FAR SOURCE TITLE AND DATE

FAR 52.212-1

Instructions to Offerors – Commercial Items (June 2010)

b) FAR 52.212-2 Evaluation - Commercial Items (Jan 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Award Evaluation will be in accordance with FAR 13.106-2 and will be based on price and delivery schedule.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c)’ Offers will be ranked according to price, including option prices. An offeror’s proposed prices will be determined by multiplying the quantities identified in Section B by the proposed unit price for each Contract Line Item Number to confirm the extended amount for each.

The prices shall included all shipping and proposed F.O.B. destination. All extended Contract Line Item Number amounts will be totaled for evaluation purposes. Price will be evaluated for reasonableness and realism. Reasonableness will be determined based on prices submitted by the competition, current market conditions, and comparison to the government estimate, if applicable. Realism will be based on an evaluation of prices to determine if they are compatible with the scope of effort, are not unbalanced, and are neither excessive nor insufficient for the effort to be accomplished. An unreasonably or unrealistically priced proposal is subject to removal from the competitive range on the basis that the offeror does not understand the requirement or has submitted an unrealistic proposal. Discounts are applicable.

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
