ARTICLE 1—DEFINED TERMS
1.01 Terms used in these Instructions to Bidders have the meanings indicated in the General Conditions and Supplementary Conditions. Additional terms used in these Instructions to Bidders have the meanings indicated below:
A. Issuing Office—The office from which the Bidding Documents are to be issued, and which registers plan holders.
ARTICLE 2—BIDDING DOCUMENTS
2.01 Bidder shall obtain a complete set of Bidding Requirements and proposed Contract Documents (together, the Bidding Documents). See the Agreement for a list of the Contract Documents. It is Bidder’s responsibility to determine that it is using a complete set of documents in the preparation of a Bid. Bidder assumes sole responsibility for errors or misinterpretations resulting from the use of incomplete documents, by Bidder itself or by its prospective Subcontractors and Suppliers.
2.02 Bidding Documents are made available for the sole purpose of obtaining Bids for completion of the Project and permission to download or distribution of the Bidding Documents does not confer a license or grant permission or authorization for any other use. Authorization to download documents, or other distribution, includes the right for plan holders to print documents solely for their use, and the use of their prospective Subcontractors and Suppliers, provided the plan holder pays all costs associated with printing or reproduction. Printed documents may not be re-sold under any circumstances nor transferred to third parties except as expressly allowed in these Instructions.
2.03 Owner has established a Bidding Documents Website as indicated in the Advertisement or invitation to bid. Owner recommends that Bidder register as a plan holder with the Issuing Office at such website, and obtain a complete set of the Bidding Documents from such website. Bidders may rely that sets of Bidding Documents obtained from the Bidding Documents Website are complete unless an omission is blatant. Registered plan holders will receive Addenda issued by Owner.
2.04 Electronic Documents
A. When the Bidding Requirements indicate that electronic (digital) copies of the Bidding Documents are available, such documents will be made available to the Bidders as Electronic Documents in the manner specified.
1. Bidding Documents will be provided in Adobe PDF (Portable Document Format) (.pdf) that is readable by Adobe Acrobat Reader Version 2019 or later. It is the intent of the Engineer and Owner that such Electronic Documents are to be exactly representative of the paper copies of the documents. However, because the Owner and Engineer cannot totally control the transmission and receipt of Electronic Documents nor the Contractor’s means of reproduction of such documents, the Owner and Engineer cannot and do not guarantee that Electronic Documents and reproductions prepared from those versions are identical in every manner to the paper copies.
B. Unless otherwise stated in the Bidding Documents, the Bidder may use and rely upon complete sets of Electronic Documents of the Bidding Documents, described in Paragraph 2.04.A above. However, Bidder assumes all risks associated with differences

arising from transmission/receipt of Electronic Documents versions of Bidding Documents and reproductions prepared from those versions and, further, assumes all risks, costs, and responsibility associated with use of the Electronic Documents versions to derive information that is not explicitly contained in printed paper versions of the documents, and for Bidder’s reliance upon such derived information.
ARTICLE 3—QUALIFICATIONS OF BIDDERS

D. Approval of Registration through the Connecticut Department of Energy & Environmental Protection General Permit to Act as a Contractor to Contain, Remove, or Otherwise Mitigate the Effects of Certain Releases.
E. Other required information regarding qualifications.
3.02 A Bidder’s failure to submit required qualification information within the times indicated may disqualify Bidder from receiving an award of the Contract.
3.03 No requirement in this Article 3 to submit information will prejudice the right of Owner to seek additional pertinent information regarding Bidder’s qualifications.
ARTICLE 4—PRE-BID CONFERENCE
4.01 A non-mandatory mandatory pre-bid conference will be held at the time and location indicated in the Advertisement or invitation to bid. Representatives of Owner and Engineer will be present to discuss the Project. Bidders are encouraged to attend and participate in the conference;
however, attendance at this conference is not required to submit a Bid.
4.02 Information presented at the pre-Bid conference does not alter the Contract Documents. Owner will issue Addenda to make any changes to the Contract Documents that result from discussions at the pre-Bid conference. Information presented, and statements made at the pre-bid conference will not be binding or legally effective unless incorporated in an Addendum.

