About this file

This is a Justification for Other Than Full & Open Competition (J&A) document from the Department of the Navy, NAVSUP WSS in Mechanicsburg, PA. The document seeks to negotiate and award a contract for a COMPRES/MTR AY (compressor/mirrored array) with NSN LLH880710, part number 12424404, under a non-competitive procurement method. The acquisition is justified under 10 USC 3204(A)(1), citing that only one or a limited number of responsible sources can satisfy agency requirements.

The document emphasizes critical safety considerations, noting that the material is for a crucial shipboard system where incorrect substitution could result in serious personnel injury, loss of life, or loss of vital shipboard systems. Market research was conducted across multiple technical databases, and the government failed to procure adequate technical data. The expected final delivery date is 06/10/2026, and the document includes approvals from various Navy personnel including requirements, technical, contracting, and legal representatives, with final signatures completed by 07/30/2025. The Navy indicates it will continue to encourage vendors to submit technical data packages to potentially enable future competition.

Acquire, for the second or subsequent time, directly from the actual manufacturer.

The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to and they are the only ones who can fulfill this obligation. Only the source listed above, who is the OEM (or Prime and OEM, etc.), maintains the design and manufacturing standards via design drawings, manufacture procedures, and quality assurance procedures. This material will be used in a crucial shipboard system. The use of incorrect, substitute or defective material would create a high probability of failure resulting in serious personnel injury, loss of life, loss of vital shipboard systems, or loss of the ship itself. Therefore, the material has been designated as SPECIAL EMPHASIS material (Level I, Scope of Certification, or Quality Assured) and special control procedures are invoked to ensure receipt of correct material which has been previously shock and vibration tested for use on submarines. Substitution is not authorized.

possesses the necessary data rights to provide the required level of performance needed to meet fleet requirements.

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

To promote competition, NAVSUP WSS will continue to encourage vendors with the expertise to manufacture/repair the subject item to submit a complete technical data package for review and source approval by the appropriate engineering source approval authority per the (WSS) guidelines. Also, future requirements will be advertised on the government-wide point of entry. For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether
