About this file

This is a Justification for an Exception to Fair Opportunity document submitted by the United States Transportation Command (USTRANSCOM) Directorate of Acquisition.

USTRANSCOM seeks to acquire a one-year Maritime Portal AISLive (Gold) subscription from Standard & Poor's Global (S&P Global), doing business as IHS Global, Inc., with two one-year option periods. The subscription runs from October 23, 2026 through October 22, 2029 and will be awarded as a Firm-Fixed Price task order against the Library of Congress FEDLINK contract. The subscription includes the SeaWeb module, Distance Tables, and an Online Connect Platform licensed for 50 concurrent users. The total estimated value is redacted in the document. USTRANSCOM requires this specific subscription to support global operational sealift mission planning, as it stands as the industry standard for maritime intelligence and consolidates critical shipping capability data essential for real-time course-of-action development for senior leadership.

The justification for the brand-name-only exception is based on FAR 16.507-7 (Item Peculiar to One Manufacturer). S&P Global exclusively controls the proprietary intellectual property, algorithms, data retrieval methodologies, and distance calculation models powering the portal. No other vendor combines the required capabilities—detailed pier data, commercial vessel characteristics with real-time ship location data, and map planning tools with integrated navigation rules and piracy identification—into a single solution with current data feeds. The Contracting Officer (Dorothy H. DelRosario) certified the justification on August 3, 2026, and will use price analysis techniques per FAR 15.404-1 to ensure fair and reasonable pricing. The Government commits to continuously monitoring the commercial market to determine if comparable maritime tracking solutions become available.

4. IDENTIFICATION OF THE EXCEPTION TO FAIR OPPORTUNITY AND

SUPPORTING RATIONALE.

FAR 16.507-7 – Item Peculiar to One Manufacturer, essential to the Government’s requirement.

(Brand Name)

This requirement represents a Brand Name Only acquisition. Standard & Poor’s Global (S&P Global), doing business as IHS Global, Inc., remains the sole source capable of delivering the capabilities required for global operational sealift mission planning using its AISLive and SeaWeb Portal. USTRANSCOM requires the Maritime Portal (Gold) subscription because it stands as the industry standard for maritime intelligence.

The integration of industry-leading reference data and business rules for global ocean shipping capabilities directly on the portal site remains essential for timely sealift mission planning. The subscription consolidates critical information into a single package, helping with real-time course-of-action development and visualization for senior leaders. This capability helps USTRANSCOM maintain decision advantage and preserves decision space for successful mission operations.

Specific capabilities provided by this subscription include:

Detailed pier data: Identifies capacity for roll-on/roll-off operations, crane availability, and hazardous cargo handling.

Commercial vessel characteristics: Provides real-time ship location data, deck information, and International Maritime Organization ship identification numbers for compliance with maritime regulations.

Map planning tools: Offers day-by-day planning with integrated sea navigation rules, piracy and danger area identification for risk mitigation, and "what-if" scenario development.

No other vendor combines all of these required capabilities into a single solution that also provides the latest updates to the data feed. S&P Global exclusively owns the intellectual property rights, proprietary algorithms, data retrieval methodologies, and distance calculation models powering the portal.

Because S&P Global strictly controls these proprietary datasets and integration methodologies, no other brand or software suite can fulfill the agency's requirement. Requiring USTRANSCOM to adopt a different software package would disrupt established analytical workflows and require personnel to spend thousands of hours rebuilding data integration models to accommodate a different data format.

5. DETERMINATION BY THE CONTRACTING OFFICER THAT ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE.

The Contracting Officer will use price analysis techniques in accordance with FAR 15.404-1 to determine that the quoted prices are fair and reasonable.
