About this file
Summary
This is a bid document and project manual for a construction contract issued by Portage County, Wisconsin, for concrete repair and rehabilitation work on the Jordan Park Dam located in Portage County. The work encompasses concrete crack repairs, concrete overlay repairs to abutment walls and spillway structures, replacement of timber stoplogs with new materials, and potential replacement of auxiliary spillway gates with stainless steel vertical slide gates as specified under mandatory alternates. Estimated quantities include 10 cubic yards of heavy riprap, 224 square feet of 9-inch concrete abutment wall overlay, 254 square feet of 6-inch spillway concrete overlay, 100 linear feet each of structural and non-structural crack repair, and various partial depth concrete repairs ranging from 0 to 6-plus inches in thickness. Bids were due by 11:00 AM on March 4, 2021, at the Portage County Purchasing Office. No pre-bid conference was scheduled. The project requires work completion and substantial completion by October 1, 2021, with final completion by October 15, 2021. The contract award was to be made to the lowest responsive, responsible bidder as determined by Portage County.
The contract is structured as a stipulated price agreement with unit price components for various work items. Liquidated damages are assessed at $500 per day for failure to achieve substantial completion and $1,000 per day for failure to achieve final completion. Retainage provisions follow Wisconsin Statutes Section 66.0901(9)(b), limiting retainage to 5 percent until 50 percent completion, after which no additional retainage is permitted unless work is not proceeding satisfactorily. The project is subject to prevailing wage requirements under federal Davis-Bacon Act wage rates applicable to Wisconsin. Contractor must provide performance and payment bonds in amounts equal to the contract price, along with comprehensive insurance including workers' compensation, commercial general liability, automobile liability, and builder's risk coverage. The work is governed by Wisconsin Department of Transportation Standard Specifications, EJCDC General Conditions (2013), and specific supplementary conditions addressing concrete repair standards, slide gate specifications, masonry mortaring, and traffic control requirements. Funding for this project is supported through a Wisconsin Department of Natural Resources municipal dam grant program, with the project subject to DNR plan approval conditions issued February 2, 2021.

2021-05 Jordan Park Dam Repair Portage County, Wisconsin
TIME AND PLACE FOR BIDDING
Notice is hereby given by Portage County, Wisconsin, that it will receive separate sealed bids for the 2021- 05 Jordan Park Dam Repair project until 11:00 AM March 4, 2021 in the Portage County Purchasing Office, ATTN: Chris Schultz, 1462 Strongs Avenue, Stevens Point, WI 54481. Bids will be publicly opened and read aloud at that time.
DESCRIPTION OF WORK
The 2017 dam inspection revealed no conditions that require immediate action on conditions that would compromise the continued safe operation of the dam. There were, however, several deficiencies requiring short term action to assure continued long term safe operation of the dam as directed in the 2017 WDNR dam safety compliance letter.
The most significant deficiency was concrete deterioration of the primary timber slide gate spillway and the auxiliary timber slide gate spillway leading to the power canal. Concrete deterioration of dam structures exposed to frequent freeze/thaw action is ongoing and periodic repairs are typical. The existing primary and secondary spillway outlets are showing continued concrete deterioration on the concrete abutment walls, support piers and head walls. Concrete repairs performed sooner than later will reduce repair costs that might otherwise develop into more major repairs efforts if not addressed.
The work consists of concrete crack repairs and concrete overlay repairs to the adjacent concrete structures, as shown on the plans. If the mandatory alternate is accepted
The 2017 inspection report, as well as, an in depth repair report prepared by IEI General Contractors Inc is available upon request.
The proposed improvements include, but are not limited to, the following approximate major bid item quantities:

A. Bidders shall submit a Bid on a lump sum basis for the base Bid and include a separate price for each alternate described in the Bidding Documents and as provided for in the Bid Form.
The price for each alternate will be the amount added to or deleted from the base Bid if Owner selects the alternate.

