About this file

This is a Brand Name or Sole Source Justification form submitted by the Colorado Department of Public Safety (CDPS), Colorado Bureau of Investigation (CBI), Identification Unit, dated May 18, 2016, for the procurement of MobileIdent devices from Morpho Trak. The CBI seeks to purchase additional MobileIdent mobile devices that enable law enforcement officers to identify individuals using fingerprint scanning of the index fingers on each hand, with results returned within 60 seconds through comparison against Colorado and FBI RISC databases. The devices are approximately cell phone-sized and designed to prevent identity theft, reduce false identification, and enhance officer safety. The procurement covers an estimated product cost of $2,000,000 with no associated services costs. The contract term runs from January 1, 2016 to June 30, 2018, representing a recurring procurement for additional units beyond the initial six MobileIdent devices and Morpho Biometric Identification System (MBIS) purchased through a competitive bid process in 2012.

The justification for sole source procurement is based on system integration requirements; the MobileIdent devices are designed exclusively to work with the existing MBIS system, and alternative manufacturers' devices would require separate servers and a new request for proposal at significant additional cost to the state, along with substantial testing with no compatibility guarantee. CBI conducted market research and determined that although numerous manufacturers produce similar MobileIdent devices, none are currently compatible with the MBIS system. The quoted price is characterized as a national standard rate applicable to all purchasers, with CBI receiving a volume discount based on the quantity of units being ordered. The cost analysis was justified under special governmental pricing. No competing bids were solicited, as the procurement was determined to be a brand name sole source based on the exclusive compatibility requirement with the state's existing biometric identification infrastructure.

COST ANALYSIS CHECKLIST

This form must be completed for each purchase above $10,000 for goods, and above $25,000 for services where the purchase is sole source justified or only one bid/proposal has been received. One of the boxes below must be checked and an explanation must be provided in the space provided at the end of this checklist.

The price being paid for goods or services is fair and reasonable based on:

Catalog or list price (or less) for STANDARD commercial item or service.

Price compares favorably with price for a similar item.

Market prices. Where an item has an established market price, verification of an equal or lower price establishes the price to be fair and reasonable. (For example, the purchase of metals, such as lead, gold, silver or commodities, such as grains.)

Special Governmental Pricing.

Professional Judgment. The Purchasing Agent is familiar with marketplace for the particular goods and services at issue and knows that the price is fair and reasonable.

Price set by law or regulation.

Price is the same as another purchaser paid. If the seller has no catalog, but has sold the same item to others in the recent past, the price can be determined to be fair and reasonable by verifying with those other purchasers what price they paid.

Price compares favorably to price paid for the same item or service, or similar item or service of like complexity under a previous purchase order, taking inflation into account.

Cost Analysis. Cost analysis shall be completed when price analysis is inadequate to verify that prices are fair and reasonable.

Cost analysis is the review and evaluation of each element of a cost estimate and proposed profit or fee to determine reasonableness, allocability and allowability. It is often used in conjunction with cost reimbursement contracts. Cost analysis should answer the following questions for the review and evaluation for any given cost element:

Is the cost necessary to perform the work and allocable to the work?

Is the cost necessary to operate the business?

Does the offeror follow applicable regulations?

Does the offeror have an acceptable accounting procedure?

Is the cost allowable in accordance with grant guidelines?

Would a prudent business person take this action in a competitive business environment?

Is the profit or fee negotiated, if any, reasonable for the degree of risk involved in performance of the work and does not exceed the limitations?

Explanation of above-checked justification.

Bkg Statement: CBI is the state's repository for fingerprint identification/ criminal histories. When a person is arrested using a false name it creates records in the victim's criminal history, i.e. aliases. It is time consuming and costly for CBI to correct these records. The use of Mobileldent devices will positively identify offenders in the databases prior to a record (alias) being created. This will save the State manpower and money. It will also save county and municipalities money as they will not have to transport suspected offenders to a jail to be fingerprinted for positive identification.
Division Needs: We are purchasing additional Mobileldent devices. These mobile devices allow an officer to attempt to identify a person using the fingerprints from the index finger on each hand. These fingerprints are ran through the Colorado and FBI RISC databases. If the subject (living or deceased)

has been fingerprinted in the State of Colorado for either civil or criminal purposes, their information will be retured to the device/ Officer within 60 seconds. If the person is in the FBI RISC database the officer will also receive this information. The device is the size of a cell phone and allows quick and positive identification based off of fingerprints. With identity theft on the rise, this device will prevent individuals from using other individual's personal information. It will also deter people without identification from providing false information to a police officer. In addition, officers will know who they are in contact with, there for creating better officer safety.

Features Req: The MobileIdent device works with Morpho Biometric Identification System (MBIS). CBI went through a bidding process in 2012 for the MBIS system and six (6) MobileIdent devices. MorphoTrak won the bid for the MBIS system and MobileIdent devices. These mobile devices allow an officer to attempt to identify a person using the fingerprints from the index finger on each hand. These fingerprints are ran through the Colorado and FBI RISC databases.
Competing Brands: CBI purchased the current MBIS system from MorphoTrak in 2012 along with six (6) MobileIdent devices. There are numerous manufacturers of similar MobileIdent devices. None of these similar devices currently work with the MBIS system. Attempting to get these other devices to work with MBIS would require a separate server and RFP at a cost to the State. It would also require substantial testing with no guarantee the device is compatible.
Future Purchases: MorphoTrak server is the only server that connects AFIS system to Mobile. Any other vendor would charge us for additional server and would require RFP.
Negotiations: This device is new to Colorado with no local market to compare prices. This device however is used throughout the United States to include the neighboring state of Arizona. The price quote is national and all entities pay the same price. CBI did receive a price break due to the number of units we are purchasing.
