2. PROJECT DESCRIPTION

2.1 Description of Project

The Project includes the installation of approximately 1,700 ft of HDD, and approximately 900 ft of open trench pipeline within private and County roads, in Ben Lomond, California, between Glen Arbor Rd and Brackney Rd. The HDD pipeline is a 24-inch (ID) HDPE pipeline. Conductor casings, approximately 108 ft and 97 ft in length, are required at each side of the HDD. The conductor casings are steel pipelines with a minimum diameter of 48-inches.

2.2 Project Scope

The Prime Contractor’s Scope of Work for the Project includes, but is not limited, to the following:

a. Installation of 24” (ID) diameter HDPE/PVC pipeline and associated appurtenances between Glen

Arbor Rd and Brackney Rd:

i. Installation of conductor casing, approximately 108 ft and 97 ft in length, at each side of the

HDD conductor casing. Conductor Casing installation work must be performed by a pre-qualified Conductor Casing Installation Contractor.

ii. Installation of approximately 1,700 ft, 24” (ID) diameter HDPE pipeline via Horizontal Directional Drilling using the drill-and-intersect method. HDD work must be performed by a pre-qualified HDD contractor.

iii. Installation of approximately 900 LF, 24” diameter PVC pipeline via conventional open-cut

iv. Two tie-ins to the existing pipeline on Glen Arbor Rd and Brackney Rd.

v. Restoration of work areas to pre-construction conditions

The Project includes furnishing all labor, materials, tools, transportation, equipment, and temporary construction features required to perform and complete all work for the Project. Work shall include all material, labor, equipment, and apparatus, whether specifically mentioned or not, necessary to complete the specified work. The Preliminary Contract Schedule duration is approximately 380 working days.

2.3 Project Challenges

a. Inadvertent Fluid Return – Geotechnical data and proximity to San Lorenzo River pose a challenge to eliminate risk of inadvertent fluid return into the San Lorenzo River.

b. Ben Lomond Fault – Fault in project zone may cause drilling difficulties

c. Project Area Constraints – the project is location in Ben Lomond, CA in a residential neighborhood.

September 2023 Page 5

Our staging areas, work areas, and access is all located near residents and best practices must be taken to maximize the usable area and minimize impacts to the neighborhood.

d. The Contractor will coordinate with the City to perform shutdowns of the existing pipeline, and testing of the installed pipeline.

e. Contractor must comply with federal funding requirements. See Exhibit II - Supplemental Contract Provisions for Contracts Funded in-part by FEMA Hazard Mitigation Assistance- for additional requirements.

f. Potential presence of special status species in or near the work area that can restrict work hours and species protection buffers which can cause project shutdowns and/or resequencing of construction activities.

g. Construction activities near trees requiring protection and implementation of specialty construction methods (e.g., trenching) and/or root protections (e.g., mulching or plating) under the supervision of a Qualified Arborist.

h. Scheduling constraints for the Project include the following:

- The maximum duration of a system shutdown shall be 10 working days during April 15 to July 31 and only 5 working days outside of this window when the City is more dependent on the source. It is likely that the Contractor will desire tie-in work during the period from September through March. In the event the Contractor can not adjust tie-in work to occur during a ten-day window from April 15 to July 31, the Contractor will be provided with multiple 5-day tie-in windows after July 31 and before April 15 provided the City can operationally afford the water shutdown to accommodate the tie in work. It is weather and rain accumulation information that is impossible to predict that will dictate the tie-in work outside of the dates of April 15 through July 31. The City will work to accommodate, but it is strongly recommended the Contractor to achieve the ten-day shutdown window for tie-ins from April 15 through July 31. City will work to accommodate shutdowns outside of the windows referenced.

i. Excavation and grading activities on or near slopes exceeding thirty (30) percent shall occur outside of the winter rainy season (October 1 through April 30) at the discretion of the City, based on weather conditions and forecasts. Other environmental requirements may be added in the final contract documents at the time of bidding.

