About this file
This document is a synopsis notice of intent to sole source a contract for preventive maintenance and repair services of a government-owned BD Biosciences Symphony S6 flow cytometer. The National Institute of Environmental Health Sciences intends to award a sole source contract to BD Biosciences for maintenance and repair services for the instrument located at their Division of Intramural Research facility. The notice provides interested parties an opportunity to submit capability statements by March 19, 2024 demonstrating their ability to satisfy the requirement. However, the agency asserts that BD Biosciences is the only responsible source due to their proprietary technology and specially trained field service engineers. The potential sole source contract would have a base year effective January 1, 2025 through December 31, 2026 and include four optional one-year extension periods.

2350 QUME DR, SAN JOSE, CA 95131-1812, UEI: MM5ZHL8SRFY5
This acquisition is conducted under the authority of 41 U.S.C. § 1901 – Simplified acquisition procedures, as implemented by FAR section 13.501, in accordance with (IAW) FAR 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.
This purchase is for: Project title. Preventive Maintenance and Repair of Government- Owned BD Biosciences Symphony S6 flow cytometer for DIR, NIEHS, Research Triangle Park, NC.
The government owned BD Biosciences Symphony S6 flow cytometer is manufactured and sold exclusively by BD Biosciences. The technology is BD Biosciences proprietary products and is not available from other sources. BD Biosciences and no other source of suppliers can provide genuine BD Biosciences parts, timely maintenance, and upgrade service or services on these instruments.
Additionally, if problems arise, technical phone support directly with a BD Biosciences engineer is included that provides immediate assistance in getting the instruments operational in a timely manner.
Furthermore, extended down time would compromise the on-going research efforts therefore the yearly maintenance agreement is in the best interest of the government to avoid costly delays that could result from not having an agreement in place, with each potential repair requiring a separate procurement action.
Finally, BD Biosciences provides field service engineers who are specifically trained on the repair and maintenance of this particular instrument. Therefore no other vendor can provide the services, specifically trained engineers, that are required to repair and/or maintain the government owened flow cytometer. In short, by BD Biosciences is the only company that has the ability to provide field service engineers who are specially trained on the repair and maintenance of these particular pieces of equipment in a timely manner and provide direct phone support with a BD Biosciences engineer.
