SECTION C
STATEMENT OF WORK
C.1 BACKGROUND
The Board of Governors of the Federal Reserve System (Board) requires services related to conducting Occupational Safety and Health Administration (OSHA)-mandated programs as described in Section 2.1, in addition to the services of (1) providing psychological evaluation services, and (2) providing work station ergonomic evaluations,.
Outsourcing these services aligns with industry best practices as other government agencies have transitioned from employer-run clinics to either eliminating in-agency health clinics and/or outsourcing the management of clinics to companies that specialize in these areas.
The Board seeks a Contractor to perform the entire scope of work listed below under C.2.
C.2 SCOPE OF WORK
The Contractor shall conduct (1) medical and physical examinations and reviews, (2) work station ergonomic services, (3) psychological assessments, and (4) automated external defibrillator program and services.
2.1 OSHA MANDATED PROGRAMS
The Contractor, at its own location, shall perform physical examinations for all medical surveillance programs, initial fit-for-duty, annual fit-for-duty, and return to work examinations for all positions that affect public safety, including law enforcement officers (LEOs) in the Board’s Law Enforcement Unit (LEU) and the Protective Services Unit (PSU) who carry weapons.
For OSHA-mandated programs, the Contractor shall:
2.1.1 Coordinate scheduling the pre-employment (initial) and annual fit-for-duty medical examinations for LEU, PSU, and Board-identified Facilities staff with Board personnel in those areas as designated by the Contracting Officer’s Representative (COR).
2.1.2 Review histories and perform physical examinations on workers in the hearing conservation and respiratory protection medical surveillance programs as identified by government standards (i.e. 29 CFR 1910.95 and 29 CFR 1910.134 respectively) and industry practice. As of the date this Solicitation is issued, there are currently 35 employees in the hearing conservation program and three (3) in the respiratory protection program.
2.1.3 Perform annual fit-for-duty examinations and new applicant medical examinations for law enforcement personnel using the Board’s “Medical Standards for Law Enforcement” as a guideline for determining fitness for duty status (see Attachment 3). General Services Administration (GSA) Standard Form 93 is used for new applicants. The Board anticipates hiring twenty (20) new LEOs annually. There are approximately 180 law enforcement positions at the Board.
2.1.4 Provide medical examinations using the following common components:
physical examination, comprehensive vision, Ishihara – 12 Plate Color Vision, audiometry, electrocardiogram, lab profile (blood and urine), venipuncture, vital signs (heart rate, blood pressure, height, and weight), agility testing (see descriptions for step, grip, and reach tests below), respirator fit testing, and record processing. The Contractor shall submit a report including the person’s medical determination after the completion of each examination.
2.1.4.1 Step Test – The LEO is given instructions regarding the step test.
The LEO is asked to step up onto a 12" platform with one foot followed by the other, then to step off the platform with one foot followed by the other. The LEO will be asked to keep cadence with a metronome. The LEO will be given 30 seconds of practice;
he/she will be offered a second 30 second practice session if he/she desires. The evaluation consists of three minutes of persistent stepping up and down off the 12" platform in time to the cadence of the metronome at a rate of 96 steps per minute. The LEO’s heart rate will be monitored with an electronic heart rate monitor. The Contractor shall record the heart rate at the beginning and end of every minute of the test, and shall test the heart rate one minute after the test. The LEO shall be encouraged to complete the three minutes, but may stop if the LEO feels that he/she is unable to safely complete the evaluation. The Contractor shall record all results on the Fitness for Duty Evaluation form.
2.1.4.2 Grip Test – A dynamometer is used to measure the LEO’s grip strength. The LEO will be asked to hold his or her arm out at shoulder level, and will then be instructed to squeeze the handle with his or her full force. The dynamometer will provide a read out in pounds of force generated with the trial. The LEO will be asked to repeat this three times with each hand. The result for each hand grip strength will be the average of the three trials. The Contractor shall record all results on the Fitness for Duty Evaluation form.
