MEMORANDUM FOR USPFO for Tennessee, Attn: Purchasing and Contracting, 3041 SIDCO Drive, Nashville, TN 37204-1502

SUBJECT: DFAC Contract W912L7-20-P-000301

1. The purpose of this memorandum is for contract modification W192L7-20-P-0003-01 for the period of performance 1 DEC 2019 through 31 January 2019 for the Smyrna Dinning Facility. The new contract is not yet awarded due to processing. The service requirement is to provide non-personal services for Smyrna DFAC Service for the Tennessee Army National Guard (TNARNG). The

Performance Work Statement (PWS) states that the contractor shall prepare meals at the Smyrna DFAC and other TNARNG Dining Facilities (DFAC) such as but not limited to Volunteer Training Site Lavinia VTS-

L(Lavinia, TN), Volunteer Training Site Tullahoma VTS-T (Tullahoma, TN), and Volunteer Training

Site Catoosa VTS-C (Tunnel Hill, GA).for the units in the TNARNG.

This service provides a critical function in support of the TNARNG.

2. This approval is for a firm fixed priced contract using operational and maintenance funds

3. Estimated Value is for the total contract is $141,383.00

4. Statutory Authority: the Federal Acquisition Regulation (FAR) 6.302-1(a)(2)(iii)(A):

Substantial duplication of cost to the Government that is not expected to be recovered through competition. This requirement will not be synopsized and or advertised at www.fbo.gov , a bridge contract must be done to fulfill the agency needs. Simplicity Caterers LLC is capable of performing the effort due to meeting the agency’s needs.

5. This is in the best interest for the Government to allow the extra time needed to award the new contract.

6. Market research was completed and is the same. Based on the justification it is in the best interest of the government to extend the service until the new contract has been awarded.

Simplicity Caterers LLC is currently Active, no delinquent federal debt and no active Exclusion. Simplicity Caterers LLC does have two (2) instances of Termination for Cause (T4C) on their FAPIIS report dated 12/2014 & 08/2017, however the contractor has performed satisfactorily for contract W912L7-13-D- 0004 and will be able to perform the duties for the length of the Bridge.
