About this file

This document is a Bill of Materials and Justification for Other than Full and Open Competition for a brand name federal contract opportunity. The National Institute of Allergy and Infectious Diseases (NIAID) has a requirement for an advanced dual-energy CT package (including automated filter wheel) to be used in their research facilities. The package can only be acquired through the vendor of the existing imaging system, MiLabs, as they are the sole provider of the required technology. The procurement will be processed under Simplified Acquisition Procedures (FAR Part 13) with a firm fixed price purchase order. The solicitation number is RFQ-NIAID-24-2229894, and offers are due by August 28, 2024. The North American Industry Classification System (NAICS) code is 334516, Analytical Laboratory Instrument Manufacturing. The government intends to award based on technical capability and price.

Bill of Materials and Justification for Other than Full and Open Competition:

Brand Name at or Below the Simplified Acquisition Threshold

Project Title: Advanced dual-energy CT package (including automated filter wheel)

I . Identification of the agency and contracting activity

DHHS, NIH, NIAID, IRF

Address of the requesting lab/office: FDC NIAID IRF BG RM 1A121A 8200 RESEARCH PLAZA, FREDERICK MD 21702

II. Description of the project, and supplies or services required to meet the agency’s needs:

The National Institute of Allergy and Infectious Diseases (NIAID) The IRF-Frederick collaborates with internal (NIAID) and extramural investigators to conduct research on viruses, such as those causing high-consequence disease (e.g., Ebola virus and SARS-CoV-2) and those included on the NIAID Priority Pathogens list. Additional resources in a dedicated biosafety level 2/3 (BSL-2/3) imaging facility study simian/simian-human immunodeficiency virus (SIV/SHIV). The MiLabs Vector is a multimodal instrument which encompasses also a state of the art CT scanner. This system is being increasingly used at the IRF-Frederick to characterize animal models of highconsequence pathogen infections. This procurement aims to acquire a dual energy CT option for the MiLabs Vector. Dual energy CT is a technology that allows for better characterization of CT images, especially related to soft tissues, lung and perfusion applications, and detection of contrast agents for tissue characterization, and material decomposition.

A. Description of the supplies/services to be purchased – Bill of Materials. Must be quoted as the following separate line items:

Line 1: Advanced dual-energy CT package (including automated filter wheel), Item # CT-DUAL-ADV, QTY 1 EA

Line 2: Shipping and Handling, if applicable

III. Identification of the statutory authority permitting other than full and open competition (SELECT ONE)

☒ 41 USC 3304(a)(1) a n d F A R P a r t 6 . 3 0 2 - 1 : Only one responsible source/Brand Name

☐ F A R P a r t 8 . 4 0 5 - 6 : Federal Supply Schedule (FSS), limited competition/Brand Name

Important Note: The statutory authority listed below will rarely ever be used in NIH. Before selecting this authority, please ensure that you have read and understood the citation and discussed it with the cognizant Contracting Officer.

☐ 41 USC 3304(a)(5) a n d F A R P a r t 6 . 3 0 2 - 2 : A u t h o r i z e d o r r e q u i r e d b y s t a t u t e / B r a n d N a m e

IV. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.

A. Describe why only the requested brand or brand name feature of the supply/service will meet the government’s needs

The lab requires a dual energy CT technology which will allow for better characterization of the animal models studied at the IRF-Frederick. This technology can only be acquired through the vendor of the imaging system (MiLabs). MiLabs is the vendor of the system for which the dual filter package is being purchased and therefore the only vendor that can provide the package. The required piece of equipment that is an upgrade is required due to the current piece of equipment failing and being replaced multiple times so must be replaced.
