JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Undersea Warfare Center Division, Code 02, Newport, RI.
2. Description of Action Being Approved
Extend the Period of Performance (PoP) and ordering period end dates of Indefinite Delivery, Indefinite Quantity (ID/IQ) Contract N66604-15-D-0132.
The PoP and ordering period end date will be extended from 30 April 2020 to 30 April 2022. There is still sufficient ceiling and hours available on this contract to support the extended PoP. This contract was awarded on a Sole Source basis to Lockheed Martin Corporation (LMC) on 17 October 2014.
The original J&A 14032.0 was approved 19 May 2014.
3. Description of Supplies/Services
There is no change to the services procured under Contract N66604-15-D-0130 as a result of this action and no change to the previously approved total contract ceiling of . The contractor will continue to provide operational maintenance and technical engineering services in support of the acquisition and life cycle maintenance of the Ohio Class Submarine Command and Control System / Non-Propulsion Electronic System (CCS/NPES) Data Processing Subsystem (DPS) shipboard/non-shipboard system and subsystems and related elements.
een verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304 (c)(1), One Responsible Source
5. Rationale Justifying Use of Cited Statutory Authority
As detailed in the original J&A (J&A 14032.0 dated 19 May 2014), the required highly specialized services as described in Paragraph 3 (Description of Supplies/Services) are deemed to be available only from the original source, and the award to any other source would result in comprised of the DPS UYK-43 hardware computer and its associated software.
The DPS is installed onboard the Ohio Class Submarines SSBN and SSGN classes. For SSBN, the DPS directly supports the United States national security and the strategic deterrent mission of the TRIDENT. For SSGN, the
NCH 53.6-2
DPS also supports the United States national security, as well as directly supporting the Strike capability of the platform. The legacy DPS is 20+ years old and becoming obsolete. The DPS was originally designed and built by the Lockheed Martin Corporation (LMC), the original equipment manufacturer (OEM). The DOS UYK-43 and its software are proprietary to LMC.
As such, LMC is not only the OEM for DPS, but they are also the Subject Matter Experts (SMEs) for the DPS.
6. Description of Efforts made to Solicit Offers from as Many Offerors as Practicable
The original contract action was synopsized via posting on the Government Wide Point of Entry (GPE), Federal Business Opportunities (FedBizOps) website, prior to solicitation in accordance with FAR 5.2. No additional market research was conducted because it is not reasonable, for the reasons discussed in section 5 above, for any company other than LMC to provide the required supplies and services. Per FAR 5.201(b)(1)(ii), the contracting officer must transmit a notice to the GPE, for each proposed modification to an existing contract for additional supplies or services that meets the threshold in FAR 5.101(a)(1) (proposed contract actions expected to exceed $25,000). As the current action does not increase the total contract value, pre-award synopsis of this modification is not required under FAR subpart 5.2.
7. Determination of Fair and Reasonable Costs
The Contracting Officer determined the negotiated amount of the contract executed under J&A 14032.0 was fair and reasonable pursuant to FAR Subpart
15.4. The current action does not result in a change to the negotiated amount of the contract. Therefore, the contract costs are still deemed fair and reasonable, based on the analysis documented in the original Business Clearance Memorandum that is included in the contract file.
8. Actions to Remove Barriers to Competition
Per FAR 6.305(a), this justification will be made publically available within 14 days of award of this modification. The Government anticipates that the DPS system supported by this contract will be replaced by the Fleet over the next two years. At this time, the Code 25 does not plan to issue future contracts for these services. If the Fleet requirements change such that support for this system is still required, the Code 25 will assess if a follow-on contract is required and conduct additional market research at that time.
