Section C - Description/Specifications/Work Statement

Cardiac Treadmill Stress Test_SOW Description / Specifications / Statement of Work

1. Background Bureau of Engraving and Printing (BEP) facilities are protected by police officers who have arrest authority, as defined by 40 U.S.C. 1315. They protect life and property on BEP owned or operated (Leased) land and buildings, and must regularly make decisions on the appropriate application of force, the use of a firearm, police baton or OC spray. Applicant BEP police officers must meet certain functional requirements.

2. General Requirements

a. Contractor shall provide all required cardiac treadmill stress tests for police officer applicants for the BEP Washington, D.C. facility during the contract period. The cardiac treadmill stress tests shall be performed in accordance with (AHA/ACC) American Heart Association and American College of Cardiology guidelines designed to determine an officer's capability of conducting designated functional requirements essential to the duties of the BEP police officer.

b. BEP regulations require an initial cardiac stress test for BEP police officer applicants. The cardiac stress test shall be performed by a cardiologist with recognized expertise in performing the specifically focused test. Any medical conditions which could cause the applicant to be a hazard to them selves' or others during stressful situations and/or physical altercations may lead to medical disqualification.

3. Qualifications

a. Personnel assigned by the Contractor to perform the services covered by this contract shall be licensed in a State, Territory, Commonwealth of the United States, or the District of Columbia.

All licenses held by the personnel working on this contract shall be full and unrestricted licenses.

b. Services shall be provided by a Cardiologist(s) who has a medical degree from an accredited medical school, is experienced working with adults, and is experienced in performing cardiac treadmill stress tests of police officer/law enforcement applicants. It is highly desirable that the Cardiologist be board certified in Cardiology by the American Board of Medical Specialties.

The Cardiologist shall be a recognized expert demonstrating expertise in completing these specifically focused police officer exams.

c. The offeror's signature in Block 30a of the Standard Form 1449 (to be provided at time of award), Solicitation / Contract / Order for Commercial Items, is a certification that any individual providing services under this contract.

(1) Has no physical/mental limitations or other conditions that may adversely affect his/ her ability to perform as required by this contract;

(2) Has not had a loss, reduction, restriction, or revocation of his/her clinical privileges at any institution;

(3) Has not, is not currently, and is not pending any litigation for medical malpractice;

(4) Is a member in good standing or has not had a loss of medical staff membership at/or from any institution; and

(5) Has not, does not currently, and has pending currently, no felony criminal charges against him/her.

4. Confidentiality: FAR 52.224-1, Privacy Act Notification, and FAR 52.224-2, Privacy Act, apply to this contract and are incorporated by reference.

5. Contract Monitoring Procedures: The BEP COR (Contracting Officer's Representative) will communicate with the participating BEP medical center to determine whether required assessments were performed as scheduled and whether all contract requirements are being met. Any incidents of contract noncompliance, as evidenced by these monitoring procedures, shall be forwarded immediately to the contracting officer.

6. Quality Assurance: Approximately two months after contract award, a BEP police official will review randomly selected cases to ensure standardization of procedures and the reliability/validity of the contractor's results. The applicant name will be expunged from the cases to ensure confidentiality.

Reviews will thereafter be completed on an annual basis during the term of the contract unless required more frequently due to performance problems or complaints. An exception to the annual review requirement will occur if there were no cardiac treadmill stress tests performed in the previous twelve

(12) months.

7. Key Personnel and Emergency Temporary Substitutions:

a. The Contractor shall assign to this contract the following key personnel:

The cardiologist proposed under Offeror's technical proposal.

b. During the first ninety (90) days of performance, the Contractor shall make NO substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The contractor shall notify the Contracting Officer, in writing, within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90 day period of the contract, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

c. The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitution, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes shall have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the contractor within 15 calendar days after receipt of all required information of the decision on the proposed substitutes. The contract will be modified to reflect any approved changes of key personnel.