2.1.4.3 Reach Test – The LEO is asked to warm up and stretch prior to this evaluation. The LEO will be asked to sit on the floor with his/her legs fully extended and his/her feet placed flat against the sit and reach test device. The LEO will then be coached to slowly reach as far forward as he/she can while exhaling and dropping his/her head forward between his/her arms. The Contractor shall calculate the reach in centimeters from the waist to the tips of the fingers. The Contractor shall record the results of all three trials on the Fitness for Duty Evaluation form.
2.1.5 Perform physical examinations for the renewal of commercial driver’s licenses for the Board’s drivers, where applicable, in accordance with the Department of Transportation’s (DOT’s) protocol.
2.1.6 Recommend and review exercise stress tests for LEOs to determine fit for duty requirements, where applicable.
2.1.7 Comply with Health Insurance Portability and Accountability Act (HIPAA) and underlying regulations in maintaining protocols for the storage, retrieval, and archiving of data resulting from medical examinations and reviews.
2.1.8 Provide services for the retrieval, digitization, and storage of the
Board’s medical records currently stored by the incumbent.
2.1.8.1 The Contractor shall provide services for the conversion of paper medical records to electronic records and ensure that paper and electronic records for employees are secured and stored in a HIPPA-compliant manner. The document retrieval and storage services shall be performed as follows:
a) Document scanning shall be performed in duplex mode set with automatic blank page deletion at 5kb or less per image.
b) Scanning is bitonal and images will be created at 300 DPI.
c) Digital records shall be indexed to create necessary metadata fields to support standard search functionality to access the documents.
d) For the purposes of a transfer of service from the Board’s existing Contractor to a new Contractor, the Contractor shall complete work related to the implementation process 10 business days prior to the start date of services under the contract resulting from this Solicitation (January 1, 2019).
e) The Contractor shall provide scan medical records and be digitally available in three (3) business days from receipt of the records from the Board or their health care professional.
2.1.8.2 The medical records shall remain Board property during the term of this Contract and beyond the term of this Contract, and shall be maintained by the Contractor in accordance with Federal records retention requirements, unless and until the Board instructs the Contractor in writing otherwise. This maintenance requirement shall survive any termination of this Contract, except to the extent that the Board issues written instructions regarding the disposition of the medical records to the Contractor or the Contractor transfers the medical records to the Board or a designee of the Board.
2.2 ERGONOMICS SERVICES
The Contractor shall provide basic ergonomics assessments for Board employees on a monthly basis, at a minimum, or when requested by the Board. Historically, the Board has conducted 30 ergonomic assessments per year, at an average of 30 minutes for each assessment. The Contractor shall perform the following:

SECTION I
EVALUATION AND AWARD PROCESS
I.1 EVALUATION OF PROPOSALS - PASS/FAIL
a. A proposal consists of Volume I (Offer), Volume II (technical proposal), and Volume III (price proposal) submitted by an Offeror responding to this Solicitation. Each non-covered company whose total price proposal exceeds $100,000 shall submit a Subcontracting Plan pursuant to Section L.13. Each Offeror shall submit a technical proposal and a price proposal, according to the guidelines presented in the following:
1. Section B, Price Proposal Form
2. Section C, Statement of Work
3. Section L, General Instructions and Information
NOTE: Offerors are advised that a one-word response, for example “comply”, to a mandatory requirement is insufficient and that such a response will receive a fail rating, thereby causing the entire proposal to be rated as fail.
b. Each technical proposal is subject to the same review and pass/fail analysis by the
Board’s technical evaluation team. Each proposal will first be examined to determine if the Offeror is responsible (see I.2). If any responsibility requirement is not demonstrated, the proposal will be rejected and will receive no further consideration. Technical proposals that meet all responsibility requirements will be subject to the pass/fail technical review described in subsection (c), below.
c. Technical Proposal (Pass/Fail). All proposals will be evaluated to determine technical acceptability based on the mandatory requirements in Section C.5 and conformance to the terms and conditions of the SOA. Technical acceptability will be evaluated based on pass or fail basis. In order to be determined to pass technically, and thus eligible for award, Offerors must meet the mandatory requirements of the SOA, including, as applicable, a Subcontracting Plan acceptable to the Contracting Officer. Technical proposals that meet all SOA requirements will receive a “pass” rating; technical proposals whose only deficiency is the Subcontracting Plan will receive a “conditional pass” rating.