2.4 NOT USED

2.5 Project Funding

The City is using federal funding from the Federal Emergency Management Agency (FEMA) Hazardous Mitigation Grant Program (HMGP). See Exhibit II for Supplemental Contract Provisions for Contracts Funded in-part by FEMA Hazard Mitigation Assistance.

2.5.1 Disadvantaged Business Enterprises (DBE) and Labor Surplus Area (LSA) Firms The following affirmative steps are required to ensure small businesses, minority and women’s owned businesses (DBEs), and labor surplus area firms (LSAs) are used when possible, per 2 CFR §200.321:

Place DBEs/LSAs on solicitation lists and solicit to them when they are a potential source.

Use the services of organizations such as the Small Business Administration and the Minority

Business Development Agency.

When economically feasible, divide total requirements into smaller tasks or quantities and establish delivery schedules.

Keep records of good faith efforts to contract with DBEs and LSAs.

Require subcontractors to follow the above affirmative steps.

September 2023 Page 6

2.6 Good Faith Effort for Local Hire

Contractor and Subcontractors shall comply with Santa Cruz Municipal Code (SCMC) Chapter 3.10, which will be incorporated into the Contract by reference. SCMC Chapter 3.10 specifically requires the City’s contractors and their subcontractors to make good faith efforts to hire qualified individuals who are local residents, as workers on City public works projects valued greater than the limit for formal bidding (as set forth in Laws and Regulations) unless prohibited by Laws or Regulations.

2.7 Prevailing Wage Requirements

To the extent that the work or services to be performed under this Agreement may be considered a “public work” pursuant and subject to Labor Code section 1720 et seq., Contractor (and any subcontractor performing the work or services) shall conform to all prevailing wage requirements applicable to such work/and or services under this Agreement. Contractor (and any subcontractor) shall adhere to the prevailing wage determinations made by the Director of Industrial Relations (DIR) pursuant to California Labor Code Part 7, Chapter 1, Article 2, applicable to the work, if any. All workers employed in the execution of a public works contract (as such term is defined California Labor Code section 1720 et seq. and section 1782(d)(1)) must be paid not less than the specified prevailing wage rates for the type of work performed. Reference: California Labor Code sections 1720, 1774 and 1782. Contractor agrees to be bound by the prevailing wage requirements to the extent applicable to the scope of work and services under this Agreement, including, but not limited to, the following:

a. If a worker is paid less than the applicable prevailing wage rate owed for a calendar day (or any portion thereof), Contractor shall pay the worker the difference between the prevailing wage rate and the amount actually paid for each calendar day (or portion thereof) for which the worker(s) was paid less than the prevailing wage rate, as specified in Labor Code Section 1775.

b. Contractor shall maintain and make available payroll and worker records in accordance with Labor Code Sections 1776 and 1812.

d. Contractor is aware of the limitations imposed on overtime work by Labor Code sections 1810 et seq.

and shall be responsible for any penalties levied in accordance with Labor Code Section 1813 for failing to pay required overtime wages.

e. Contractor shall post a copy of the applicable wage rates at each jobsite at a location readily available to its workers.

Any failure of Contractor and/or its subcontractors to comply with the above requirements relating to a public works project shall constitute a breach of this Agreement that excuses the City’s performance of this Agreement at the City’s sole and absolute option and shall be at the sole risk of Contractor. Contractor on behalf of itself, and any subcontractor, agree to indemnify, defend and hold harmless the City and its officials, officers, employees, and agents from and against any and all claims, liabilities, losses, costs, expenses, attorney’s fees, damages, expenses, fines, financial consequences, interest, and penalties, of any kind or nature, arising from or relating to any failure (or alleged failure) of the Contractor and any subcontractor to pay prevailing wages or to otherwise comply with the requirements of prevailing wage law relating to a public work.

Contractor acknowledges that it and any subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, unless currently registered with the DIR and qualified to perform public work pursuant to Labor Code Section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code Section 1771.1(a)]. A bid shall not be accepted, nor any contract or subcontract entered into without proof of the Contractor or subcontractor’s current registration to perform public work.
