DETERMINATION AND FINDINGS (D&F)

(PR 20079504)

1. Identification of the agency and the contracting activity:

U.S. Customs and Border Protection

Procurement Directorate, IT Contracting Division

Washington, DC 20229

2. Nature and/or description of the action being approved:

This Contracting Officer D&F is prepared in accordance with the requirement set forth in the FAR. CBP intends to award a firm fixed-price (FFP) delivery order (DO) for Splunk Enterprise licenses & support.

3. A description of the supplies or services required to meet the agency's needs

CBP requires the procurement of Splunk Enterprise licenses & support. Splunk software provides the ability to better manage application health by rapidly diagnosing application logs in order to pinpoint problems.

4. Identification of the rationale and, if applicable, a demonstration of the proposed contractor's unique qualifications to provide the required supply or service.

The Analytical Framework for Intelligence (AFI) project needs an application with the ability to aggregate logs from diverse servers and to search across all logs for events indicating the application health. Additionally, the AFI security team has a need to extract security events which only exist in the application logs. Splunk Enterprise is the only product which can handle the scope and complexity of the AFI application as it expands across servers.

5. Determination of price reasonableness.

The Contract Specialist shall perform price analysis to determine price reasonableness before award of the delivery order. Price reasonableness will be established by comparing the offerors’ pricing to each other and the Government’s IGCE.

6. A description of the market research conducted among schedule holders, if applicable, and the results or a statement of the reason market research was not conducted.

The Targeting and Analysis Systems Program Directorate (TASPD) has a need to better manage its application health as the AFI project expands in scope and complexity.

This need is currently serviced by the Data Center server monitoring; however, the Data Center does not have the ability to efficiently manage the AFI project’s application health or the ability to rapidly diagnose and pinpoint problems. To expand across servers using the Data Center would create additional costs and rework.

7. Any other facts supporting the sole source action.

While this procurement will be competitive amongst the DHS First Source II multiple-award, this requirement is for a subscription that can only be provided by one company.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

The requirement for functionality and compatibility with existing U.S. Customs and Border Protection's (CBP) Enterprise Architecture will impede CBP's ability to compete this acquisition.