email to the bidder’s address on file. It is the Bidder’s responsibility to review and confirm that the Bid has been withdrawn successfully. An unopened Bid may be withdrawn by an appropriate document duly executed in the same manner that a Bid must be executed and delivered to the place where Bids are to be submitted prior to the date and time for the opening of Bids. Upon receipt of such notice, the unopened Bid will be returned to the Bidder.
15.02 Bids may be modified and resubmitted prior to the Bid opening through the Project’s bidding service website. If a Bidder wishes to modify its Bid prior to Bid opening, Bidder must withdraw its initial Bid in the manner specified in Paragraph 15.01 and submit a new Bid prior to the date and time for the opening of Bids.
15.03 If within 24 hours after Bids are opened any Bidder files a duly signed written notice with Owner and promptly thereafter demonstrates to the reasonable satisfaction of Owner that there was a material and substantial mistake in the preparation of its Bid, the Bidder may withdraw its Bid, and the Bid security will be returned. Thereafter, if the Work is rebid, the Bidder will be disqualified from further bidding on the Work.
ARTICLE 16—OPENING OF BIDS
16.01 Bids will be opened at the time and place indicated in the advertisement or invitation to bid and, unless obviously non-responsive, read aloud publicly. An abstract of the amounts of the base Bids and major alternates, if any, will be made available to Bidders after the opening of Bids.
ARTICLE 17—BIDS TO REMAIN SUBJECT TO ACCEPTANCE
17.01 All Bids will remain subject to acceptance for the period of time stated in the Bid Form, but Owner may, in its sole discretion, release any Bid and return the Bid security prior to the end of this period.
ARTICLE 18—EVALUATION OF BIDS AND AWARD OF CONTRACT
18.01 Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner also reserves the right to waive all minor Bid informalities not involving price, time, or changes in the Work.
18.02 Owner will reject the Bid of any Bidder that Owner finds, after reasonable inquiry and evaluation, to not be responsible.
18.03 If Bidder purports to add terms or conditions to its Bid, takes exception to any provision of the Bidding Documents, or attempts to alter the contents of the Contract Documents for purposes of the Bid, whether in the Bid itself or in a separate communication to Owner or Engineer, then Owner will reject the Bid as nonresponsive.
18.04 If Owner awards the contract for the Work, such award will be to the responsible Bidder submitting the lowest responsive Bid.
18.05 Evaluation of Bids
A. In evaluating Bids, Owner will consider whether the Bids comply with the prescribed requirements, and such alternates, unit prices, and other data, as may be requested in the Bid Form or prior to the Notice of Award.

B. In the comparison of Bids, alternates will be applied in the same order of priority as listed in the Bid Form. To determine the Bid prices for purposes of comparison, Owner will announce to all bidders a “Base Bid plus alternates” budget after receiving all Bids, but prior to opening them. For comparison purposes alternates will be accepted, following the order of priority established in the Bid Form, until doing so would cause the budget to be exceeded. After determination of the Successful Bidder based on this comparative process and on the responsiveness, responsibility, and other factors set forth in these Instructions, the award may be made to said Successful Bidder on its base Bid and any combination of its additive alternate Bids for which Owner determines funds will be available at the time of award.
C. For the determination of the apparent low Bidder when unit price bids are submitted, Bids will be compared on the basis of the total of the products of the estimated quantity of each item and unit price Bid for that item, together with any lump sum items.
18.06 In evaluating whether a Bidder is responsible, Owner will consider the qualifications of the Bidder and may consider the qualifications and experience of Subcontractors and Suppliers proposed for those portions of the Work for which the identity of Subcontractors and Suppliers must be submitted as provided in the Bidding Documents.
18.07 Owner may conduct such investigations as Owner deems necessary to establish the responsibility, qualifications, and financial ability of Bidders and any proposed Subcontractors or Suppliers.
18.08 Before award is made to a Bidder not a resident of the State in which the Project is located, such Bidder shall be properly licensed and authorized to do business in Connecticut and shall designate in said State a person on whom service of process can be made in the event of litigation.
