U.S. Customs and Border Protection Limited-Sources Justification (LSJ) - FAR 8.405-6

For orders or BPAs exceeding the Simplified Acquisition Threshold (SAT)

Date: 201 PR Number: 20105508

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive

Agencies.

1. Agency and Contracting Activity. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited-Sources Justification.”

The Department of Homeland Security (DHS), Customs and Border Protection (CBP), Office of Acquisition (OA) and the CBP Office of Information and Technology (OIT), proposes to award an order pursuant to FAR 8.405-6, Limiting Sources.

2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

CBP intends to limit the number of sources solicited pursuant to FAR Part 8.405-6(a) for the procurement of licenses and maintenance to upgrade and maintain software that is proprietary to Compuware Corporation, 1 Campus Martius, Detroit, MI 28226-5000. The Firm Fixed price delivery order will be issued against the Government Services Administration (GSA) Schedule Contract #47QTCA18D0038.

3. Description of Supplies/Services. Describe the supplies or services to be acquired.

Provide the estimated total value (including options, if any).

CBP has entered into an agreement with IBM to provide mainframe cloud services.

CBP’s workload will transition to an IBM-owned mainframe at IBM’s Federal Data Center in Research Triangle Park, NC in March 2019. The purpose of this fixed-price order is for the contractor to provide Compuware product licenses and software maintenance for Abend-AID for CICS and Hiperstation for VTAM on the new machine for the base period, anticipated to be February 15, 2019 through March 31, 2019. The order will contain a one year option period with a period of performance of April 1, 2019

– March 31, 2020.

This software is an item peculiar to one manufacturer, Compuware, and will allow CBP to maintain compatibility with and interface with existing CBP systems.

The maintenance is needed to ensure that all online terminal screens and raw data are captured and saved as an investigative audit trail for law enforcement internal audits.

This software maintenance will ensure system accuracy and effectiveness, access to previously created audit data, and the continuation of capturing audit trail data consistent with CBP Office of Professional Responsibility (OPR) requirements. The software is proprietary to the manufacturer. Compuware Corporation is the only source that provides

U.S. Customs and Border Protection Limited-Sources Justification (LSJ) - FAR 8.405-6

For orders or BPAs exceeding the Simplified Acquisition Threshold (SAT) to meet the Government’s needs. This order will be placed in accordance with FAR 8.404, “Use of Federal Supply Schedules.” GSA has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested.

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Market research was conducted; however, none of the vendors available under the FSS for SIN 70 are authorized to supply the maintenance needed for proprietary software owned by Compuware Corporation.

7. Any other facts supporting the justification.

This is proprietary Original Equipment Manufacturer (OEM) software that supports specific hardware and software products. The compatibility with existing hardware/software system’s configuration is limited to the OEM, Compuware Corporation, to maintain uninterrupted use of CBP legacy audit trail data needed for OPR investigative purposes.

Converting to an alternative software product is not a feasible alternative to maintaining the previously purchased software at this time. Testing and implementation of a new product would require extensive modifications to the existing mainframe legacy applications, and cannot be justified at this time. CBP is in the process of modernizing the mainframe applications and plans to migrate off of the mainframe so additional investments in new software are not warranted.

8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made.

CBP is in the process of modernizing its mainframe applications to reside in an open-systems environment. This software is specific to the mainframe and will be retired when the mainframe is retired.

9. CBP intends to post this requirement on FedBizOpps pursuant to FAR 8.405-6(a)(2)(i).

10. Technical/Requirements Personnel Certification.

Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.

File details come from the government source that posted it.
