Statement of Work Solid Waste Management

Background

The Bureau of Indian Affairs (BIA), Standing Rock Agency, Facilities Operations in Fort Yates, North Dakota provides operation and maintenance to all agency facilities. Solid waste disposal services are needed for agency buildings and offices.

General SOW Specifications

A. Scope: The scope of this statement of work (SOW) is to provide solid waste disposal services for BIA buildings and offices with collection frequency as described below and shall be guaranteed throughout period of performance (PoP). The contractor shall be available within 24 hours of call from the Agency Point of Contact (POC). The contractor shall provide all labor, equipment, supplies, materials, and incidentals, except as otherwise noted herein, necessary to provide services described in the SOW.

B. Objective: The objective is to ensure a safe and healthy working and living environment by providing solid waste disposal services.

C. Government Furnished Property: N/A

D. Supervision: The contractor shall provide competent supervision at all times when work is in progress. The contractor is responsible for assuring that all work accomplished and materials used are in accordance with the specifications.

E. Applicable Publications, Laws, and Regulations: Solid waste disposal services shall be conducted in conformity with applicable regulations to provide satisfactory protection of property and the environment. Work accomplished under this contract shall conform to the requirements of all applicable Federal, Tribal, State and Local laws and regulations pertaining to environmental protection and occupational safety and health.

F. Contractor-Owned Equipment: The cost of maintenance and repair of the contractor–owned vehicles shall be the sole responsibility of the contractor. The contractor shall furnish all containers and equipment needed to meet the requirements under this contract.

G. Transportation: All solid waste shall be transported from the collection point to the landfill site in the type of vehicle so designed for solid waste transportation. Transportation equipment shall be in acceptable and safe condition.

1.2 Adding or Removing Services

The contract may be modified, by supplemental agreement, to add or remove services as needed, including the quantity, size, and type of containers, and the frequency of pick-ups. A modification shall be signed by a warranted Contracting Officer prior to implementing any changes.

Section 2: Period of Performance (PoP)

The period of performance shall be 12 months, beginning November 4, 2024, or the day after the award date, whichever occurs later, with the option to extend services up to two (2) additional years. The total duration of the contract shall not exceed three (3) years.

Section 3: Inspection and Acceptance Criteria

Inspection for acceptance of all services will be performed by BIA Facilities Dept.

Section 4: Administrative Considerations

4.1 Correspondence

To promote timely and effective administration, correspondence shall be subject to the following procedures:

Technical correspondence where technical issues relate to compliance with the requirements herein shall be addressed to the POC with an information copy to the Contracting Officer.

All other correspondence, which propose or otherwise involve waivers, deviations, or modifications to the requirements, terms, or conditions of this contract, shall be addressed to the Contracting Officer with an information copy to the POC.

4.2 Non-payment for Unauthorized Work

No payments will be made for any unauthorized supplies or services or for any unauthorized changes to the work specified herein. This includes any services performed by the contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the terms and conditions under this effort.

Section 6: Contractor Interfaces

The contractor and subcontractors may be required, as part of the performance of this effort, to work with other contractors working for the Government. Such other contractors shall not direct this contractor or their subcontractors in any manner. Also, this contractor and their subcontractors shall not direct the work of other contractors in any manner.

No personal services shall be performed under this contract. No contractor employee shall be directly supervised by the Government. If the contractor believes any Government action or communication has been given that would create a personal services relationship between the Government and any contractor employee, the contractor shall promptly notify the Contracting Officer of this communication or action.

The contractor shall not perform any inherently governmental actions under this contract. No contractor employee shall hold themselves out to be a Government employee, agent, or representative. No contractor employee shall state orally or in writing at any time that they are acting on behalf of the Government. In all communications with third parties in connection with this contract, contractor employees shall identify themselves as contractor employees and specify the name of the company for which they work.

6.1 Technical Direction

Technical direction provided by the POC shall be within the general scope of this effort. The POC does NOT have the authority to and may NOT issue any technical direction which:

a. Constitutes an assignment of work outside the general scope of this effort;

b. In any way causes an increase or decrease in cost or the time required for performance;

c. Changes any of the terms, conditions, or other requirements of this effort; and

d. Suspends or terminates any portion of this effort.

The Contracting Officer is the only individual with the authority to financially obligate the government and modify terms and conditions of this contract. The contractor shall be responsible for notifying the Contracting Officer of any potential issues or concerns - technical, scope or financial - concerning this contract.
