2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):
A. _X__ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. _X__ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
Amee Bay is the only NAVSEA approved contractor with proven results authorized to perform rotor cleaning/repairs of SSMG rotor in place. Refer to Department of Navy letter 4710 , Ser 04x/099 of 7 June 2007 Life Cycle Engineering was authorized for utilization of contracted services by LCE in support of 688/726/21 Class Submarine Ships Service Motor Generators (SSMG) , Ships Service Diesel Generator (SSDG) and Emergency Propulsion Motors (EPM) in-place . Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.
OR
Identify the distributor(s)/authorized technical representative(s) for the item or service. Provide evidence of the exclusive licensing agreement as an attachment to this document. C. _X_UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the
Last Updated: January 2020 agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified: 21 Apr 2020
2. Required delivery date/period of performance: 20 Jul 2020 – 24 Aug 2020
3. Explanation of why delivery/commencement of services by the date mentioned above is required:
The Puget Sound Naval Shipyard and Intermediate Maintenance Facility (PSNS&IMF), in support of a SSN 21 SEAWOLF class submarine, refurbishment of number two ship service motor generator (SSMG), includes complete SSMG set disassembly and reassembly including rigging and inspection of all machine components. Measure bearing seat dimensions, accomplish in-place detergent/water cleaning of SSMG set to include air cooler, static exciter, rotor and stationary field windings, repair defective insulation, replace field leads as required, stone commutator stone/polish slip rings as required, undercut and bevel commutator, if necessary, replace ac and dc bearings.
The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government.
The work needed is to be completed during a Continued Maintenance Availability (CMAV) with dates of 20 Jul 2020 through 24 Aug 2020. It is essential that this work is completed during this period to enable the ship to get underway and complete their mission.
With the current COVID-19 pandemic and the 14 day Restriction of Movement (ROM) that is in place for the state of Washington, contractors traveling to PSNS from outside Washington will have to shelter in place in the local area for 14 days before they can begin work. The 14 day ROM coupled with the CMAV and POP dates make this an unusual and compelling urgency.
4. If appropriate, include any additional pertinent information.
