About this file

This document is a justification and approval for other than full and open competition for an emergency contract award. The Department of Veterans Affairs awarded a firm-fixed price construction services contract valued at $900,000 to HC Integrated Systems, Inc. on October 8, 2020. The contract is to replace an inoperable Bosch intrusion alarm system at the Long Beach VA Health Care System that has failed catastrophically. The 15-year-old system provides security coverage for 12 buildings on the campus housing sensitive areas like pharmaceutical storage. The system failure puts patients, staff, and assets at high risk as federal police must increase monitoring manually. An interim solution is unsustainable, and any delay in replacing the full system could seriously jeopardize safety and result in loss of critical equipment or resources. Due to the unusual and compelling urgency, further solicitation was deemed to only increase risks to safety and security. The contractor's price was determined fair and reasonable based on an independent cost estimate.

DEPARTMENT OF VETERANS AFFAIRS

Network Contracting Officer 22 Gilbert

Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

1. Contracting Activity and Procurement Information:

Department of Veterans Affairs, Network Contracting Office NCO 22-Gilbert has an Unusual and

Compelling Urgent Emergency and request for the Long Beach VA Health Care System

(LBVAHCS) with the following procurement details:

a. Title: Emergency Lynx Security Intrusion Alarm System Installation

b. Acquisition Plan Action ID: 36C262-21-AP-0136

c. 2237 Funding ID - 600-21-1-5923-0006

d. Estimated Contract Value: $900,000.00

2. Description of the Action Being Processed:

This Firm-Fixed-Price construction service acquisition is in pursuant of Unusual and Compelling

Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2 authority. LBVAHCS is requesting authorization for HCI Systems, Inc to replace inoperable and non-serviceable Bosch

Intrusion Alarm System with fully integrable Lynx Duress and Emergency Notification System throughout VA Long Beach Medical Center.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

The Veterans Affairs Healthcare System located in Long Beach, California (600) requires emergency construction services to install fully integrable Lynx duress and emergency notification systems throughout Long Beach for Buildings-1, 2, 5C, 7, 25, 50, 126, 128, 138, 149, 164 & 165.

The security system ensures protection of remote security observation and monitoring for sensitive areas as such pharmaceuticals/narcotics, mail room, high cost item storage, and currency storage.

This requirement is classified under construction services as it calls for the alteration of real property. The estimated value of this proposed action is $900,000.00

4. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy

Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;

( X ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4

( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5;

( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority):

LBVAHCS current Bosch security intrusion alarm system is over 15 years old and the main server has catastrophically failed, the panels have become inoperable and non-serviceable and all other software and hardware are obsolete. The system must be replaced in full throughout the campus.

This inoperative intrusion alarm and motion sensor infrastructure provides security coverage for

Buildings, 1, 2, 5C, 7, 25, 50, 126, 128, 138, 149, 164 and 165. This complete loss in the priority security system forces the station into a high-risk concern to all remote observation and monitoring of sensitive areas to include pharmaceuticals/narcotics, mail room, high cost item storage, and currency storage. The situation is such that the VA Federal Police must deploy additional personnel to monitor the locations putting significant stress on manpower and budget. The loss in police response time also affects other daily emergencies that directly jeopardizes staff and patient safety.

This interim solution cannot be sustained, and the likeability of a response conflict rises as time increases. Any undue delay could result in serious risk to patient health and safety and significant loss of critical equipment and monetary resources.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

Due to the Unusual and Compelling Urgency of this procurement and the safety and security to patients and staff, further solicitation efforts would further delay this emergency acquisition.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The Technical Evaluation team found the single source contractor technically acceptable once all contractor clarification questions were answered and considered. It was determined the price is fair and reasonable per FAR 15.403-3(a)(1)(i) based on Independent Government Cost Estimate (IGCE) was 6% less than contractor proposal. Additionally, pursuant to FAR 6.302-2 Unusual and

Compelling Urgency – Emergency, further delay would greatly harm the safety and security of patients and staff.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

CS and COR conducted an informal market research inquiry from of FPDS, Beta SAM, SBA, VIP and the IGCE recommended source. The requesters Market Research and IGCE referenced one contractor with estimated pricing based on previous subcontracting services and above satisfactory performance on a prior contract acquisition for similar services. HCI Systems is a local area contractor and was found the lowest price technically acceptable. The Contracting Officer may use a source lower in priority than as specified in VAAR 819.501-70 however the time to locate, find responsible and negotiate terms would prolong the safety and security of all staff and patients at

Long Beach VA HCS.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

None known at this time.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

None known at this time.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

None known at this time.
