JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN

MARKET OR GSA) UNDER $150,000

Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:

D. Justification:

1. The justification for this non-competitive action is:

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”

☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”

2. Other facts supporting sole source procurement:

a. What can this product/service do that other products/services cannot do?

ThinkWell is the only organization that knows the Mozambican geography and demography intimately, that has successfully implemented GIS platforms, and that is directly linked, compatible, and has been validated to be compatible with the Ministry of Health of Mozambique’s GIS platform. Additionally, due to its proven track record and expertise (including having on-the-ground/in-country staff) in working on GIS-related projects with the Ministry of Health in Mozambique, ThinkWell is the only organization that could begin the work immediately (i.e. based on the existence of known & on-going/open communication with the Ministry of Health) and has an established working relationship with the Ministry of Health for GIS-related projects.

Other organizations would need time to develop the required GIS capacity and expertise and to establish a working relationship with the Ministry of Health in Mozambique, which would create delays in the completion of the project, for which the GIS maps are needed. Those delays would be unacceptable because the International Organization for Migration is already developing interventions to address TB among Mozambican miners in South Africa, and they need these GIS maps as soon as possible to refine and implement those interventions. Delays in provision of these maps could delay the larger public health interventions, which would result in missed opportunities for program refinement and expansion and lives lost.

b. What other products/services were considered and why did they not meet the need?

The product that we require is specific and has to be validated and fully compatible with the GIS platform currently being utilized by the Ministry of Health in Mozambique. Otherwise, any GIS maps generated which are not compatible will be of no value and of no use. Other organizations do not have the GIS mapping experience/expertize in Mozambique, a GIS platform fully compatible with the GIS platform being used by the Ministry of Health in Mozambique, and the established relationship with the Ministry of Health that is required to implement recommendations.

3. Program Office efforts to seek potential offerors:

We conducted online internet search as well as reached out to a number of partners and collaborators to identify organizations in Mozambique that have the GIS expertise and have successfully conducted GIS mapping in the regions of interest. We also asked the central committee of the National TB Program (at the Mozambique Ministry of Health) to identify organizations with whom they work most directly and from whom they would accept actionable and compatible GIS mapping data. ThinkWell was the only organization identified by the National TB Program as an organization that has previously successfully conducted GIS mapping projects in Mozambique and to have compatible GIS data with the Ministry of Health GIS platform. The National TB Program and partners/collaborators did not identify any other organization with the GIS expertise and experience necessary to conduct GIS mapping in the regions of interest.
