☒ Shall Apply.

a. Section 3. This Project is subject to Section 3 of the Housing and Urban

Development Act of 1968 (12 U.S.C. § 1701u) and 24 C.F.R. Part 75, which require that, to the greatest extent feasible, employment and contracting opportunities generated by this federally assisted Project be directed to low-and very-low-income persons (Section 3 workers) and to Section 3 business concerns. The successful Bidder shall track and report Section 3 labor-hour data and shall complete the Section 3 participation forms required by the

Florida Department of Commerce, as further detailed in the Form of

Agreement.

b. M/WBE Solicitation. The City and the Contractor shall take affirmative steps, as required by 2 C.F.R. § 200.321 and Form SC-66, § 9, to solicit and use minority business enterprises, women's business enterprises, and labor surplus area firms when possible. Each Bidder shall document its good-faith efforts to solicit M/WBE subcontractors and suppliers and shall submit the M/WBE

Good-Faith-Effort Documentation form included in this Solicitation with its Bid.

c. Required Forms. The forms identified in Section 10 (10.7 Required Bid

Contents) shall be completed and submitted as specified. Failure to submit required Section 3 or M/WBE documentation as specified may affect the responsiveness determination or, for post-award forms, the issuance of the

Notice to Proceed.

SECTION 8 – EVALUATION AND BASIS OF

AWARD

8.1 Evaluation

This Solicitation is issued as a competitive sealed bid pursuant to §255.20, Florida

Statutes. Award, if made, shall be to the lowest responsive and responsible

Bidder whose Bid conforms in all material respects to the requirements of this ITB.

The lowest responsive and responsible Bidder shall be determined based on the

Base Bid amount stated in the Bid Form.

Estimated quantities are approximate and are provided solely for comparison of

Bids. Actual quantities may increase or decrease as required for completion of the Work, and payment shall be based on actual quantities incorporated into the Work at the Unit Prices bid.

Where Add Alternates are included, the City may determine award based on the Base Bid or Total Evaluated Bid Amount alone, or plus any combination of

Add Alternates selected by the City.

8.2 Responsiveness

The City will review each Bid to determine whether it is responsive to the requirements of this ITB.

A responsive Bid is one that conforms in all material respects to the Solicitation

Documents without material deviation, reservation, or irregularity.

Failure to submit required forms, failure to acknowledge addenda, failure to include required bonds, or failure to comply with material requirements of this ITB may result in the Bid being deemed non-responsive.

8.3 Clarifications

The City may request clarification of information submitted in a Bid for the purpose of resolving ambiguities or confirming compliance with the requirements of this ITB.

Clarifications shall not constitute negotiations and shall not permit modification of price, scope, or other material terms of the Bid.

Clarifications shall not cure a material defect or omission.

8.4 Responsibility

The City shall determine whether the lowest responsive Bidder is responsible. In determining responsibility, the City may consider factors including, but not limited to:

• Relevant experience on projects of similar size and scope

• Financial capacity and bonding capability

• Availability of equipment and personnel

• Safety record

• Past performance on public construction projects

• Compliance with applicable statutory requirements

• Ability to obtain required insurance and permits

The City may request additional information to assist in its responsibility determination. Failure to provide requested information within the time specified may result in a determination of non-responsibility.

8.5 Rejection of Bids

The City reserves the right to:

• Reject any or all Bids.

• Reject a Bid determined to be mathematically or materially unbalanced.

• Waive minor irregularities or informalities that do not affect price, competition, or substantive rights.

• Verify references and qualifications.

• Conduct investigations as permitted by law.

• Award in the best interest of the City as authorized by law.

The City’s determination of responsiveness and responsibility shall be final, subject to applicable protest procedures set forth in the City of Milton

Purchasing Policy 9.0.

8.6 Tie Bids

In the event of a tie between two or more lowest responsive and responsible

Bidders, the tie shall be resolved in accordance with the City of Milton

Purchasing Policy 9.0.

SECTION 9 – AWARD PROCESS AND

CONTRACT

9.1 Notice of Intended Award

Following completion of the evaluation described in Section 8, the City will post a Notice of Intended Award identifying the lowest responsive and responsible

Bidder. The Notice of Intended Award shall be posted in accordance with the

City of Milton Purchasing Policy 9.0.

9.2 Protest Procedures

Any actual or prospective Bidder who is aggrieved in connection with this

Solicitation or the intended award may file a protest in accordance with the procedures and timeframes set forth in the City of Milton Purchasing Policy 9.0.

The protest period shall commence upon posting of the Notice of Intended

Award. Failure to timely file a protest in accordance with Purchasing Policy 9.0 shall constitute a waiver of all protest rights.

9.3 Notice of Award

If no timely protest is filed, or upon resolution of any timely protest, the City may issue a Notice of Award to the successful Bidder.

Issuance of the Notice of Award does not authorize commencement of the

Work and does not constitute a binding contract between the parties.

9.4 Contract Execution and Bond Submission

Within the time specified in the Notice of Award, the successful Bidder shall:

• Execute the Form of Agreement;

• Furnish the required Performance and Payment Bonds in accordance with

§255.05, Florida Statutes; and

• Provide all required insurance documentation.

Execution of the Agreement and submission and approval of required bonds and insurance are conditions precedent to issuance of the Notice to Proceed.

9.5 Failure to Execute or Provide Required Bonds

Failure of the successful Bidder to timely execute the Agreement or furnish required bonds and insurance may result in withdrawal of the award and forfeiture of the Bid Bond as permitted by law.

The City may, at its discretion, award the Contract to the next lowest responsive and responsible Bidder or reject all Bids and re-solicit.

9.6 Notice to Proceed

The Contractor shall not commence Work until the City issues a written Notice to

Proceed. The Contract Time shall commence as stated in the Notice to

Proceed.

9.7 Contract Term

The Contract shall become effective upon execution by both parties and shall remain in effect until Final Completion has been achieved, all closeout requirements have been satisfied, and final payment has been made, unless terminated earlier in accordance with the Contract Documents.

9.8 Contract Time

a. Substantial Completion shall be achieved within 335 Calendar Days after issuance of the Notice to Proceed.

b. Final Completion shall be achieved within 365 Calendar Days after issuance of the Notice to Proceed.

Substantial Completion is delayed beyond the required date.

Failure to achieve Final Completion within the Contract Time shall result in assessment of Liquidated Damages of $500.00 per Calendar Day for each day

Final Completion is delayed beyond the required date.

Liquidated Damages for Final Completion shall apply only after Substantial

Completion has been achieved and shall not be assessed concurrently with