8. Joint Commission on the Accreditation of Healthcare Organizations (JCAHO) and Other Special Requirements:

a. The contractor will be responsible to ensure that contractor employees providing work on this contract are fully trained and completely competent to perform the required work.

b. Although this contract does not require JCAHO accreditation or other regulatory requirements regarding worker competency, the Contractor must perform the required work in accordance with JCAHO standards. The Contractor is required to provide a current performance evaluation on each cardiologist providing services under the contract. The Contractor will provide current copies of the performance evaluations at the time of the contract award and annually on the anniversary date of contract award to the BEP Contracting Officer, or upon request.

9. Types of Personnel Needing Assessment Police Officer Applicants

a. At a minimum, the cardiac treadmill stress tests for police officer applicants shall be consistent with Bruce Protocol requirements. Additional test instruments, available information, and interview questions should be used as deemed appropriate by the evaluating cardiologist. All interview questions and testing instruments should be chosen based upon their relevance to job performance and not subject to selective cultural gender or racial bias. All applicants for police officer positions must successfully complete cardiac treadmill stress testing before a final job offer is made.

Following the stress test, the contractor will make a formal recommendation to the agency health unit physician and the ranking Police Operations Division manager regarding the applicants' medical suitability.

10. Other Requirements

a. This contract does not mandate the use of any specific structured medical interview questions or specific medical testing instruments. The cardiologist may utilize structured interview formats and/or tests not identified herein during the performance of this contract, provided the selected interview formats and/or tests are validated instruments for cardiac assessments of police officers and the offeror submits a written narrative as part of the technical proposal supporting the validity of the selected assessment instruments. It is essential that the assessment process be standardized which will include the same set of interview questions and cardiac treadmill stress test battery (if applicable) shall be administered to all individuals assessed under this contract.

b. The cardiologist will provide each police officer applicant with an informed consent sheet to review, sign, and date.

c. All cardiac treadmill stress tests will be performed at offices/facilities operated by the contractor that are within fifty (50) miles of the Bureau of Engraving and Printing's Washington D.C. facility. The contractor will be given two (2) weeks' notice for scheduling purposes and will schedule tests in a timely manner. The exact date(s) and time(s) for performance of services will be coordinated between the Contractor and the Contracting Officer Representative (COR) or designee.

11. Report Format:

a. Rating of police officer candidates requiring cardiac treadmill stress testing, in addition to the overall results of a required physical, will be on the basis of the entire examination. Decisions regarding the suitability of candidates or the disposition of other personnel are entirely the prerogative and responsibility of the BEP ranking authority. The recommendations are advisory only and are based upon the best professional judgment of the examining cardiologist considering all data available at the time.

b. The final report will provide a general description of the examining cardiologists credentials, dates of review, and a description of the interview format utilized, testing procedures (if testing was performed) and the overall results. The report must specifically address whether the officer is medically fit to perform his/her duties, to include the carrying of the issued firearms. The report will conclude with one of the two (2) findings noted below, with supportive reasoning if conclusion two (2) is specified:

(1) RECOMMENDED: The individual was found to have no cardiac health issues which would cause significant concern at this time.

(2) NOT RECOMMENDED: In the best professional judgment of the examiner(s), we find that this person, at this time, does not possess the cardiac health deemed necessary to perform the duties of the position and is not considered to be medically fit for this position for reasons detailed in this report.

12. Confidentiality Agreement:

A. Contractor personnel performing work under this contract shall satisfy all requirements for appropriate security eligibility in dealing with access to sensitive information belonging to or being used on behalf of the Bureau of Engraving and Printing. The contractor will be responsible for the actions of those individuals they provide to perform work for the BEP under this contract. In the event that damages arise from work performed by contractor-provided personnel, under the auspices of this contract, the contractor will be responsible for all resources necessary to remedy the incident. Printed output containing sensitive BEP employee data will be stored in a secured area, and disposed of properly by shredding or similar methods. Under the provisions of the Privacy Act of 1974 as amended, personnel performing work under this contract have an obligation to indefinitely protect all U.S. government information.

B. All portable media (including, but not limited to thumb-drives, CR-ROMs, etc.) utilized by the contractor under this contract must be encrypted in accordance with the security requirements identified in FIPS 140-2.

