FAR Part 16 Exception to Fair Opportunity Justification Under Multiple Award Indefinite Delivery Contracts

For Actions Exceeding the Simplified Acquisition Threshold (SAT)

1. Contracting Activity: Mission and Installation Contracting Command Fort Hood (MICC-FH), 36000 Darnall Loop, Fort Hood, TX 76544-5025.

2. Description of Action: The Information Management Directorate, White Sands Missile Range (WSMR), NM requests a firm-fixed-price modification to contract GS-06F- 0627Z Order W91151-17-F-0001 with Federal Acquisition Services Alliant JV, 2138 Priest Bridge Court, STE 1, Crofton MD, 21114. The Government projects award for January 2019 and fiscal year 2019 Operations and Maintenance, Army; Navy RDT&E;

and RDT&E Army funds will be used.

3. Description of Supplies/Services: The incumbent shall provide all management, tools, material, equipment and labor necessary to provide non-personal services for Information Systems Operation and Support Services (ISOSS) to WSMR as defined in the current Performance Work Statement (PWS) for a six month extension. The technical scope of the PWS requires all technicians obtain and maintain security clearances and commercial certification in accordance with DoDI 8570.1-M, Information Assurance Workforce Improvement Program, latest edition including any follow-on revisions, at the level consistent with duties assigned by the contractor management. Any individual filling a position under this PWS shall be fully certified before assuming duties under this PWS. The Information Systems Operations Service Support (ISOSS) PWS includes all networks located on WSMR. The six month extension does not decrease or increase the scope of the current contract.

Period of Performance: 1 FEB 2019 to 31 JUL 2019 Total Value: .

4. Authority Cited: 10 U.S.C. 2304c(b)(3) as implemented by FAR 16.505(b)(2)(i)(C) – The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

5. Reason for Authority Cited:

a. Background. The current contract was solicited under the GSA Alliant Government-wide Acquisition Contract. Seven proposals were submitted. Task Order W91151-17-F-0001 was awarded on a competitive bases for a one year period of performance on 1 February 2017. FAR Clause 52.217-8 was exercised for a 6 month extension that ended on 31 July 18. An additional 6 month extension authorized by justification and approval number “MICC 2018-72” and using the authority of 10 U.S.C.

2304c(b)(3) was exercised for the period 1 August 2018 through 31 January 2019. The current contract is vital for WSMR to continue IT services for government, contractors, and mission personnel. If this extension is denied for the period requested there will be a break in service and a severe degradation of IT services on WSMR. The original acquisition strategy developed was to place this requirement on the AbilityOne procurement list and award to an AbilityOne contractor but this strategy was not agreed upon by the MICC Small Business Specialist. This delayed the initial procurement effort for several months while an acquisition strategy could be agreed upon by all stakeholders. The solicitation was released on 17 October 2018 but numerous questions were received and needed to be adjudicated which required extending the closing date to 26 November 2018.

With the current contract ending on 31 January 2019, there will be 4 month break in service until the follow-on requirement can be awarded by the end of May 2019. The incumbent contractor has the knowledge of the IT systems for WSMR. Team FASA employees are certified, current on security clearances, and are allowed access to the required networks. If a new contractor takes over the current IT services on another short term bridge, there would be a delay in transferring and or hiring the required employees with the proper clearances and certifications without incurring a break in services. The current contract is vital to continue IT services for government, contractors, and mission personnel in support of the DoD and Army test mission at WSMR. If this extension is denied for the period requested there will be a break in service and a severe degradation of IT services on WSMR.

b. Alternatives.

1) In house government personnel. The government does not at this time have the personnel required to accomplish the scope of this contract and the current governmental functions required to keep the IT services above a degradable level. This contractor uses over people to maintain all the required network functions, provide help desk support for computers, tenant organizations, Garrison directorates, and implement additional required DoD security functions. This is not a viable alternative.

2) Competitive Bridge. There is insufficient time for a competitive award to include; evaluation, contract review board review, and a 30 day phase-in time for the contractor to begin work. It would be neither cost effective nor realistic to expect another Contractor to perform during the brief extension period. The start-up costs would be expensed within the short extension period and would measurably increase the vendor’s proposed price. Manning problems including recruitment, security clearances, and associated relocation fees would delay the new contractor’s abilities for full performance in the short time frame required. Continuity of service without a phase-in would introduce unnecessary risk and the Government would most likely bear the burden with vendors proposing increased prices.

6. Actions to Increase Competition: The government is proceeding with the procurement of a follow-on contract that will be a five-year competitive, Firm-Fixed-Price, Woman-Owned Small Business set-aside award.

7. Market Research: Extensive market research, last updated on 5 July 2017, was conducted for the follow-on requirement which identified multiple capable Women Owned Small Businesses (WOSB) with the qualifications and resources to perform these services. Based on the results of this market research, a DD2579 was approved on 8 July 2017 to process the follow-on requirement as a WOSB set aside. It is not feasible or in the interest of the government to award a six month contract to any other vendor but the incumbent. The costs, hiring, time to award, and phase-in would be detrimental to continuity of the current work of this contract. The extension is to allow the appropriate time to award a five year contract. The request for proposals generated more than two proposals.

8. Other Facts:

a. Procurement History.
