J&A No: 21-0014 Contract No: HQ014716F0019

MISSILE DEFENSE AGENCY

LIMITED SOURCE JUSTIFICATION AND APPROVAL

FOR FEDERAL SUPPLY SCHEDULE (FSS) AWARD (FAR 8.4)

1. Introductory Paragraph. Upon the basis of the following justification, I, as the Missile Defense Agency Competition Advocate, hereby approve the issuance of the contractual action discussed below using other than full and open competition, pursuant to the authority cited herein.

2. Agencies and Contracting Activity (FAR 8.405-6). The Missile Defense Agency (MDA) contracting activity is MDA/MSK, which provides contracting support to the Mission Support (MS) program office. The point of contact for this action is

, Contracting Officer, .

3. Nature and Description of the Action Being Approved (FAR 8.405-6(c)(2)(ii)). This limited source justification (LSJ) authorizes the 6 month extension for FSS order/contract HQ014716F0019 (Packaging, Handling, and Storage), in support of the Life-Cycle Management Directorate (MSL), from October 1, 2021 to March 31, 2022.

4. Description of the Supplies and/or Services Required to Meet the Agency’s Needs (including the estimated value) (FAR 8.405-6(c)(2)(iii). This LSJ is for MSL to continue providing support via contract HQ014716F0019 by extending this effort for six months. The award date for the firm-fixed-price contract HQ014716F0019 to Venturi, LLC was October 1, 2016, with a two-year base period of performance and three one-year options. The current period of performance (last option period) expires on September 30, 2021. MDA intends to invoke FAR clause 52.217-8 and execute a contract modification to extend the order for six months to provide uninterrupted, high-quality continuity of services. FAR clause 52.217-8 was included in the original contract, but price was not evaluated. This 6 month extension will provide continued critical logistical support starting October 1, 2021 and ending March 31, 2022 at a total estimated cost of $4,926,367.00. Per FAR clause 52.217-8, these costs may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. This extension will provide continuity of existing work and avoid disrupting critical logistical support, e.g., deploying MDA target systems, maintaining Missile Defense System (MDS) equipment, storing critical MDS assets, and packaging MDS hardware for deployments in support of the MDA Integrated Master Test Plan at both permanent and temporary MDA duty stations in CONUS and OCONUS.

The recent U.S. coronavirus outbreak has altered daily work life in the U.S. Department of Defense in many ways. The World Health Organization (WHO) declared the COVID- 19 outbreak a pandemic on March 11, 2020, and this was followed by the U.S.

Government declaration of a National Emergency. The pandemic and resulting shift to a virtual environment has created unique challenges and forced the Agency to rebaseline requirements. Early technology challenges and the time needed for employees to adjust to the new paradigm led to sub-optimal collaboration, significantly slowing activities such as requirements and acquisition strategy development, market research, budget de-confliction, and staffing/coordination of documents. These challenges and delayed activities have led to a need to delay some acquisition related activity to allow adequate time to prepare documentation and coordinate with Industry for future procurements.

5. Identification of the justification rationale (FAR 8.405-6(c)(2)(iv). The proposed action to extend the services may be awarded on a limited source basis under the authority of FAR 8.405- 6(a)(1)(i)(C). In the interest of economy and efficiency, this extension is within the scope of the current performance work statement. The MDA requires safe, efficient and expeditious Packaging Handling and Storage operational support. MDS equipment, hardware and property includes a diverse array of items including, but not limited to, launch vehicles and associated flight hardware, including ordnance components; ground support equipment; electrical power generators; non- tactical vehicles; and command, control, communications and battle management equipment. Using the existing MSL prime contractor, Venturi, LLC, is the logical choice to support these critical logistical requirements.

6. Determination of Best Value (FAR 8.405-6(c)(2)(v)). This order represents the best value to the Government consistent with FAR Part 8.404(d). GSA has already determined the prices of services under schedule contracts to be fair and reasonable. A discount to the GSA schedule pricing will be requested. By placing an order against a schedule contract using the procedures in 8.405, the ordering activity has concluded that the order represents the best value.

7. Description of Market Research Conducted (FAR 8.405-6(c)(2)(vi). This LSJ is for continuation of existing work for which market research was conducted at the time of initial contract award. In accordance with FAR 8.405-6(2), the approved LSJ will be made publicly available within 14 days after contract award by posting to GSA eBuy.

8. Other Facts (FAR 8.405-6(c)(2)(vii)). None.

9. Actions Taken to Remove Barriers to Competition (FAR 8.405-6(c)(2)(viii). There are no known barriers to future competition. MDA plans to compete the follow-on MSL Packaging, Handling, and Storage contract. The sources sought to determine potential vendors was posted on January 27, 2021 via GSA eBuy. The extension of current work proposed in this LSJ ensures mission critical logistical needs are met throughout the Agency.