C. All Hard drives utilized under this contract must also be encrypted in accordance with FIPS 140-2.

1052.224-1 DTAR 1052.224-1 Contract Publication The contractor shall submit, within ten business (10) days from the date of award of the contract or any order hereunder (exclusive of Saturdays, Sundays, and federal holidays), a .pdf file of the fully executed contract or order with all proposed necessary redactions, including redactions of any trade secrets or any commercial or financial information that it believes to be privileged or confidential business information, suitable for public disclosure at the sole discretion of the United States Department of the Treasury. The contractor shall provide a detailed written statement specifying the basis for each of its proposed redactions, including the applicable exemption under the Freedom of Information Act (FOIA), 5 U.S.C. § 552, and, in the case of FOIA Exemption 4, 5 U.S.C. § 552(b)(4), shall demonstrate why the information is considered to be a trade secret or commercial or financial information that is privileged or confidential. Information provided by the contractor in response to this requirement may itself be subject to disclosure under the FOIA. The Treasury will carefully consider all of the contractor's proposed redactions and associated grounds for nondisclosure prior to making a final determination as to what information may be properly withheld.

1052.232-7003 DTAR 1052.232-7003 Electronic Submission of Payment Requests (APR 2015)

(a) Definitions. As used in this clause—

(1) "Payment request" means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Content of Invoices" and the applicable Payment clause included in this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Invoice Processing Platform (IPP). Information regarding IPP, including IPP Customer Support contact information, is available at www.ipp.gov or any successor site.

(c) The Contractor may submit payment requests using other than IPP only when the Contracting Officer authorizes alternate procedures in writing in accordance with Treasury procedures.

(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the Contracting Officer's written authorization with each payment request.

52.217-8 52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days.

(a) The Government may extend the term of this contract by written notice to the Contractor within 60 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years .

(a) The COR is TBD.

(b) Performance of work under this contract is subject to the technical direction of the COR identified above, or a representative designated in writing. The term "technical direction" includes, without limitation, direction to the contractor that directs or redirects the labor effort, shifts the work between work areas or locations, and/or fills in details and otherwise serves to ensure that tasks outlined in the work statement are accomplished satisfactorily.

(c) Technical direction must be within the scope of the contract specification(s)/work statement. The COR does not have authority to issue technical direction that:

(1) Constitutes a change of assignment or additional work outside the contract specification(s)/work statement;

(2) Constitutes a change as defined in the clause entitled "Changes";

(3) In any manner causes an increase or decrease in the contract price, or the time required for contract performance;

(4) Changes any of the terms, conditions, or specification(s)/work statement of the contract;

(5) Interferes with the contractor's right to perform under the terms and conditions of the contract; or

(6) Directs, supervises or otherwise controls the actions of the Contractor's employees.

(d) Technical direction may be oral or in writing. The COR must confirm oral direction in writing within five workdays, with a copy to the Contracting Officer.

(e) The Contractor shall proceed promptly with performance resulting from the technical direction issued by the COR. If, in the opinion of the Contractor, any direction of the COR or the designated representative falls within the limitations of (c) above, the Contractor shall immediately notify the Contracting Officer no later than the beginning of the next Government work day.

1052.210-70 DTAR 1052.210-70 Contractor Publicity (APR 2015) The Contractor, or any entity or representative acting on behalf of the Contractor, shall not refer to the supplies or services furnished pursuant to the provisions of this contract in any news release or commercial advertising, or in connection with any news release or commercial advertising, without first obtaining explicit written consent to do so from the Contracting Officer.

Should any reference to such supplies or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government shall consider institution of all remedies available under applicable law, including 31 U.S.C. 333, and this contract. Further, any violation of this clause may be considered as part of the evaluation of past performance.

