Task/Delivery Order Number: _GS-06F-0592Z/DJO2011TO11047_
LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE
PROGRAM
Upon the basis of the following justification, I, as Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6 )a)(1)(i)(C). This acquisition is conducted under the authority of the Multiple- Award Schedule Program (FAR 8.401).
1. Identification of the agency and the contracting activity.
Office of Justice Programs, Office of Administration, Acqusition Management Division.
2. Nature and/or description of the action being approved.
The Bureau of Justice Statistics (BJS) utilized OCIO’s task order with AAC, Inc. to acquire System Administration services which is within the scope of this task order (Unix and Adobe ColdFusion Application Support). Originally, BJS intended on migrating the ColdFusion Application from Unix to Windows/SharePoint solution but unfortunately they had not been able to accomplish this work due to other competing priorities. BJS requires continued support under this task order. A modification is required to add more funding for BJS ColdFusion support through May 24, 2016. The task order ceiling will increase by $120,304.00.
3. A complete description of the supplies and/or services required to meet the agency’s needs
As a Federal statistical agency, the Bureau of Justice Statistics (BJS) must meet OMB and congressional mandates for management and dissemination of statistical data and products. BJS complies with this mandate by developing externally facing web sites and applications that allow users to obtain the information they are seeking.
All BJS sites and applications are developed for, and hosted on, the Adobe ColdFusion platform. ColdFusion allows BJS to develop rich, database-driven applications using both in-house and contractual developers.
OJP/OCIO needs additional services for the Unix/Cold Fusion initiative and WorkSpace Redesign, which includes design, deployment, and support the new IT capabilities at OJP HQ located at 810 7th Street NW.
4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor’s unique qualifications to provide the required supply or service.
FAR 8.405-6(a)(1)(i)(C) - The new work is a logical follow on to an original FSS order and the order was placed in accordance with FSS procedures and was not issued under sole source or limited sources procedures.
At this time, migrating all BJS application to use of another brand of middleware would take over a year to complete and would require over $300K in additional funding at a minimum. In addition, all publishing processes would need to be revised and staff retrained to use a different system. Service is currently being acquired under this task order and is within the scope.
5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d).
The Contracting Officer has determined, after considering the level of effort and the mix of skills available for the tasks needed, that the proposed order modification represents a reasonable total price and will be the best value for the Office of Justice Programs.
6. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS.
No market research was conducted as the existing offer was competed and represented the best value to the Government at the time of award. The services requested are available from the contractor’s GSA FSS.
7. Any other facts supporting the limited source justification.
In order to maintain continuity of services for website users, BJS must renew the annual support subscriptions for Adobe ColdFusion Enterprise server. Current Contractor, AAC, Inc. is familiar with the technology deployed and is best qualified to provide ongoing support.
8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.
This project will occur under the last option period that ends in May, 2016;
therefore, there will be no further competition restrictions related to this project.
9. The ordering activity Contracting Officer’s certification that the justification is accurate and complete to the best of the Contracting Officer’s knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel.
