INDIAN AFFAIRS
SAFETY AND HEALTH ADOPTED CODES, POLICY AND
MANDATORY STANDARDS
Indian Affairs has adopted the following safety and health codes, policies and mandatory standards:
A. OSHA Compliance. All operations, new construction, major alterations and improvements, minor remodeling and workplace sites shall comply with all occupational safety standards issued under Section 6 of the OSHA of 1970, as amended, or alternate standards issued pursuant to this part.
B. Fire and Fire Safety. All new construction, major alterations and improvements, and minor remodeling shall be classified according to occupancy and/or use shall conform to the National Fire Codes, IA policy, and Topic 27, Structural Fire Program, in the IA Safety and Risk Management Handbook.
C. Accommodations for People with Disabilities. All new construction, and major alterations and improvements, including modular and portable buildings, shall be in accordance with 36 CFR, Part 1191, Americans with Disabilities Act and Architectural Barriers Act Accessibility Guidelines (ADAABAAG), as prepared by the U. S. Access Board, as well as Section 504 of the Rehabilitation Act of 1973, as amended in 1978, which generally requires that IA programs do not discriminate against physically impaired persons.
1. The DOI Civil Rights Directive 2006-02, issued January 5, 2005, requires all new construction, major alterations, and improvements be in accordance with the ADAABAAG. Through 25 United States Code (U.S.C.), Section 2005, all facilities connected with the education of Indian children must follow ADAABAAG’s, ADA Chapter 2 Scoping Requirements. ABA Chapter 2 Scoping Requirements apply to all other facilities. Technical Chapters 3 through 10 are to be applied as referred from the applicable scoping requirements. In addition to standard ‘adult’ (more than 12 years old) accessibility requirements, child (12 years old and younger) accessibility is to be provided in school facilities, using ADAABAAG children guidance, applied in accordance with any indicated age groupings.
D. Building Safety Code. All buildings, structures and facilities shall be designed and constructed in accordance with the current edition of National Fire Protection Association (NFPA) 5000 – Building Construction and Safety Code©.
E. Boiler/Pressure Vessels. The fabrication and installation of all new boiler and unfired pressure vessels shall conform in all respects to the American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code and shall be marked with appropriate ASME Code symbols. The repair, alterations, or re-rating of all existing units shall conform to the National Board Inspection Code and shall be marked with appropriate code symbols. In each situation, a Qualified Boiler Inspector shall inspect the final product, and annually thereafter.
F. Elevators. All passenger and freight elevators, dumbwaiters, escalators, or moving sidewalks constructed or leased by IA shall conform to the ASME American National Standard Safety Code for Elevators and Escalators (ASME A17.1/CSA B44 Handbook) and applicable accessibility standards. All platform lifts shall conform to the ASME American National Standard Safety Standard for Platform Lifts and Stairway Chairlifts (ASME A18.1) and applicable accessibility standards.
G. Piping. Boiler/Pressure Vessel external piping and piping installations shall conform to American National Standards Institute (ANSI) B31.1, American National Standard, Power Piping, ASME Boiler and Pressure Vessel Code, Section I - Power Boilers;
Section IV - Heating Boilers and Section VIII - Pressure Vessels - Division I. The piping or associated mechanical system shall not be operated unless that part of the system has been inspected and approved by a Qualified Boiler Inspector. Other fuel piping, steam and water piping, air piping, and their respective installations shall conform to applicable sections of the Uniform Plumbing Code and the Uniform Mechanical Code.
H. Mechanical Systems.
1. Liquefied Petroleum Gas. Liquefied petroleum gas heating systems and distribution facilities shall conform to NFPA Standards No. 58 and 86.
2. Natural Gas. Natural gas systems shall comply with NFPA Standards No. 54 and 86.
3. Oil. Oil burning system installations shall conform to NFPA Standards No. 31 and 86.
4. Electrical. Electrical heating and cooling systems shall be installed in accordance with the National Electrical Code (NFPA Standard No. 70). Specific equipment shall be Underwriter’s Laboratory (UL) or Factory Mutual (FM) listed or labeled.
5. Solar. Solar installations shall be installed in accordance with the Uniform Solar Code and the American Society of Heating, Refrigerating and Air- Conditioning Engineers (ASHRAE) Standards.
6. Cooling and Ventilation. Cooling and ventilation systems shall conform to the Uniform Mechanical Code and NFPA No. 90A.
