About this file
This is a proposal and bidding document issued by the Wisconsin Department of Transportation for the Town of Bradford, concerning the replacement of the O'Riley Road over Turtle Creek Bridge (Project B-53-0390) located in Rock County. The scope of work includes replacing the existing structure, performing grading and base aggregate work, installing dense asphalt pavement, guardrail installation, clearing and grubbing, erosion control items, finishing work, permanent signing, tree clearing, and all incidental items necessary for project completion as shown on the plans. The contract is governed by the Wisconsin Department of Transportation Standard Specifications for Highway and Structure Construction, 2025 Edition, and includes comprehensive special provisions addressing environmental protection, threatened and endangered species mitigation, utility coordination, and construction sequencing. Work must begin within ten calendar days after the engineer issues written notice to proceed, with a start date to be provided within one month of contract execution and at least 14 calendar days before the preconstruction conference. The O'Riley Road must be closed to through traffic during construction with access maintained for nearby residences; alternative routes are available. Construction sequencing is mandatory to protect threatened species habitat, with site mobilization and traffic control restricted before April 1, deck and pier removal not beginning before April 1 and avoiding certain wetlands until after May 1, causeway construction occurring between April 1 and June 1, and all work within 20 feet of Turtle Creek completed by September 15.
Bidders must submit proposals using electronic bidding methods through the Bid Express system, with paper bids accepted only under waiver with a $75 administrative fee per proposal. A proposal guaranty in proper form and amount is required, payable to the State of Wisconsin if the bidder fails to execute the contract and contract bond within fourteen days of notification. Bidders must possess a properly executed annual bid bond on file with the department and a digital ID enabled by Info Tech Inc. prior to electronic submission. The department will measure Underwater Substructure Inspection once per individual substructure unit, Installing and Maintaining Bird Deterrent System as a single unit per structure, Creek Bed Stone by each project acceptably completed, and Steel Thrie Beam Structure Approach Curved by linear foot. Special provisions address extensive environmental requirements including compliance with the federal Migratory Bird Treaty Act regarding swallow nesting deterrents, a Biologic Opinion for endangered snake species requiring qualified biologist oversight and specific construction timing, an Incidental Take Authorization requiring species surveys and relocation efforts, and a Fish Broad Incidental Take Authorization addressing fish species protection. Contractors must maintain drone liability insurance with minimum coverage of $1,000,000 for drones weighing ten pounds or less, submit Waterway Marker Applications to the Wisconsin Department of Natural Resources by February 1 of the construction season for navigational safety on Turtle Creek, and comply with aquatic exotic species control procedures for all equipment contacting state waters. Holiday and special event work restrictions prohibit material hauling and traffic along affected routes during Memorial Day, Independence Day, and Labor Day weekends.

CERTIFICATION REGARDING DEBARMENT, SUSPENSION, AND OTHER
RESPONSIBILITY MATTERS - PRIMARY COVERED TRANSACTIONS
Instructions for Certification
1. By signing and submitting this proposal, the prospective contractor is providing the certification set out below.
2. The inability of a person to provide the certification required below will not necessarily result in denial of participation in this covered transaction. The prospective contractor shall submit an explanation of why it cannot provide the certification set out below. The certification or explanation will be considered in connection with the department or agency's determination whether to enter into this transaction. However, failure of the prospective contractor to furnish a certification or an explanation shall disqualify such person from participation in this transaction.
3. The certification in this clause is a material representation of fact upon which reliance was placed when the department determined to enter into this transaction. If it is later determined that the contractor knowingly rendered an erroneous certification in addition to other remedies available to the Federal Government the department may terminate this transaction for cause or default.
4. The prospective contractor shall provide immediate written notice to the department to whom this proposal is submitted if at any time the prospective contractor learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
5. The terms "covered transaction," "debarred," "suspended," "ineligible," "lower tier covered transaction," "participant," "person," "primary covered transaction," "principal," "proposal," and "voluntarily excluded," as used in this clause, have the meanings set out in the Definitions and Coverage sections of the rules implementing Executive Order 12549. You may contact the department to which this proposal is being submitted for assistance in obtaining a copy of those regulations.
6. The prospective contractor agrees by submitting this proposal that, should this contract be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized by the department entering into this transaction.
7. The prospective contractor further agrees by submitting this proposal that it will include the clause titled "Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion-Lower Tier Covered Transaction," which is included as an addendum to PR- 1273 - "Required Contract Provisions Federal Aid Construction Contracts," without modification, in all lower tier covered transactions and in all solicitations for lower tier covered transactions.
8. The contractor may rely upon a certification of a prospective subcontractor/materials supplier that it is not debarred, suspended, ineligible, or voluntarily excluded from the covered transaction, unless it knows that the certification is erroneous. A contractor may decide the method and frequency by which it determines the eligibility of its principals. Each contractor may, but is not required to, check the Disapproval List (telephone # 608/266/1631).
Effective with December 2000 Letting Debarment Certification
9. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render in good faith the certification required by this clause. The knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
10. Except for transactions authorized under paragraph 6 of these instructions, if a contractor in a covered transaction knowingly enters into a lower tier covered transaction with a person who is suspended, debarred, ineligible or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department may terminate this transaction for cause or default.
Certification Regarding Debarment, Suspension, and Other Responsibility Matters - Primary Covered Transactions

Coordination with DNR for the Waterway Marker Application and Permit should begin on or before February 1 of the construction season to allow enough time for approval prior to start of construction.
For reference, there are two types of waterway markers, informational or controlling/restrictive. During the application process you will be notified if you need informational or controlling/restrictive markers. If controlling/restrictive markers are required, please allot enough time to work with the municipality as a local ordinance will need to be adopted.
The general steps for submission of a Waterway Marker Application and Permit are as follows:
1. Please fill out the Waterway Marker Application and Permit form:
http://dnr.wi.gov/files/PDF/forms/8700/8700-058.pdf
Please identify The Wisconsin Department of Transportation as the applicant.
2. Include an aerial map-diagram or engineered-diagram of the work location and the placement of the waterway markers (buoys). If proposed GPS coordinates for each buoy are not provided, then markers placed on the diagram must show distance (in feet) from each marker location and from one permanent fixture as a benchmark.
3. Forward the signed application/permit to me and the local Recreational Safety Warden Jason Roberts Jason.Roberts@wisconsin.gov.
4. If controlling/restrictive navigational markers are required, also provide the completed application/permit to the local municipality having jurisdictional authority over the area in which the waterway markers will be placed. Consult with the local municipality regarding their ordinance adoption process.
DNR will communicate with the local Warden and Recreational Safety Warden in processing and finalizing the permit. If the permit application is incomplete, or additional information is needed, the Recreation Safety Warden will work with DNR’s Regional WisDOT Liaison to resolve.
Furnishing, installing, and removing buoys and aids shall be included in the bid item “Traffic Control”.
10. Environmental Protection, Aquatic Exotic Species Control.
Exotic invasive organisms such as VHS, zebra mussels, purple loosestrife, and Eurasian water milfoil are becoming more prolific in Wisconsin and pose adverse effects to waters of the state. Wisconsin State Statutes 30.07, "Transportation of Aquatic Plants and Animals; Placement of Objects in Navigable Waters", details the state law that requires the removal of aquatic plants and zebra mussels each time equipment is put into state waters.
At construction sites that involve navigable water or wetlands, use the follow cleaning procedures to minimize the chance of exotic invasive species infestation. Use these procedures for all equipment that comes in contact with waters of the state and/or infested water or potentially infested water in other states.
Ensure that all equipment that has been in contact with waters of the state, or with infested or potentially infested waters, has been decontaminated for aquatic plant materials and zebra mussels before being used in other waters of the state. Before using equipment on this project, thoroughly disinfect all equipment that has come into contact with potentially infested waters. Guidelines from the Wisconsin Department of Natural Resources for disinfection are available at:
http://dnr.wi.gov/topic/invasives/disinfection.html
Use the following inspection and removal procedures:
1. Before leaving the contaminated site, wash machinery and ensure that the machinery is free of all soil and other substances that could possibly contain exotic invasive species;
2. Drain all water from boats, trailers, bilges, live wells, coolers, bait buckets, engine compartments, and any other area where water may be trapped;
3. Inspect boat hulls, propellers, trailers and other surfaces. Scrape off any attached mussels, remove any aquatic plant materials (fragments, stems, leaves, seeds, or roots), and dispose of removed mussels and plant materials in a garbage can before leaving the area or invested waters; and
4. Disinfect your boat, equipment and gear by either:
4.1. Washing with ~212 F water (steam clean), or
4.2. Drying thoroughly for five days after cleaning with soap and water and/or high pressure water, or http://dnr.wi.gov/files/PDF/forms/8700/8700-058.pdf mailto:Jason.Roberts@wisconsin.gov http://dnr.wi.gov/topic/invasives/disinfection.html
3614-00-78 6 of 12
4.3. Disinfecting with either 200 ppm (0.5 oz per gallon or 1 Tablespoon per gallon) Chlorine for 10-minute contact time or 1:100 solution (38 grams per gallon) of Virkon Aquatic for 20- to 30-minute contact time. Note: Virkon is not registered to kill zebra mussel veligers nor invertebrates like spiny water flea. Therefore, this disinfect should be used in conjunction with a hot water (>104º F) application.
