About this file

This justification document supports a sole source award for the integration of an Advanced Architecture Desktop Signal Generator into an existing High Power Portable Range Threat Simulator. The Center of Countermeasures at White Sands Missile Range requires this upgrade to simulate higher fidelity threat signals and directly run simulation files from the Navy's Electronic Combat Simulation and Evaluation Laboratories. The justification cites the proprietary nature of the requirement and original equipment from the vendor Systems as reasons only they can fulfill it within the needed timeframe. The contract would award $1.46 million to Systems from July 2020 to July 2021 using RDTE&E funds. Market research identified no other capable sources. The agency is the Department of the Army Materiel Command Mission and Installation Contracting Command at Fort Hood.

FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items Sole Source Justification And Approval

1. Contracting Activity: U.S. Army Mission and Installation Contracting Command - Fort Hood (MICC-FH), 36000 Darnall Loop, Room 1300B, Fort Hood, TX 76544-5095

2. Description of Action: White Sands Missile Range (WSMR) Center of Countermeasures (CCM) requests a Firm-Fixed-Price (FFP) noncompetitive contract with Systems, 124 Industry Lane, Hunt Valley, Maryland 21030. The Government projects award by 31 July 2020. Research, Development, Test & Evaluation (RDTE&E) funds will be used. An acquisition plan is not required because this procurement does not meet the threshold in accordance with Defense Federal Acquisition Regulations Supplement (DFARS) 207.103(d)(i)(B).

3. Description of Supplies/Services: This requirement is for the improvement of the existing High Power Range Threat Simulator (HPRTS) with the replacement of the current signal generator system, Model 527, with the Advance Architecture Desktop Signal Generator (A2DSG) system, all manufactured by Systems. CCM uses simulator files provided by the U.S. Navy’s Electronic Combat Simulation and Evaluation Laboratories (ECSEL) which is a Government entity using the System’s Advanced Architecture Phase, Amplitude, and Timing Simulator (A2PATS) which require a translation process with the Model 527. The upgrade to the A2DSG will allow simulator files from the A2PATS to be run directly on the signal generator. CCM requires the upgrade of the signal generator in the HPRTS in order to simulate higher fidelity signal generation capability, files, and the usage of validated signal libraries to support the Warfighter with their mission requirements. CCM receives on average 5-10 requests a year to support warfighter training exercises. The existing Model 527 is not capable of emitting the new high fidelity threat radar signals. The requirement includes services of program and configuration management, design, engineering, assembly, integration, testing, acceptance, and delivery of the A2DSG into the HPRTS.

Period of Performance: 31 July 2020 through 30 July 2021 Total Value: $1.46M

4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C.

1901 as implemented by FAR Subpart 13.5: Other: Only one source reasonably available

5. Reason for Authority Cited: Based on the proprietary nature of this requirement it has been determined through the market that the requirement is specific to Systems and cannot be fulfilled by any other current capabilities.

a. Background: CCM provides various DoD evaluation, test, and training support for military units. CCM has an existing HPRTS acquired in 2014 by the Naval Research Laboratory Department from Systems. The Systems Lab Model 527 was added in 2018 as the signal generator. Systems is the original equipment manufacturer (OEM) and has proprietary rights to the equipment discussed. Therefore, only Systems would have the ability to integrate the A2DSG signal generator into HPRTS.

b. Alternatives.

1) The first alternative would be to conduct a competitive acquisition. This is not acceptable because alternate contractors would need to develop a waveform generator that is capable of directly inputting A2PATS threat simulation files into the HPRTS system. The contractor would have to research and develop expertise in CCM’s HPRTS system and in ECSEL A2PATS system and then manufacture and integrate their solution into the HPRTS system. This would not be able to be accomplished within the timeframe needed to support CCM’s test schedule requirement (4QFY20/1QFY21) due to the lack of preexisting knowledge into the two separate systems (HPRTS & A2PATS) and the production lead time of 9 to 12 months.

2) The second alternative is to use in-house resources. CCM is unable to upgrade the HPRTS system in-house to meet the Warfighter’s requirements because it does not have the expertise and resources available to design, develop, and integrate a signal generator that is compatible with the ECSEL signature files in a timely manner.

Therefore, this alternative is not acceptable.

3) The only feasible alternative is to establish a noncompetitive contract with Systems to provide the integration of the A2DSG into the HPRTS.

