About this file

This document is a Sole Source Determination for a firm fixed-price procurement above the micro-purchase threshold but not exceeding the Simplified Acquisition Threshold (SAT). The U.S. Customs and Border Protection (CBP) intends to issue a sole source award to Thurston and Wong LLC. (Aroosta-Cast) to provide, deliver, and place 238 "Jumbo Block" concrete vehicle barriers to support the U.S. Border Patrol - Fort Fairfield Station. The sole source justification cites "urgent and compelling circumstances" due to a 250% increase in vehicle incursions crossing illegally between the U.S. and Canada in this area from FY23 to FY24, which is greatly impacting border and national security. The anticipated cost for the concrete barriers is $. The price will be determined fair and reasonable based on market research. The period of performance is 60 days after receipt of the order.

Sole Source Determination For actions above the micro-purchase threshold but not exceeding the SAT

Version 1.0 September 2016

Date: __9/10/2024___________ PR Number: 20146846______

1. Nature and/or description of the item/service being procured and anticipated cost:

There is an immediate need for concrete vehicle barriers due to a border security issue in the AOR for Fort Fairfield station within Houlton Sector. There has been a 250% increase from FY23-FY24 in vehicle incursions crossing illegally between the United States and the Canadian border. The current vehicle gate in place is easily circumvented by cars and minivan vehicles.

The proposed acquisition of the concrete barriers would effectively prohibit most illegal incursions in this area. The anticipated cost for the needed 238 concrete blocks would be

. This cost covers the purchase, delivery, and specific required placement of the blocks.

2. Sole Source Determination Rationale in accordance with FAR 13.106-1(b)(1)(i) and (ii).

(Check one and explain below):

__XXX_ Urgent and compelling circumstances exists.

Due to the “urgent and compelling circumstances”, the sole source option is being requested in this situation. Utilizing Aroosta-Cast will cut down the time waiting for an awardee, as well as the timeliness of delivery and setup in the area. Therefore, it is felt that this request meets the FAR exception (FAR16.505(b)(2)(i)(A) stating: "The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays".

_________ Exclusive licensing agreement exists.

_________ Brand name. If the brand name requirement applies to a portion of the procurement, please identify that portion.