I. Electrical. Electrical power transmission, distribution, and installation shall comply with the National Electrical Code (NFPA Standard No. 70) and the National Electrical Safety Code.
J. Environmental Quality.
1. Food Service. All new construction, major alterations and improvements, minor remodeling, and operation of food service facilities shall conform to the guidelines set forth in the latest edition of the Food and Drug Administration (FDA) Food Code.
2. Sanitation Facilities. All new construction, major alterations and improvements, and minor remodeling of sanitation facilities shall conform to the following guidelines:
• Liquid Waste: Applicable parts of 40 CFR, Protection of Environment, and 29 CFR 1910, OSHA.
• Solid Waste: Applicable parts of 40 CFR, Protection of the Environment.
K. Water Facilities. All new construction, major alterations and improvements, and minor remodeling of domestic water facilities shall conform to 40 CFR, Protection of the Environment, and 29 CFR 1910, OSHA.
L. Illumination. All new construction, major alterations and improvements, and minor remodeling shall provide facilities which conform to Illuminating Engineering Society Standards and Regulations on Illumination which include 29 CFR 1910, OSHA.
M. Heating, Ventilation and Air Conditioning (HVAC). All new construction, major alterations and improvements, and minor remodeling of facilities shall conform to minimum requirements given in the Uniform Mechanical Code, NFPA Standard No.
90B and the American Society of Heating, Refrigeration, and Air-Conditioning Engineers (ASHRAE) Standards.
N. Pest, Vector and Vermin Control. All new construction, major alterations and improvements, and minor remodeling shall provide facilities which conform to regulations on pest, vector and vermin control included in 29 CFR, Protection of Environment, Parts 162, 163, 165, 170 and those provisions outlined in the Food and Drug Administration (FDA) Food Code.
O. Plumbing. All plumbing installations, equipment and fixtures shall comply with the Uniform Plumbing Code. They shall be subject to periodic and final inspections to ensure compliance. Code reference to the administrative authority refers to the Division of Safety and Risk Management or its authorized representative.
BASIC CODE AND REGULATION CITATIONS
Appendices, subdivided into basic requirements of several codes, standards and regulations, are to be supplemented with the inspector’s inserted notes, and the completed version should be available at the inspection’s closing meeting, for discussing the findings with the Official-in- Charge, the authorized employees’ representatives and/or safety and health committee members.
As is the case throughout these guidelines, identified violations must be entered into the final safety and health inspection report through the Safety and Condition Assessment Portal
(S&CAP).
MAINTENANCE, INSPECTION AND TESTING OF SYSTEMS AND EQUIPMENT
When performing an annual safety and health inspection, the maintenance, inspection and testing requirements described in appendices need to be verified and evaluated. The safety inspector needs to be familiarized with “Indian Affairs Fire Systems Inspection, Testing, and Maintenance Guidelines” dated December, 2016 in order to gain more information on these items, as well as on others not listed herein that need to be evaluated. That document establishes various responsibilities, including the safety inspector’s responsibility to verify that all required inspections, operational tests, and preventive maintenance are being performed and that all records are up to date. When applicable, the inspector should require on-site testing during the safety and health inspection, to positively determine compliant operation. Such testing must occur when the inspector perceives any doubt as to up-to-date maintenance, inspecting and testing, or any doubt that a system or equipment is even operable. As applicable, the safety inspection’s subsequent formal inspection report would require corrective action needed to update such maintenance, inspecting and testing.

INTRODUCTION
These guidelines establish Indian Affairs’ internal operating procedures for performing mandatory workplace inspections/evaluations at least once annually by qualified safety inspectors and more frequently where there is an increased level of hazard at a facility.
Quality inspections and timely abatement processes are necessary to ensure the safety and health of students, employees, and the visiting public.
Inspectors are comprised of Indian Affairs, Bureau of Indian Affairs, and Bureau of
Indian Education safety professionals who meet the Office of Personnel Management requirements of the Occupational Health and Safety Management Series 018, Safety
Technician Series 019, Safety Engineer Series 803, or Industrial Hygiene Series 690.
Regional Collateral Duty Safety Officers, Haskell Indian Nations University Collateral
Duty Safety Officer, inspection contract services, and inspection services through a
Memorandum of Agreement or a Memorandum of Understanding are also included.
These inspectors are required to be proficient in applying relevant Indian Affairs adopted safety and health codes, policy, and mandated standards. It is imperative they maintain their knowledge and proficiency in the following current, though not inclusive, set of publications:
