About this file

This is a sole source notice issued by an Oregon state agency regarding the procurement of Wildlife Acoustics passive monitoring devices. The notice documents the agency's determination that Wildlife Acoustics is the sole source capable of providing the required equipment and justifies the use of a sole source procurement method rather than competitive bidding. The procurement involves passive monitoring devices used for wildlife acoustic research and monitoring purposes. The notice establishes the agency's intent to award a contract exclusively to Wildlife Acoustics based on the unique specifications and technical requirements of the monitoring equipment needed for the project.

The sole source justification is based on Wildlife Acoustics' proprietary technology and the specialized nature of the passive monitoring devices required for the agency's specific wildlife monitoring applications. No competitive bidding process will be conducted, and no alternative vendors are considered capable of meeting the stated requirements. This procurement approach allows the agency to proceed directly with contract negotiations and award to Wildlife Acoustics without the typical competitive solicitation timeline, expediting the acquisition of critical monitoring equipment for the wildlife management program.

Solicitation Notice Number: S-62900-00009962

Solicitation Number: S-62900-00017590

The Oregon Department of Forestry (ODF) intends to enter into a sole source contract with Wildlife Acoustics (WA) as the only provider of a Passive Acoustic Monitoring (PAM) device having the specifications necessary to effectively and efficiently utilize required federal survey protocols. More specifically, for the purchase of Song Meter® Mini 2 (Li-ion) Acoustic Recorders. ODF has determined that there is only one manufacturer or seller of the product of the quality, performance or functionality required to complete the work these devices are intended to aid in completing.

ODF’s research has led it to believe that Wildlife Acoustics (WA) is the only provider of a Passive Acoustic Monitoring (PAM) device having the features necessary to effectively and efficiently utilize required federal survey protocols.

Those mandatory specifications include:

(1) Approved for use by U.S. Fish and Wildlife survey protocols. Must be compatible with U.S. Department of Agriculture and Cornell University species classifiers.

(2) Portability- THE WA PAM device is only 1 pound per unit, making it suitable for manual transport into remote areas for practical use for ODF target projects, ODF finds that a heavier unit would not be suitable for this purpose. (i.e., 15 lbs per unit compared to 1 lb per unit for WA PAM device).

(3) Storage- small size of units makes it practical for seasonal storage of hundreds of units, whereas a larger unit would be impractical for seasonal storage.

(4) WA PAM device does not require a proprietary data subscription, which poses a risk of losing device operability and data access if the company should cease operations.

ODF intends to enter into this sole source agreement under authority granted in OAR 125-247- 0275.

If another vendor believes they can provide the goods described in this notice, they have until July 31, 2026 at 2:00 PM PT to submit a protest.
