About this file

This document is an Amendment of Solicitation (Standard Form 30) for a Bureau of Engraving and Printing (BEP) contract (Solicitation Number 2031ZA25Q00156) issued on 07/31/2025 with an effective date of 08/13/2025. The amendment addresses vendor questions about a recompete contract for nickel pellets, with the previous contract awarded under 2031ZA20D00002. The solicitation is set aside for small businesses and requires Buy American Made nickel pellets per FAR 25.101(b), reflecting recent changes in executive orders that removed nickel pellets from previous non-availability exceptions.

Key details include a requirement for six small nickel S pellet samples, which the contractor must provide and pay for, and clarification on economic price adjustments. The solicitation specifies that Made in America products are the only acceptable quotes, and while historical price adjustments were common, current regulations limit flexibility. The amendment emphasizes compliance with specific Federal Acquisition Regulation (FAR) clauses related to economic price adjustments, tariffs, and domestic sourcing requirements.

Question and Answer:

1. EPA Clause:

Question: We noticed that the solicitation does not include an Economic Price Adjustment (EPA) clause.

Historically, when raw material prices fluctuated, BEP made price adjustments accordingly. However, given the current volatility in the nickel market—especially due to the newly imposed tariffs under the Trump administration (30% on Canadian nickel and 15% on European nickel)—we would appreciate clarification on whether price adjustments will be permitted should such volatility affect future costs.

Answer: Page 33 states FAR 52.216-2 Economic Price Adjustment- Standard Supplies. This applies when nickel pellets being purchase in the United States; however, you are addressing the tariffs imposed by the Trump administration which would require to add FAR 52.216-4(a). This will be added if the solicitation opens to full and open competition and if small business set aside can’t be fulfilled according to FAR 25. This solicitation is open to small business. Nickel pellets used to be in FAR 25.103(b) Exceptions list, non-availability of Buy American statue, but on May 2025 Executive Order or called Revolutionary FAR Overhaul (RFO), nickel pellets is no longer in the exception list. Therefore, BEP is seeking Buy American Made nickel pellets per FAR 25.101(b).

2. Sample of Nickel S Pellets:

Question: The solicitation does not specify the quantity of Nickel S pellets required for sampling. As these pellets are packaged in boxes and are relatively costly, could you please confirm if BEP will bear the cost of the sample?

Answer: The requirement is six small samples (look like tablets). Contractor will pay for sending and providing the sample.

3. Call Orders:

Question: Regarding the reference to "call orders" in the solicitation, we would like to clarify whether these will allow for price adjustments over the contract period, especially in response to changes in raw material or tariff-related costs.

Answer: Follow FAR 52.216-2(c). This is currently set-aside to small business. Therefore, Made in America is the only acceptable quote at this time. See #1 posting.

4. Question: Is there any incumbent/recompete or this is a brand-new project? If yes, could you please provide us with their award number or even if the customer bought similar services in the past.

Answer: This requirement is a recompete. The existing contract was awarded under 2031ZA20D00002.