ARTICLE 19—BONDS AND INSURANCE
19.01 Article 6 of the General Conditions, as may be modified by the Supplementary Conditions, sets forth Owner’s requirements as to performance and payment bonds, other required bonds (if any), and insurance. When the Successful Bidder delivers the executed Agreement to Owner, it must be accompanied by required bonds and insurance documentation. Delivery of said bonds and insurance is an EXPRESS CONDITION PRECEDENT to the Successful Bidder’s right, but not its obligation, to perform Work.
19.02 Article 8, Bid Security, of these Instructions, addresses any requirements for providing bid bonds as part of the bidding process.
19.03 The “Hold Harmless” Indemnification endorsement of the insurance shall include the interest of the Town of Hebron and the State of Connecticut. The Contractor and Subcontractors and other interests shall be so named.
ARTICLE 20—SIGNING OF AGREEMENT
20.01 When Owner issues a Notice of Award to the Successful Bidder, it will be accompanied by the unexecuted counterparts of the Agreement along with the other Contract Documents as identified in the Agreement. Within 15 days thereafter, Successful Bidder must execute and deliver the required number of counterparts of the Agreement and any bonds and insurance documentation required to be delivered by the Contract Documents to Owner. Within 10 days thereafter, Owner will deliver one fully executed counterpart of the Agreement to Successful

Bidder, together with printed and electronic copies of the Contract Documents as stated in Paragraph 2.02 of the General Conditions.
ARTICLE 21—SALES AND USE TAXES
21.01 Owner is exempt from State of Connecticut state sales and use taxes on materials and equipment to be permanently incorporated in the Work. (Exemption No. [number]). Said taxes must not be included in the Bid. Refer to Paragraph SC-7.10 of the Supplementary Conditions for additional information.
ARTICLE 22—NON-DISCRIMINATION AND EQUAL EMPLOYMENT OPPORTUNITY
22.01 The Contract Documents provide that the Contractor and his Subcontractors shall not discriminate against any employee or applicant for employment because of race, creed, color, national origin, age, sex, sexual orientation, marital status or physical disability. The successful Bidder must be prepared to comply in all respects with the provisions regarding non-discrimination as set forth in the Contract Documents and all applicable Federal and State laws.
ARTICLE 23—COMPLIANCE WITH ALL LAWS, ORDINANCES, RULES, REGULATIONS, AND CODES
23.01 All applicable Federal, State and Municipal laws, ordinances, rules, regulations and codes of all authorities having jurisdiction over construction work in the locality of the Project shall apply to the Contract throughout and they are deemed to be included in the Contract Documents the same as though written therein.
23.02 Attention is directed to laws and regulations of the State Labor Department with respect to employment conditions and minimum wages.
ARTICLE 24—DEPARTMENT OF ECONOMIC AND COMMUNITY DEVELOPMENT REQUIREMENTS
24.01 Bidders are advised that valid Registration through the Connecticut Department of Energy and Environmental Protection General Permit to Act as a Contractor to Contain, Remove, or Otherwise Mitigate the Effects of Certain Releases is required. Subject: Tershen Mill Brownfield Remediation Filing # 133388 NDDB – New Determination Number: 202506948 459 Church St Amston
Expiration Date: 9/23/2027
Current data maintained by the Natural Diversity Database (NDDB) and housed in the DEEP ezFile portal indicates that populations of the following State Endangered, Threatened, or Special Concern species (RCA Sec. 26-306) have been documented within the project area or in close proximity to the proposed Remediation/Contaminated soil remediation, Tershen Mill Brownfield Remediation.
Brook floater (Alasmidonta varicosa) Eastern pearlshell (Margaritifera margaritifera) Eastern hognose snake (Heterodon platirhinos) Spotted turtle (Clemmys guttata) Wood turtle (Glyptemys insculpta)
In accordance with the project information provided in your request submittal, implementation of the following Best Management Practices will avoid negative impacts to listed species:
Common Name Brook floater Scientific Name Alasmidonta varicosa Taxa invertebrate Status1 E General Ecology Habitat: Small to medium-sized rivers, usually in gravel and cobble substrates in swift current.