Systems has the knowledge, expertise, and resources to complete this requirement in the timeframe that is required by the Government. This alternative is principally beneficial to the Government as any attempt to compete this requirement would result in unreasonable delays as other competitors work to develop this highly specialized technology. Consequently, these delays would likely result in a substantial duplication of costs to the Government that would not be offset by a theoretically lower price after competition.

c. Impact if Not Approved: If the acquisition and integration of the System

A2DSG is not approved, CCM will not be able to adequately support the testing and training of the Warfighter with the HPRTS system. There is a risk that the Warfighter will deploy without receiving the appropriate training, which can put their safety at risk, risk damaging their platforms, and jeopardize their missions. Adequately training the Warfighter is critical in ensuring DoD can execute their mission, and CCM supports the DoD mission by operating the HPRTS system during Test and Evaluation and training events.

6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201 and any bids or proposals received shall be considered. In an effort to increase competition a sources sought notice was posted to solicit competition, see details in paragraph (a) below:

a. Effective Competition: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought notice was posted to the Federal Business Opportunities (FBO) website on 11 February 2019 for ten days and resulted in one response from an interested source. The Government requested a capability statement to determine technical capability. Preliminary technical information submitted by Information Systems Laboratories, Incorporated (ISL, Inc.) was reviewed and found not technically acceptable. Due to the nature of this requirement, it is anticipated no other source will have the ability to provide the services and supplies to meet CCM needs.

b. Subcontracting Competition: is classified as a Large Business under the selected North American Industry Classification System (NAICS) 541512-Computer Systems Design. Therefore, a subcontracting plan was requested as required by FAR 19.705-2. However, the subcontracting plan p by was reviewed by the Small Business Specialist and found unacceptable. It was deter will not offer sufficient subcontracting opportunities. A Determination and Findings (D&F), stating that no subcontracting possibilities are available and a subcontracting plan will not be required, is located in the Paperless Contracting Files (PCF), signed by both the Contracting Officer and Branch Chief.

7. Actions to Increase Competition: This acquisition will be synopsized at beta.SAM.gov as a sole source notice in accordance with (IAW) FAR 5.201. If other sources express interest as a result of the synopsis or other action, they will be listed in the official contract file, and the Contracting Officer may change the acquisition strategy based on the relevance of comments and time constraints. Due to reasons indicated above in paragraph 5, Systems is the only firm that can realistically perform the required services. As stated in paragraph 6 above, the sources sought notice posted on the FBO website did not identify any other viable sources that could perform this requirement.

8. Market Research: Based on the market research conducted from 5 February 2019 through 3 April 2020, historical contract information, and the sources sought synopsis (SSS) results, there is only one available source under NAICS 541512 that is capable of providing the supply and service for this acquisition. This highly specialized supply and service requirement is available only from one source for services described above for the time period requested. Systems is the original equipment manufacturer of the HPRTS and only Systems would have the ability to integrate the A2DSG signal generator into HPRTS in a timely and efficient manner. The A2DSG meets the definition of commercial items set forth in FAR Part 2.101. Awarding to any other source would impact the CCM test and evaluation ability to meet the critical mission and services.

8. Market Research: Based on the market research conducted from 5 February 2019 through 3 April 2020, historical contract information, and the sources sought synopsis (SSS) results, there is only one available source under NAICS 541330 that is capable of providing the supply and service for this acquisition. Awarding to any other source would impact the CCM test and evaluation ability to meet the critical mission and services.

b. Subcontracting Competition: is classified as a Large Business under the selected North American Industry Classification System (NAICS) 541330-Engineering Services. Therefore, a subcontracting plan was requested as required by FAR 19.705-2.

However, the subcontracting plan provided by w ed by the Small Business Specialist and found unacceptable. It was determined t offer sufficient subcontracting opportunities. A Determination and Findings (D&F), stating that no subcontracting possibilities are available and a subcontracting plan will not be required, is located in the Paperless Contracting Files (PCF), signed by both the Contracting Officer and Branch Chief.

9. Interested Sources: On 2 October 2019, the Government received an e-mail to the previous sources sought notice posted on FBO. The Government requested a capability statement to determine if competition could be established. ISL, Inc. provided a capability statement on 9 October 2019 that was sent for a technical review. ISL capabilities did not meet the requirements in the Statement of Work (SOW). ISL’s presentation consisted more of a modeling and simulation (M&S) tool that is used in a laboratory environment. The upgraded HPRTS RSS A2DSG is needed in an open air environment for flight testing. Attempting to implement ISL capability would not be feasible and cost effective, due to having to convert their modeling and simulation tools into the CCM open air flight test system HPRTS. Also, ISL M&S capability is not compatible to the Navy’s ECSEL laboratory simulator files, which is what the HPRTS system uses to emit and therefore creates additional cost to the Government to attempt to convert to the ECSEL simulation file structure and format. To date, no other sources have written to express interest in the acquisition.