Complete the inspection and removal procedure before equipment is brought to the project site and before the equipment leaves the project site.

13. Notice to Contractor, Biologic Opinion Requirements.
A Biologic Opinion (BO) was issued on June 26, 2026 for one of the state endangered/federally threatened snakes with habitat existing within the project limits. The following are requirements of the BO:
• Follow the construction sequencing and phasing listed in the Prosecution and Progress. This has been developed so ground disturbing activities will be completed during the snakes’ active season (April 1 through November 15) to provide an opportunity for individuals to leave the areas prior to being impacted.
• Crews will receive an environmental briefing, from a qualified biologist approved by the WDNR ER Transportation Liaison, covering snake identification and procedures, including daily checks for the snake under equipment and around stockpiles. Project personnel will be instructed to report any snake observations during construction to the WisDOT Environmental Manager who will report observations to the USFWS within 24 hours.
• Erosion control fencing will include J turns consistent with DNR amphibian/reptile protocols.
• Erosion control will consist of 100% biodegradable materials and use a loose weave that allows animals to get free.
• Preconstruction sweeps for the snake will be completed prior to, and during, vegetation removal and erosion control fencing installation. Vegetation removal will be conducted using hand-operated equipment in wetlands and within 20 feet of Turtle Creek.
• Construction sweeps for the snake will be completed by a qualified biologist prior to any ground related disturbance within the snake habitat zone.
• If the snake is located during preconstruction sweeps, the qualified biologist will attempt to capture and relocate the snake to a suitable adjacent habitat outside the work area.
• Upon suspected snake encounter, crews will halt work in the immediate area, allow the animal to self-relocate, and notify the WisDOT representative. Any relocation will be conducted only by the qualified biologist holding appropriate state and federal permits.
• Work will occur during daytime hours with maintained mufflers and federal permits.
• Primary access and staging will use the closed roadway. Any additional staging will be located in the uplands and will be set at a distance determined reasonable, based on project conditions and site access restrictions, by the project engineer.
• Substances that could harm federally listed species (ex: oil, fuel) will be located a minimum of 30 feet above the ordinary high water mark (EL 839.34) of Turtle Creek for the duration of construction.
14. Notice to Contractor, Incidental Take Authorization Requirements.
An Incidental Take Authorization (ITA) was approved by DNR for two snake species, a fish species, and a mussel species within the project limits. The following are requirements of the ITA:
• Follow the construction sequencing and phasing listed in the Prosecution and Progress. This has been developed to minimize impacts on all threatened and endangered species in the project area.
• Crews will receive an environmental briefing from a qualified biologist, approved by the WDNR ER Transportation Liaison, covering the identification of the species and applicable conservation measures and response procedures if listed species are observed.
• Ground disturbing activities need to be completed in an enclosed area that has been surveyed for listed species. This is shown in the plans as the area encompassed by silt fence, hay bales, and turbidity barrier and is referred to as the “exclusion fence area”.
• Vegetation clearing within 20 feet of Turtle Creek will be completed using hand-operated equipment from April 1 to November 15. Woody vegetation grubbing within the project area will only occur after the exclusion fence area has been set up and listed species have been removed from the project area.
3614-00-78 8 of 12
• The qualified biologist will monitor construction activities as well as lead all listed species survey, rescue, and relocation efforts. No project-related disturbances will be allowed inside the exclusion fence area until listed species have been surveyed and removed from the project area.
• Trim, with hand tools, any overhanging vegetation outside the exclusion fence area to prevent listed species accessing the project area.
• Grading may not begin until vegetation removed from project area and exclusion fence area has been inspected for species by the qualified biologist.
• Hay bales will be placed across the roadway to fully enclose the project area and will be replaced immediately after equipment enters or exists the exclusion fence area.
• Cofferdams are to be removed as soon as possible after pier construction is completed.
• Cofferdam install, dewatering, and pumping operations will occur during daylight hours under oversight of the qualified biologist.
