J&A Number: 20-320

5. Rationale Justifying Use of Cited Statutory Authority.

Boeing Huntington Beach is currently under contract via N00019-16-G-0001 Delivery Order 2001 to complete the aforementioned P-8A systems and sub-systems, and has the requisite knowledge, experience, and technical data that can meet the Government's requirements. While both of these capabilities (NRAAM and MAC-E) have been largely developed, there is still a need for correcting deficiencies found during integration and testing efforts at the P-8A platform, through Development Test, for each ECP.

Boeing Huntington Beach is the sole designer and developer of the Acoustic Operational Flight Program (AOFP) and is the only company with the requisite knowledge and experience that can meet the Government's requirement. The support to be provided under this contract include modifications to and continuation of the current efforts and therefore, cannot be completed by another contractor without significant duplication of cost equivalent, at a minimum, the value of recent and current contracts/delivery orders (completed to date), which totals approximately

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with FAR 6.302-1, a Sources Sought Notice for this requirement was posted to beta.SAM.gov on 7 April 2020. The Government did not receive any capability statements in response to the Sources Sought Notice.

Additionally, in accordance with FAR 5.201, the proposed contract action was synopsized on the beta.SAM.gov website on 29 April 2020 and no other potential sources expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than The Boeing Company to provide the required supplies and services.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer must purchase supplies and support from responsible sources at a fair and reasonable price. The technical analysts and contract specialist will perform an analysis of the proposals, with the assistance of Defense Contract Management Agency (DCMA) and Defense Contract Audit Agency (DCAA) auditors as needed. The Contracting Officer will analyze the various cost elements that are presented in proposals; as well as review the actual cost elements from previous procurements, if applicable.

The Contracting Officer will use Government expertise, including DCMA, DCAA, the program office, and other Government resources, to evaluate the material, labor and subcontract positions. As discussed in this paragraph, the Contracting Officer will use cost and price analysis as the basis for negotiating a fair and reasonable price for the supplies/support covered by this J&A.

8. Actions to Remove Barriers to Future Competition.

J&A Number: 20-320

For the reasons set forth in Paragraph 5, NAVAIR has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVAIR will assess whether competition for future requirements is feasible.