d. A Board price evaluation team will review each Offeror’s price proposal as formatted according to Section B. Offerors are reminded that they must use the format set forth in Section B in submitting their price proposals. The price evaluation team will evaluate the price proposals for price reasonableness, realism, risk, and any other criteria set forth in Section B. The price evaluation team may reject unrealistically low or materially unbalanced offers.
SOA (v. 07/10/2018) Page 22 of 83
e. Covered Company Preference: If a covered company, as defined in Section M.25, is among the Offerors whose price proposal is being evaluated under this section, price will be adjusted as described in subparagraph 1, below. The adjusted price will be used as the final price when making an award decision.
1. Except for the acquisitions described in subparagraph 2., below, if a responsible covered company submits a responsive bid, quotation, or proposal, the Contracting Officer shall, for the purpose of price evaluation, add to each non-covered company’s proposal the following factor(s): three percent (3%) of the first $500,000, plus one percent (1%) for any amount of the bid, quotation, or proposal that exceeds $500,000. After applying this price adjustment, the Contracting Officer will evaluate the proposals and award the Contract as provided in paragraph g., below.
2. No price adjustment will be calculated in any of the following acquisitions, even if a covered company is a bidder: (1) the value of the contract is equal to or less than $100,000, (2) the acquisition is a set-aside under the Board’s Small and Disadvantaged Business Acquisition Policy, (3) the covered company has executed a waiver of the price preference, (4) price is not a factor in the evaluation, or (5) the contract is being awarded pursuant to the Trade Agreements Act or another international agreement.
f. The Offeror with the lowest price, acceptable proposal that also received a “pass” rating on its past performance evaluation and technical proposal will be awarded the Contract. If the Offeror with the lowest price received a “conditional pass” on its Subcontracting Plan, such Offeror will be awarded the Contract only if the Offeror timely agrees to amend the Subcontracting Plan in a manner acceptable to the Contracting Officer.
I.2 FACTORS TO DETERMINE A RESPONSIBLE OFFEROR
a. The Offeror shall provide financial statements for its two most recently completed fiscal years.
b. The Offeror shall disclose any actions pending before any body competent to rule on, adjudicate, or referee any legal dispute, including labor or workers’ compensation controversies, or bankruptcy filings.
c. Without additional expense to the Board, the Offeror shall possess and maintain, from the date of the Solicitation and throughout the Contract’s period of performance, any and all licenses and permits necessary to perform the work set forth in the Solicitation (i.e., licenses and permits required under Federal, State, and/or municipal laws, codes, and/or regulations applicable to the performance of the work). The Offeror shall indicate the type(s) of licenses and/or permits that have been issued to them, and the names of the
SOA (v. 07/10/2018) Page 23 of 83 issuing jurisdictions. The Offeror shall provide copies of such licenses and/or permits if requested.
d. The Offeror shall certify, as of the date of release of this Solicitation, that it has paid all taxes due, withholding or otherwise, and that it is not a party to any action by any taxing jurisdiction or authority to collect overdue or back taxes.
e. If an Offeror has financial statements that are weak, has any actions pending, has not obtained or retained the required licenses and/or permits, has any outstanding taxes, or fails to provide any other information required by this Solicitation, the Offeror shall fully explain such action or deficiency so that the Contracting Officer may have sufficient information to determine whether the Offeror is a responsible Offeror.
f. Upon the Contracting Officer’s request, Offerors shall submit information concerning their prior compliance with subcontracting plans required under previous contracts. The Contracting Officer will consider Offerors’ responses (including any failure to respond) in determining Offerors’ responsibility.
I.3 PROTESTS
Any actual or prospective Contractor who is aggrieved in connection with the solicitation or award of a contract may submit a written protest consistent with the provisions of Section M.23.
