About this file
This is a Justification for Other Than Full & Open Competition (J&A) document for a Basic Ordering Agreement (BOA) renewal under the Department of the Navy, NAVSUP Weapon Systems Support at Philadelphia.
The document authorizes negotiation and award of a contract through other than full and open competition for BOA Number N003832DGWR01, valid from June 2023 through June 2026. The J&A covers repair and overhaul services for various equipment items with part numbers referenced in Attachment A (nomenclature, NSN 99251, and quantities listed as various). The statutory authority cited is 10 USC 2304(C)(1) under FAR 6.302-1, establishing that only one or a limited number of responsible sources can satisfy agency requirements. The approved source is OEM-Cobham Mission Systems Davenport (cage code 99251), the sole qualified repair source for four items designated as Critical Safety Items (CSI) and one item designated as Critical Application Item (CAI). Specifically, Cobham is the only approved repair source for part numbers 1601409-1, 1601410-1, 3261129-0104, 3261129-0103, and 1660733-1. Triumph is identified as the only capable repair source for certain items. Market research confirmed that technical data necessary to solicit other sources is not physically available and economically infeasible to obtain, with no Source Approval Requests received from alternative sources. The contracting officer determined the anticipated cost to be fair and reasonable. The action was synopsized on the government-wide point of entry on August 16, 2022, and received final approval on September 26, 2022.

This J&A is based upon the authority of 10 USC 2304(C) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1
A/RMC 3
Acquire, for the second or subsequent time, directly from the actual manufacturer.
A/RMSC C
This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.
This acquisition will be solicited to
OEM-Cobham Mission Systems Davenport (99251). OEM-Cobham Mission Systems Davenport (99251) are the only approved repair source for items A001 p/n:1601409-1, A002 p/n:1601410-1, A004 p/n:3261129-0104, A004A p/n:3261129-0103. These have been deemed as Critical Safety Items (CSI), thus limiting qualified sources. The repair of the item listed above will be solicited to Triumph because they are the only capable source of repair. All alternate sources must qualify IAW the DCA's procedures, as approved by NAVAIR prior to contract award.
OEM-Cobham Mission Systems Davenport (99251) are the only approved repair source for item A003 p/n:1660733-1. The item is a Critical Application Item (CAI). An alternate source must qualify IAW the design control activity procedures, as approved by the cognizant Government engineering activity NAVAIR PMA-275 or NAVSUP Source Development Department. At this time only Cobham and no other approved repair sources have the expertise, facilities, associated drawings, specifications or the test equipment necessary to repair the subject item. Cobham is the only capable repair source approved at this time.
15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement
The proposed contract action was synopsized on the government-wide point of entry on 08/16/2022 and as a result
Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows
The latest configurations have been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. Four items have been deemed Critical Safety Items (CSI), and one Critical Application Item (CAI) thus limiting qualified sources. Per JDRS, Cobham Mission Systems Davenport is the only approved source at this time. The data necessary to solicit this item from sources other than Cobham is not physically available and is uneconomical to obtain.
The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source. Cobham (99251) is the only approved source at this time.
The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition
9. Any Other Facts Supporting Other Than Full & Open Competition
History
For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