B. The “Bid Price” (sometimes referred to as the extended price) for each unit price Bid item will be the product of the “Estimated Quantity” (which Owner or its representative has set forth in the Bid Form) for the item and the corresponding “Bid Unit Price” offered by the Bidder. The total of all unit price Bid items will be the sum of these “Bid Prices”; such total will be used by Owner for Bid comparison purposes. The final quantities and Contract Price will be determined in accordance with Paragraph 13.03 of the Standard General Conditions.
C. Discrepancies between the multiplication of units of Work and unit prices will be resolved in favor of the unit prices. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum.
14.03 Allowances
A. For cash allowances the Bid price shall include such amounts as the Bidder deems proper for Contractor's overhead, costs, profit, and other expenses on account of cash allowances, if any, named in the Contract Documents, in accordance with Paragraph 13.02.B of the General Conditions.
ARTICLE 15 – SUBMITTAL OF BID
15.01 With each copy of the Bidding Documents, a Bidder is furnished one separate unbound copy of the Bid Form, and, if required, the Bid Bond Form. The unbound copy of the Bid Form is to be completed and submitted with the Bid security and the following documents:
A. Corporate Resolutions
The Corporate Resolutions form, on attached page 00 45 43-1, indicates whether the bidder is a corporation, a partnership, or a sole trader. The Resolutions must contain a sworn statement that the bidder has examined and carefully prepared the Bid from the Plans and Specifications, and has checked the same in detail [Section 66.0901(7), Wisconsin Statutes].
B. Disclosure of Ownership (required when State Wage Rates are applicable)
The Disclosure of Ownership form, No. ERD-7777, on attached page 00 46 00-1, must be completed and submitted with the Bid. The instructions for completing this document are self-explanatory.
C. Lobbying Certification for Contracts, Grants, Loans, and Cooperative Agreements (Required on Federally Funded Projects only; otherwise not applicable).
The Lobbying Certification on attached page 00 46 50-1, must be completed and submitted with the Bid. The instructions for completing are self-explanatory.
15.02 A Bid shall be received no later than the date and time prescribed and at the place indicated in the advertisement or invitation to bid and shall be enclosed in a plainly marked package with the Project title (and, if applicable, the designated portion of the Project for which the Bid is submitted), the name and address of Bidder, and shall be accompanied by the Bid security and other required documents. If a Bid is sent by mail or other delivery system, the sealed envelope containing the Bid shall be enclosed in a separate package plainly marked on the outside with the notation “BID ENCLOSED.”
15.03 Bids received after the date and time prescribed for the opening of bids, or not submitted at the correct location or in the designated manner, will not be accepted and will be returned to the Bidder unopened.

