Questions?

UNCLASSIFIED

Small Business Set-Asides And

Command Goals

Suzanne Mudd-Yarber, Director

Small Business Programs, TCAQ-SB

• Small Business Set-Asides – Definition, Purpose, and Preference

• Criteria in Making a Set-Aside Acquisition Strategy Determination

• Partial Set-Asides - When and How to Apply

• Insufficient Reasoning for Not Setting Aside an Acquisition

• Command’s Small Business Prime Contractor Achieved Goals

• Calculation of an Agency’s Small Business Prime Contractor Achieved Goals

• Subcontracting Goals Relationship to the Command’s SB Prime Contractor Achieved Goals

AGENDA

UNCLASSIFIED

Small Business Programs

• Definition

– A reasonable expectation of receiving two or more offers from responsible small business concerns that are competitive in terms of fair market prices, quality and delivery. [Federal Acquisition Regulation

(FAR) Subpart 19.502-2(a)]

• Purpose

– The use of this acquisition strategy allows the Contracting Officer to limit the acquisition exclusively to small business prime concerns [FAR Subpart 19.501(a)(1)]

• Preference

– There is no order preference among the 8(a) Business Development, Historically Underutilized Zone, Service-Disabled Veteran-Owned Small Business, or the Women-Owned Small Business programs when determining the set-aside [FAR Subpart 19.203(a)]

SMALL BUSINESS SET-ASIDES

UNCLASSIFIED

TOGETHER, WE DELIV ER.• Criteria

– A requirement had been accepted in the 8(a) Business Development Program

– Market Research; Respond to Requests for Information (RFIs)

– The Small Business Administration (SBA) Procurement Center Representative (PCR) can recommend a set-aside to the Contracting Officer

– Reserve when conducting multiple awards using full and open competition

• Misconception

– Current acquisition was set-aside so acquisition strategy should be the same for follow-on (other than

8(a) program)

– Command has not met Small Business Prime Contractor Goals

– Assumption that small business concern peers will respond to the RFI

– Assumption the Small Business Professional will mandate a set-aside

CRITERIA IN MAKING A SET-ASIDE STRATEGY DETERMINATION

UNCLASSIFIED

• Partial Set-Asides – When [FAR Subpart 19.502-3(a)(1)-(4)]

– A total set-aside is ruled out during market research

– The requirement can be divided into distinct portions

– Simplified acquisition procedures (FAR Subpart 13) does not apply

– Two or more responsible small business concerns are expected to offer on set-aside portion

• Partial Set-Asides – How [FAR Subpart 19.502-3(b)-(d)]

– The solicitation shall identify which contract line item is set-aside

– Other than small business concerns submitting an offer for the set-aside shall be rejected

PARTIAL SET ASIDES - WHEN AND HOW

UNCLASSIFIED

• Insufficient Reasons [FAR Subpart 19.502-5(a) – (h)]

– The Contracting Officer independently decides to solicit as a different acquisition strategy even though market research supports follow-on as a set-aside

– The item is on an established planning list under the Industrial Readiness Planning Program

– The item is on a Qualified Products List

– Offers are due in less than 30 days

– Classified acquisition

– Command’s Small Business Prime Contractor goals are exceeding projected goals

– Another contracting activity has determined the requirement to be a “class” small business set-aside

– The product description is a brand name or equal

INSUFFICIENT REASONING FOR NOT SETTING ASIDE

UNCLASSIFIED

• What is a Small Business Prime Contractor Achieved Goals

– It is the dollars and percentages of obligations being awarded to small business and socioeconomic concerns as a prime contractor

– TRANSCOM’s goals are not the same percentage as the Department of Defense (DoD)

• TRANSCOM contributes to DoD’s overall goals

• How are the Goals Determined

– DoD Office of Small Business Programs (OSBP) assign the projected Small Business and Small

Disadvantaged Business goals

– The remaining socioeconomic projected goals (SDVOSB, WOSB, and HUBZone) are developed by my office based on historical data

SMALL BUSINESS PRIME CONTRACTOR ACHIEVED GOALS

• Which Categories Make Up the Small Business Prime Contractor Achieved Goal

– Small Business

– Small Disadvantaged Business

– Service-Disabled Veteran-Owned Small Business

– Women-Owned Small Business

– Historically Underutilized Business Zone

• Monitoring Goals

– Systems for Award Management (SAM)

• Report is titled - Small Business Achievements by Awarding Organizations

• Tracking dollars/percentages on monthly basis

• Data is shared with the Acquisition Directorate

SMALL BUSINESS PRIME CONTRACTOR ACHIEVED GOALS

TOGETHER, WE DELIV ER.• FORMULA

– The Small Business Category Dollars divided by the Total Eligible Small Business Dollars =

Percentage

• EXAMPLE

− The Total Eligible Small Business Dollars (LB + SB) = $100,000

CALCULATING SB PRIME CONTRACTOR ACHIEVED GOALS

UNCLASSIFIED

UNCLASSIFIED

Small Business Programs

CATEGORY DOLLARS PERCENTAGE

SB $50,000 50%

SDB $25,000 25%

SDVOSB $10,000 10%

WOSB $20,000 20%

HUBZone $5,000 5%

• Subcontracting Goals versus the Small Business Prime Contractor Achieved Goals

– These goals are two different entities and have no related relationship

– Subcontracting goals define the amount of work to be performed by subcontractors

• When are Subcontracting Goals Required

– If an acquisition with a value greater than the simplified acquisition threshold and subcontracting opportunities exist, the apparently successful offeror (other than a small business concern) shall submit a subcontracting plan

• Development of Subcontracting Goals

– Target goals in a solicitation may be based on market research, historical data, or statutory goals

– Contracting Officer can designate the goals to be a percentage of the total contract dollars

– The offeror determines its own dollars and percentages
