About this file

This is a proposal and special provisions document for a Regionwide Tree Clearing project administered by the Wisconsin Department of Transportation (WisDOT). The contract encompasses tree clearing, erosion control, traffic control, and all incidental work across two project areas (Area 12 and Area 13) along USH 14. The work includes site mobilization, traffic control setup for various closure types (shoulder, lane, and ramp closures), semi-permanent restoration with erosion control materials, pedestrian accommodations, and coordination with multiple utility companies operating within the construction limits. The project is subject to minimum notification requirements of three calendar days for shoulder closures and three business days for lane and ramp closures. Holiday and special event work restrictions apply during specified periods from November 2025 through January 2027, including Thanksgiving, Christmas, New Year's Day, and MLK Day. The contract requires WPDES Transportation Construction General Permit (TCGP) coverage for Area 12, which involves more than one acre of land disturbance, while Area 13 requires less than one acre of disturbance and is not subject to TCGP requirements.

The proposal includes multiple special provision bid items with unit prices to be determined, including Site Mobilization (SPV.0060.01), Site Traffic Control (SPV.0060.02), Semi-Permanent Restoration (SPV.0060.03), and various traffic control configurations for different road conditions. The contractor retains ownership of timber salvaged from clearing activities and must properly dispose of or utilize this material rather than burning or burying it on the right-of-way. The contract incorporates comprehensive utility coordination requirements with 16 utility companies and districts, including Alliant Energy, Madison Gas & Electric, AT&T Wisconsin, Frontier Communications, and others, with specific notification periods ranging from 3 working days to 30 calendar days before work near utility facilities. Environmental compliance requirements include adherence to Section 404 Transportation Regional General Permit standards for wetlands work, compliance with Wisconsin's aquatic invasive species control procedures, and proper equipment decontamination protocols. The contract also establishes provisions for prompt subcontractor payment within 10 calendar days of receiving progress payments, with no allowance for retainage withholding.

CERTIFICATION REGARDING DEBARMENT, SUSPENSION, AND OTHER

RESPONSIBILITY MATTERS - PRIMARY COVERED TRANSACTIONS

Instructions for Certification

1. By signing and submitting this proposal, the prospective contractor is providing the certification set out below.

2. The inability of a person to provide the certification required below will not necessarily result in denial of participation in this covered transaction. The prospective contractor shall submit an explanation of why it cannot provide the certification set out below. The certification or explanation will be considered in connection with the department or agency's determination whether to enter into this transaction. However, failure of the prospective contractor to furnish a certification or an explanation shall disqualify such person from participation in this transaction.

3. The certification in this clause is a material representation of fact upon which reliance was placed when the department determined to enter into this transaction. If it is later determined that the contractor knowingly rendered an erroneous certification in addition to other remedies available to the Federal Government the department may terminate this transaction for cause or default.

4. The prospective contractor shall provide immediate written notice to the department to whom this proposal is submitted if at any time the prospective contractor learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

5. The terms "covered transaction," "debarred," "suspended," "ineligible," "lower tier covered transaction," "participant," "person," "primary covered transaction," "principal," "proposal," and "voluntarily excluded," as used in this clause, have the meanings set out in the Definitions and Coverage sections of the rules implementing Executive Order 12549. You may contact the department to which this proposal is being submitted for assistance in obtaining a copy of those regulations.

6. The prospective contractor agrees by submitting this proposal that, should this contract be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department entering into this transaction.

7. The prospective contractor further agrees by submitting this proposal that it will include the clause titled "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion-Lower Tier Covered Transaction," which is included as an addendum to PR- 1273 - "Required Contract Provisions Federal Aid Construction Contracts," without modification, in all lower tier covered transactions and in all solicitations for lower tier covered transactions.

8. The contractor may rely upon a certification of a prospective subcontractor/materials supplier that it is not debarred, suspended, ineligible, or voluntarily excluded from the covered transaction, unless it knows that the certification is erroneous. A contractor may decide the method and frequency by which it determines the eligibility of its principals. Each contractor may, but is not required to, check the Disapproval List (telephone # 608/266/1631).

Effective with December 2000 Letting Debarment Certification

9. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in good faith the certification required by this clause. The knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

10. Except for transactions authorized under paragraph 6 of these instructions, if a contractor in a covered transaction knowingly enters into a lower tier covered transaction with a person who is suspended, debarred, ineligible or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department may terminate this transaction for cause or default.

Certification Regarding Debarment, Suspension, and Other Responsibility Matters - Primary Covered Transactions

(a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal department or agency;

(d) Have not within a three-year period preceding this proposal had one or more public transactions (Federal, State or local) terminated for cause or default.

