JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA)
UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

D. Justification:
1. The justification for this non-competitive action is:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
The primary technical advantage of the Phenom Pharos is that it is the only tabletop SEM to use a FEG as the electron source. All other tabletop SEMs use a less-desirable tungsten filament as the electron source. The advantages of the FEG electron source include:
o Provides 100 times more electrons than competing tungsten sources.
o Has a >10,000 hour life versus 100 hours for tungsten.
o Enables better than 2nm resolution versus 20nm for tungsten o Lower operating temperature leads to superior operation at all accelerating voltages (especially lower voltages) often eliminating the need for a conductive coating on insulating samples o Enables up to 2,000,000 times of true electron magnification versus 30,000- 100,000x magnification for tungsten (some tungsten systems claim higher magnification, but this is accomplished by augmenting the true magnification with a digital zoom).
o Maintenance free operation for long periods of time (12+months) versus the need to regularly change tungsten filaments and retune the system each time
Rev. 5/14/19 a filament is changed (this also minimizes potential contamination of the inner portion of the microscope).
b. What other products/services were considered and why did they not meet the need?
No other desktop FEG-SEM instruments were found. Zeiss Gemini systems and Jeol JSM-7600F were considered, but rejected due to immense size
3. Program Office efforts to seek potential offerors:
Nanoscience Instruments is the sole source for ThermoFisher’s Phenom Pharos SEM in the United States of America. Nanoscience Instruments has the exclusive distribution rights for all Phenom SEMs and is the only vendor from which the above-mentioned instrument can be purchased