ARTICLE 16 – MODIFICATION AND WITHDRAWAL OF BID
16.01 Withdrawal of Bids shall be pursuant to Wisconsin Statutes, Section 66.0901(5).
A. If a person submits a bid or proposal for the performance of public work under any public contract to be let by a municipality and the bidder claims that a mistake, omission or error has been made in preparing the bid, the bidder shall, before the bids are opened, make known the fact that an error, omission or mistake has been made. If the bidder makes this fact known, the bid shall be returned to the bidder unopened and the bidder may not bid upon the public contract unless it is readvertised and relet upon the readvertisement. If a bidder makes an error, omission or mistake and discovers it after the bids are opened, the bidder shall immediately and without delay give written notice and make known the fact of the mistake, omission or error which has been committed and submit to the municipality clear and satisfactory evidence of the mistake, omission or error and that it was not caused by any careless act or omission on the bidder’s part in the exercise of ordinary care in examining the plans or specifications and in conforming with the provisions of this section.
If the discovery and notice of a mistake, omission or error causes a forfeiture, the bidder may not recover the moneys or certified check forfeited as liquidated damages unless it is proven before a court of competent jurisdiction in an action brought for the recovery of the amount forfeited, that in making the mistake, error or omission the bidder was free from carelessness, negligence or inexcusable neglect.
ARTICLE 17 – OPENING OF BIDS
17.01 Bids will be opened at the time and place indicated in the Advertisement or Invitation to Bid and, unless obviously non-responsive, read aloud publicly. An abstract of the amounts of the base Bids and major alternates, if any, will be made available to Bidders after the opening of Bids.
ARTICLE 18 – BIDS TO REMAIN SUBJECT TO ACCEPTANCE
18.01 All Bids will remain subject to acceptance for the period of time stated in the Advertisement or Invitation to Bid Form, but Owner may, in its sole discretion, release any Bid and return the Bid security prior to the end of this period.
ARTICLE 19 – EVALUATION OF BIDS AND AWARD OF CONTRACT
19.01 Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner will reject the Bid of any Bidder that Owner finds, after reasonable inquiry and evaluation, to not be responsible. If Bidder purports to add terms or conditions to its Bid, takes exception to any provision of the Bidding Documents, or attempts to alter the contents of the Contract Documents for purposes of the Bid, then the Owner will reject the Bid as nonresponsive; provided that Owner also reserves the right to waive all minor informalities not involving price, time, or changes in the Work.
19.02 If Owner awards the contract for the Work, such award shall be to the responsible Bidder submitting the lowest responsive Bid.
19.03 Evaluation of Bids

A. In evaluating Bids, Owner will consider whether or not the Bids comply with the prescribed requirements, and such alternates, unit prices, and other data, as may be requested in the Bid Form or prior to the Notice of Award.
19.04 In evaluating whether a Bidder is responsible, Owner will consider the qualifications of the Bidder and may consider the qualifications and experience of Subcontractors and Suppliers proposed for those portions of the Work for which the identity of Subcontractors and Suppliers must be submitted as provided in the Bidding Documents.
19.05 Owner may conduct such investigations as Owner deems necessary to establish the responsibility, qualifications, and financial ability of Bidders and any proposed Subcontractors or Suppliers.
ARTICLE 20 – BONDS AND INSURANCE
20.01 Article 6 of the General Conditions, as may be modified by the Supplementary Conditions, sets forth Owner’s requirements as to performance and payment bonds and insurance. When the Successful Bidder delivers the Agreement (executed by Successful Bidder) to Owner, it shall be accompanied by required bonds and insurance documentation.
ARTICLE 21 – SIGNING OF AGREEMENT
21.01 When Owner issues a Notice of Award to the Successful Bidder, it shall be accompanied by the unexecuted counterparts of the Agreement along with the other Contract Documents as identified in the Agreement. Within 15 days thereafter, Successful Bidder shall execute and deliver the required number of counterparts of the Agreement (and any bonds and insurance documentation required to be delivered by the Contract Documents) to Owner. Within ten days thereafter, Owner shall deliver one fully executed counterpart of the Agreement to Successful Bidder, together with printed and electronic copies of the Contract Documents as stated in Paragraph 2.02 of the General Conditions.
ARTICLE 22 – SALES AND USE TAXES
22.01 Conform to § 77.54 (9m) of the Wisconsin statutes:
77.54 General Exemptions. These are exempted from the taxes imposed by this subchapter:
77.54 (9m) The sales price from the sale of and the storage, use, or other consumption of tangible personal property, or items or property under s. 77.52 (1) (b) or (c), sold to a construction contractor who, in fulfillment of a real property construction activity, transfers the tangible personal property, or items or property under s. 77.52 (1) (b) or (c), to an entity described under sub. (9a) (b), (c), (d), (em), or (f), if such tangible personal property, or items or property, becomes a component of a facility in this state that is owned by the entity. In this section, “facility” means any building, shelter, parking lot, parking garage, athletic field, athletic park, storm sewer, water supply system, or sewerage and waste water treatment facility, but does not include a highway, street, or road.
