOTES

The Offeror agrees to hold the prices in its quote firm for 60 calendar days from the date specified for receipt of quotes unless another time period is specified in an addendum to the RFQ. Quotes shall be submitted no later than – see Block 10. Quotes shall be submitted via email to Melva.Robinson@bep.gov.

2.0 REQUEST FOR CLARIFICATION

The Government intends to evaluate offers and award a contract without clarifications with Offerors. Therefore, the Offeror’s initial offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct clarifications if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

3.0 GENERAL QUOTE PREPARATION INSTRUCTIONS

Offerors shall submit a firm fixed price for all items. For any item where a quote will not be offered, the offeror shall state “No Quote”. The offeror shall use page 2 to submit pricing. The estimated delivery date shall be included on page 2. The quote shall include full specifications of proposed product. Please provide UEI or CAGE. Registration in the System for Award Management is required (www.sam.gov).

4.0 MULTIPLE AWARDS

The Government may accept any item or group of items of a quote, unless the Quoter qualifies the quote by specific limitations. Unless otherwise provided in the Schedule, Quotes may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity quoted, at the unit prices quoted, unless the Quoter specifies otherwise in the quote.

EVALUATION FACTORS

1.0 GENERAL

The quotes received under 2031ZA25Q00221 will be evaluated in accordance with the instructions contained in this section. If it is determined that a quotation is substantially not in compliance with the instructions above, the Government may deem that quotation to be unacceptable and it will not be evaluated further. The quotation may be removed from consideration for contract award. One award may be made to the Offeror whose quote is determined to best meet the needs of the Government after consideration of all factors.

2.0 EVALUATIONS METHODOLOGY

52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

The Government shall evaluate quotes based on Lowest Price, Technically Acceptable. For quotations determined technically acceptable, an offer will be made to the lowest priced quote. A quote will be determined technically acceptable if proposed quote takes no exception to the requirement listed in the item description and the proposed items meet the specifications.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
