About this file
This is a New York State Department of Environmental Conservation (NYSDEC) permit issued to the NYS Office of Resilient Homes and Communities for the Rebuild by Design Living Breakwaters project located at Hampton Plaza on the shoreline of Raritan Bay offshore of Tottenville, Staten Island. The permit authorizes the establishment of oyster reef habitats on four existing breakwaters through the introduction of approximately 39,675,000 oyster spat conducted in two phases: an initial phase consisting of three in situ trials conducted within turbidity curtains, and a second phase involving installation of approximately 4,494 ECOncrete disks seeded with oyster spat within the existing breakwater footprint. The permit was issued on January 23, 2026, and is valid through December 31, 2031. The permittee must submit a Notice of Intent to Commence Work at least five days prior to project start and a Notice of Completion of Work within ten days of completion. In-water work is prohibited from January 15 through May 31 to protect winter flounder spawning habitat.
The permit contains extensive conditions requiring strict conformance with approved plans prepared by Scape Landscape Architecture and a monitoring plan developed by Billion Oyster Project, annual reporting of oyster performance criteria for years one, three, and five including epibenthic community monitoring, and post-construction photographs within thirty days of completion. The permittee must obtain a Shellfish Importation Permit prior to receiving oysters from out-of-state hatcheries and must comply with License to Collect and Possess requirements (LCP #1143) governing oyster quantities. Additional requirements include notification to NYSDEC Region 2 Division of Law Enforcement at least 24 hours prior to installation of ECOncrete disks, employment of best management practices to prevent material loss and water contamination, maintenance of at least two feet vessel clearance from the mudline, and immediate reporting of any tampering or theft. The permit is subject to modification, suspension, or revocation by NYSDEC based on material misstatements, non-compliance with conditions, or material changes in environmental conditions or applicable law.