ALL OCCUPATIONS LISTED ABOVE RECEIVE THE FOLLOWING BENEFITS:

HEALTH & WELFARE: $4.27 per hour or $170.80 per week or $740.13 per month

VACATION: 2 weeks paid vacation after 1 year of service with a contractor or successor, 3 weeks after 5 years, and 4 weeks after 15 years. Length of service includes the whole span of continuous service with the present contractor or successor, wherever employed, and with the predecessor contractors in the performance of similar work at the same Federal facility. (Reg. 29 CFR 4.173)

HOLIDAYS: A minimum of ten paid holidays per year: New Year's Day, Martin Luther

King Jr.'s Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans' Day, Thanksgiving Day, and Christmas Day. (A contractor may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the employees involved.) (See 29 CFR 4.174)

THE OCCUPATIONS WHICH HAVE NUMBERED FOOTNOTES IN PARENTHESES RECEIVE THE FOLLOWING:

1) COMPUTER EMPLOYEES: Under the SCA at section 8(b), this wage determination does not apply to any employee who individually qualifies as a bona fide executive, administrative, or professional employee as defined in 29 C.F.R. Part 541. Because most Computer System Analysts and Computer Programmers who are compensated at a rate not less than $27.63 (or on a salary or fee basis at a rate not less than $455 per week) an hour would likely qualify as exempt computer professionals, (29 C.F.R. 541.

400) wage rates may not be listed on this wage determination for all occupations within those job families. In addition, because this wage determination may not list a wage rate for some or all occupations within those job families if the survey data indicates that the prevailing wage rate for the occupation equals or exceeds

$27.63 per hour conformances may be necessary for certain nonexempt employees. For example, if an individual employee is nonexempt but nevertheless performs duties within the scope of one of the Computer Systems Analyst or Computer Programmer occupations for which this wage determination does not specify an SCA wage rate, then the wage rate for that employee must be conformed in accordance with the conformance procedures described in the conformance note included on this wage determination.

Additionally, because job titles vary widely and change quickly in the computer industry, job titles are not determinative of the application of the computer professional exemption. Therefore, the exemption applies only to computer employees who satisfy the compensation requirements and whose primary duty consists of:

(1) The application of systems analysis techniques and procedures, including consulting with users, to determine hardware, software or system functional specifications;

(2) The design, development, documentation, analysis, creation, testing or modification of computer systems or programs, including prototypes, based on and related to user or system design specifications;

(3) The design, documentation, testing, creation or modification of computer programs related to machine operating systems; or

(4) A combination of the aforementioned duties, the performance of which requires the same level of skills. (29 C.F.R. 541.400).

2) AIR TRAFFIC CONTROLLERS AND WEATHER OBSERVERS - NIGHT PAY & SUNDAY PAY: If you work at night as part of a regular tour of duty, you will earn a night differential and receive an additional 10% of basic pay for any hours worked between 6pm and 6am.

If you are a full-time employed (40 hours a week) and Sunday is part of your regularly scheduled workweek, you are paid at your rate of basic pay plus a Sunday premium of 25% of your basic rate for each hour of Sunday work which is not overtime

(i.e. occasional work on Sunday outside the normal tour of duty is considered overtime work).

An 8 percent differential is applicable to employees employed in a position that represents a high degree of hazard when working with or in close proximity to ordnance, explosives, and incendiary materials. This includes work such as screening, blending, dying, mixing, and pressing of sensitive ordnance, explosives, and pyrotechnic compositions such as lead azide, black powder and photoflash powder.

All dry-house activities involving propellants or explosives. Demilitarization, modification, renovation, demolition, and maintenance operations on sensitive ordnance, explosives and incendiary materials. All operations involving re-grading and cleaning of artillery ranges.

A 4 percent differential is applicable to employees employed in a position that represents a low degree of hazard when working with, or in close proximity to ordnance, (or employees possibly adjacent to) explosives and incendiary materials which involves potential injury such as laceration of hands, face, or arms of the employee engaged in the operation, irritation of the skin, minor burns and the like;

minimal damage to immediate or adjacent work area or equipment being used. All operations involving, unloading, storage, and hauling of ordnance, explosive, and incendiary ordnance material other than small arms ammunition. These differentials are only applicable to work that has been specifically designated by the agency for ordnance, explosives, and incendiary material differential pay.
