About this file

This Request for Proposal (RFP) is issued by Harrisonburg City Public Schools (HCPS) in Virginia to solicit sealed proposals from qualified contractors to supply fresh fruits and vegetables for the school division's nutrition program. The RFP seeks to establish one or more qualified suppliers to provide inside delivery of fresh produce to HCPS's 10 schools (6 elementary, 2 middle, and 2 high schools) on an as-needed basis. The scope of work requires contractors to furnish all labor, equipment, and supervision necessary for delivery with prices quoted on an FOB destination basis. Weekly deliveries are required between 7:00 AM and 2:00 PM, with no deliveries permitted on weekends or during HCPS holidays. The proposal closing date is May 12, 2026, at 12:00 PM (noon), with the final day for questions set at May 5, 2026. No mandatory pre-proposal meeting is scheduled. The subsequent contract will be a firm-fixed-price agreement for an initial one-year term beginning July 1, 2026, with four optional one-year renewal periods. HCPS reserves the right to obtain comparative pricing from full-service food distributors, purchase from local suppliers outside the contract, obtain items from approved Department of Defense suppliers, and make on-site visits to assess contractor capabilities.

Pricing must be submitted on the required Price List (Attachment M) with all prices remaining firm throughout the initial contract term and including all charges for fulfillment. Contractors must provide weekly price lists with items identified as locally grown and note any Virginia-grown produce on their offerings. HCPS emphasizes preference for pesticide and herbicide-free products and local Virginia produce, with the ability to provide local sourcing noted as an evaluation criterion. Payment terms require monthly billing statements submitted no later than the fifth of each month detailing contract numbers, delivery tickets, order numbers, and costs by school location. Evaluation criteria include pricing (15 points), years of experience (5 points), references (10 points), HACCP plan (10 points), Virginia farm usage (10 points), computerized pricing lists (5 points), product and market updates (5 points), invoicing capability (5 points), delivery schedule compliance (15 points), delivery handling (15 points), and prior HCPS experience (5 points). The procurement is subject to Virginia Public Procurement Act requirements and includes special terms and conditions for contracts using state and federal funds, including Buy American provisions requiring domestic products to comprise over 51 percent of food products, with non-domestic purchases capped at 10 percent of total annual commercial food costs by July 1, 2025.

11.0 AWARD OF CONTRACT

Selection shall be made of two (2) or more Offerors deemed to be fully qualified, responsible and best suited among those submitting proposals, on the basis of the factors involved in the Request for Proposal, including price if so stated in the Request for Proposal. In the case of a proposal for information technology, as defined in Virginia Code § 2.2-2006, a public body shall not require an offeror to state in a proposal any exception to any liability provisions contained in the Request for Proposal.

Negotiations shall then be conducted with each of the Offerors so selected. The Offeror shall state any exception to any liability provisions contained in the Request for Proposal in writing at the beginning of negotiations, and such exceptions shall be considered during negotiation. Price shall be considered, but need not be the sole or primary determining factor. After negotiations have been conducted with each Offeror so selected, the public body shall select the Offeror which, in its opinion, has made the best proposal and provides the best value, and shall award the contract to that Offeror. When the terms and conditions of multiple awards are so provided in the Request for Proposal, awards may be made to more than one Offeror. Should the public body determine in writing and in its sole discretion that only one Offeror is fully qualified, or that one Offeror is clearly more highly qualified than the others under consideration, a contract may be negotiated and awarded to that Offeror.

Once the selection has been made as to which Offeror will be awarded the contract, the Procurement Specialist will post a Notice of Award on the eVA website athttps://eva.virginia.gov/. The award documentationwill subsequently be followed by a contract incorporating by reference all the requirements, terms and conditions of the solicitation and the Offeror’s proposal as negotiated.

Successful Offeror shall contact the Commissioner’s Office to obtain proper business licensing for the City of Harrisonburg, if it does not already possess (540-432-7704).