Host fish include longnose dace (Rhinichthys cataractae), blacknose dace (Rhinichthys atratulus), slimy sculpin (Cottus cognatus), golden shiner (Notemigonus crysoleucas), pumpkinseed sunfish (Lepomis gibbosus), yellow perch (Perca flavescens), and tessellated darter (Etheostoma olmstedi). The brook floater is critically imperiled throughout most of New England, including Connecticut. Remaining populations of brook floaters are found in undisturbed sections of streams in the upper reaches of watersheds that have relatively in-tact upland forest. DEEP Wildlife Division considers all streams with populations of brook floaters to be conservation priorities. Protected riparian buffers should be increased from the standard

100ft to 300ft of streams within 1km upriver of brook floater habitat. Percent forest cover throughout the watershed as well as adjacent to the rivers and streams has been highly correlated with Brook floater persistence, and this buffer will help maintain local habitat characteristics for this sensitive species.
Best Management Practice We do not anticipate significant negative impacts to this species from your Project
Type category selected in this location. Impact from this project can be minimized if you follow any applicable Best Practices and monitoring associated with your project activities and/or permit requirements, minimize impact to and loss of preferred habitat, and include any protection measures included here in the Species General Ecology that relate to your project activities before, during, and after completion.
Common Name Eastern pearlshell Scientific Name Margaritifera margaritifera Taxa invertebrate Status1 SC General Ecology This freshwater mussel species lives buried in clean, stable, mixed substrate in fast-flowing unpolluted streams and rivers. Its host fish include Atlantic salmon (Salmo salar), brook trout (Salvelinus fontinalis), brown trout (Salmo trutta), rainbow trout (Onchorhynchus mykiss). Best habitats are good trout streams that are heavily shaded by a riparian canopy, possess clean cold water with high dissolved oxygen, and have stable channels with substrates of coarse sand, gravel, and cobble. Factors that limit the eastern pearlshell are changes to water quality, including eutrophication, acidification, sedimentation, and increases in water temperature.
Common Name Eastern hognose snake Scientific Name Heterodon platirhinos Taxa reptile Status1 SC General Ecology In Connecticut, these snakes are found in well-drained forest bottomlands and a matrix of open deciduous forests and early successional habitat, including powerlines. Within the early successional habitat, they preferentially use habitat that consists of sandy soils with medium to high vegetation cover and coarse woody debris. They tend to avoid dense forest, wetlands and developed areas. Paved roads may present a barrier to dispersal and connectivity within populations. Snakes are dormant between November 1 and April 1. They will overwinter in a variety of habitats, preferably at the edges of forest and within open habitats if available. They have been observed to overwinter under areas of tree roots, rodent burrows, rock crevices, or excavate their own dens in sandy soils. Many of these harmless snakes are killed by people who are convinced that they are venomous and dangerous. When confronted, the hognose snake will suck in air, spread the skin around its head and neck like a cobra, hiss, and lunge as if to strike. Take the time to learn about, understand, and respect this reptile, and share your knowledge with others. Being able to identify and educate others about the eastern hog-nosed snake can help conserve this species. The more people that are aware of the physical and behavioral identification of this unique snake, the more individuals that can be spared from unnecessary killing. If you encounter a hog-nosed snake, observe it from a distance and allow it to go on its way. All snakes will retreat from humans if given a chance.
Best Management Practice Apply time of year restrictions as appropriate for the habitat types you will be conducting work.
• Construction that involves ground disturbance in suitable habitat described above should be done during the active season, which is April 1 through Oct. 31 to avoid killing hibernating animals.
• Construction that will be confined to managed turf grass , agricultural fields, 00 31 46-6
22 04/2026 impervious or graveled surfaces, or areas confined to compacted soil can be conducted at any time of year.
For work conducted during the active season (April 1- Oct 31):
• Construction workers should be apprised of the species description and possible presence and that any snakes encountered site should not be killed.
• The immediate work area should be scanned for reptiles before starting work using mechanical equipment
• Any reptiles found should be moved out of the way. These animals are protected by law and should never be taken off site.
• Work conducted during early morning and evening hours should occur with special care not to harm basking individuals.
• No vehicles or heavy machinery should be parked overnight in any sandy areas especially within early successional habitat or along forest edges.
• Areas where excavated or stockpiled materials are stored will be first…
