DEPARTMENT OF THE TREASURY

SF 1014 - JUSTIFICATION FOR AN EXCEPTION

TO FAIR OPPORTUNITY

Treasury Standard Form – 1014 (Rev 5/18)

Prescribed by Treasury: DTAP 1016.505

1. Identification of the requiring activity and the contracting activity:

The requiring activity is the IRS, Information Technology (IT), Data Delivery Services (DDS) and the contracting activity is IRS, Procurement, Office of Information Technology Acquisition (OITA).

2.a Nature and/or description of the action being approved:

The purpose of this Justification for an Exception to Fair Opportunity is to obtain approval to award a firm fixed price/labor hour contract for the requirement described in section 3.a below. The period of performance will be for a base period plus two one-month option periods, for a total of 6 months:

Base Period: July 21, 2021 - November 20, 2021 (4mos) Option Period 1: November 21, 2021 - December 20, 2021 (1mo) Option Period 2: December 21, 2021 - January 20, 2022 (1mo)

2.b Name of the vendor. Accenture Federal Services 2.c Requisition No.: 5000119123 2.d Bridge contract: Yes No 2.e Brand name: Yes No 3.a A description of the supplies or services required to meet the agency’s needs:

The proposed acquisition is to acquire support services for the IRS DDS Customer Accounting Data Engine (CADE2) Program to modernize individual tax account processes and replace the Individual Master File and related application processing systems. The goal of this task order is to obtain contractor support services that provide consultation and subject matter expertise to the IRS DDS Customer Accounting Data Engine (CADE2) with design, configuration, customization, development, integration, and implementation of data analytics and reporting capabilities for applicable IRS programs. The Contractor shall also provide cross-functionality support services to other IRS systems that interact with any DDS programs to deliver legislative mandates and business requirements.

The scope of this PWS encompasses contractor support for the Data Delivery Services Domain and its current and future projects and systems to include but not limited to CADE2 Projects, and development of data as a service (DaaS) solutions. Support under this contract falls into three broad categories: 1) Project and Program Management Support, 2) new development and 3) Operations and Maintenance of existing applications.

This acquisition supports multiple Legislative Mandates, to include: CARES Legislation Economic Impact Payment (EIP), Protecting Americans from Tax Hikes (PATH), Legislative Mandate: Advanced Child Tax Credit (ACTC) and American Rescue Plan Act of 2021.

3.b Includes IT: Yes No PSC: R425 NAICS: 541511 3.c IGCE/Estimated dollar value:

The IGCE is $6,650,122.57 for a four-month base period plus two, one-month option periods.

4.a Identification of the exception to fair opportunity being used:

FAR 16.505(b)(2)(i)(A) – The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

FAR 16.505(b)(2)(i)(B) – Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

FAR 16.505(b)(2)(i)(C) – The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

FAR 16.505(b)(2)(i)(D) – It is necessary to place an order to satisfy a minimum guarantee.

FAR 16.505(b)(2)(i)(E) – For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

FAR 16.505(a)(4) – The requirement is for an item peculiar to one manufacturer.

4.b Supporting rationale:

Accenture Federal Services is the incumbent and this requirement is currently being re-competed, which is tentatively scheduled to be awarded in November 2021. The current task order, 2032H5-21-F-00097, expires on July 20, 2021, and the incumbent is the only vendor that can continue performance without delays or interruptions. Onboarding and transitioning another vendor prior to award of the re-compete would negatively impact the program and it would also not be a sound business decision.

Accenture currently maintains multiple cleared resources performing the functions of this project, alongside CADE2 complex requirements and the specialized legacy skills like ALC on mainframe which is hard to acquire required for success of project implementation and maintenance. Five years into this highly complex and requirement intensive project, Accenture is qualified and positioned to continue their service within the CADE2 pace by the requested extension.

This contract is critical to the consistent project success because it provides the business units with implementation and support of legislative mandated Filing Season changes, EIP payment processing support, Tax Reform changes, individual tax processing as well as providing financial data to host of downstream business processes.

Any break in service since would result in the inability to implement Legislative mandates like EIP 3 processing (which is already in progress), ACTC implementation scheduled for May 2021 and Filing Season processing during early part of 2021. On-going Operational support will be negatively impacted due to resolution of the issues in production will not be timely with new vendor staff due to steep learning curve in a very short period of time. There is not enough time to support Knowledge Transfer to a new vendor due to tight deadlines of critical Legislative mandates and the need for on-going support for mission critical IRS Filing Season processing. The need for uninterrupted support services is critical to meet the goals and mission of the project and the agency.

This sole source bridge order will provide the re-compete procurement team with adequate time to get a new award in place while also ensuring there is not a lapse in these critical services for the customer during the filing season.

5. A determination that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on comparing prices/costs and hours with prior and similar task orders issued, performing cost and price analysis techniques.

6.a Any other facts supporting this justification:

None

6.b Attachments: Yes No

7. A statement of the actions, if any, the Requiring Activity and Contracting Activity may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies and services is made:

A follow-on competitive award is currently in process and anticipated to be awarded in late 2021.