The approval will include all conditions to the request as mutually agreed upon by WisDOT and DNR.

Protection of Endangered Bats Federally protected bats have the potential to inhabit the project limits because they roost in trees, bridges, culverts, and other structures. Roosts may not have been observed on this project, but conditions to support the species exist. The species and all active roosts are protected by the federal Endangered Species Act. If an individual bat or active roost is encountered during construction operations, stop work, and notify the engineer and the WisDOT Regional Environmental Coordinator

(REC).

Ensure all operators, employees, and subcontractors working in areas of known or presumed bat habitat are aware of environmental commitments and avoidance and minimization measures (AMMs) to protect both bats and their habitat.

Direct temporary lighting, if used, away from wooded areas during the bat active season April 15 to October 31, both dates inclusive.

Tree Clearing/Trimming:

To avoid adverse impacts upon protected bats, do not perform tree clearing/trimming between April 15 and October 31, both dates inclusive. If the required tree clearing/trimming is not completed by April 14, the department will suspend all tree clearing/trimming and associated work directly impacted by clearing/trimming.Tree clearing/trimming is limited to that which is specified in the plans. Contractor means and methods to remove additional trees/branches will not be allowed. If it is determined that additional trees with a 3-inch or greater diameter at breast height (dbh), or branches of any size on those sized trees, need to be removed beyond contractor means and methods, notify the engineer to coordinate with the WisDOT REC to determine if consultation with United States Fish and Wildlife Service (USFWS) is required. The contractor must be aware that the WisDOT REC and/or USFWS may not permit modifications.

Due to potential for erosion, do not perform grubbing operations at the time of tree clearing unless grading activities will commence in those areas immediately following the tree clearing, or as otherwise approved by the engineer. Provide information for the grubbing and grading activities, including the schedule of operations, in the Erosion Control Implementation Plan (ECIP).

Blanding’s Turtle (Emydoidea blandingii) Area 12

Blanding’s Turtle is a Special Concern species in Wisconsin and has been known to inhabit the project area. Install “J-turns” at all silt fence ends adjacent to waterways to redirect them from the project areas.

6. Traffic.

Submit to engineer for approval a detailed traffic control plan for any changes to the proposed traffic control as shown on the plans. Submit the plan 14 days prior to the preconstruction conference, or if after the preconstruction conference, 14 days prior to the intended use of the revised traffic control. A request does not constitute approval.

If plan details are not provided in the traffic control plan, furnish plans for review by the engineer so that approval, or disapproval, is obtained at least three business days prior to any closure.

5105-16-63 6 of 18

Maintain access to all commercial, private, and field entrances for residents, businesses, and emergency vehicles. If access is to be temporarily closed, notify those affected at least two business days in advance of the closure. Do not restrict or close access to a property without notifying the property owner, resident, or business a minimum of 48 hours in advance.

Conduct operations in such a manner that causes the least interference and inconvenience to the free flow of vehicles and bicyclists on the roadways. This includes the following:

• All construction vehicles and equipment entering or leaving live traffic lanes shall yield to through traffic and bicyclists.

• Equip all vehicles and equipment entering or leaving the live traffic lanes with a hazard identification beam (flashing yellow signal) capable of being visible on a sunny day when viewed without the sun directly on or behind the device from a distance of 1000 feet. Activate the beam when merging into or exiting a live traffic lane.

• Do not deliver or store materials or equipment within open travel lanes or open side roads during any stage of construction. Temporary lane closures and/or halting of traffic within open roadways is not permitted.

Area-Specific Information Area 12

General No full freeway closures are allowed.

Active work zones and lane closures along USH 14 shall be limited to a maximum length of 4 miles at a time. Any lane closure exceeding 4 miles in length must be approved by the engineer.

Only one lane closure in a direction of travel along USH 14 will be allowed at a time.

Equipment, vehicles, and materials are not allowed to remain on the freeway shoulders and ramp shoulders when the contractor is not actively working.

If plan details are not provided in the traffic control plan, furnish plans for review by the engineer so that approval, or disapproval, is obtained at least three business days prior to any closure.

During lane closures, keep drums out of the open lane of traffic. When traffic is reduced to a single lane, drums may be placed in the open lane to shift traffic onto the shoulder only in the immediate vicinity of work with the approval of the engineer. Restore drums immediately after completing work in that area.

Material and equipment delivery is only permitted within lane closures.

Do not use maintenance crossovers to make U-turns unless the inside lanes in both directions are closed and the turn can be made without encroaching into adjacent open lanes. Do not use existing median crossovers for storage of equipment or materials.
