About this file
Summary
This is a Justification for Other Than Full & Open Competition (J&A) document issued by the Department of the Navy, NAVSUP WSS (Naval Supply Systems Command Weapon Systems Support), Philadelphia, PA. The document justifies a non-competitive acquisition for repair services on a Basic Ordering Agreement (BOA) N0383-25-G-NC01 through October 31, 2029. The contracting activity covers 16 Critical Application Items (CAI) that require repair, with one item (line A002) having undetermined criticality. These items include antennas, receiver assemblies, windows, digital receivers, power distribution modules, front-end optics, control modules, distribution modules, line select assemblies, and cable assemblies with various part numbers ranging from 5204375 to 5217009-110.
The acquisition is justified under 10 USC 3204(A)(1) and FAR 6.302-1, citing that only one responsible source (identified but redacted) can satisfy agency requirements. The rationale emphasizes that the approved source possesses unique design capability, exclusive engineering skills, proprietary manufacturing/repair knowledge, and retained data rights that are not economically available to the government. The source is the sole approved repair source identified in JDRS/ASE (Joint Data Repository System/Automated Support Equipment) and holds technical data essential to repair, test, and certify these items. While market research was conducted per FAR Part 10, no alternate sources have submitted Source Approval Requests. The document indicates future requirements will be advertised on the government-wide point of entry, and NAVSUP WSS will assess feasibility of future competition if alternative sources emerge. The acquisition was approved by Lynn Kohl, Head of Contracting Activity, on October 22, 2024.

This J&A is based upon the authority of 10 USC 3204(A) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1
A/RMC 3
Acquire, for the second or subsequent time, directly from the actual manufacturer.
A/RMSC C
This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.
This acquisition will be solicited to
Per JDRS/ASE, these items have been deemed Critical Application Items (CAI), except for line (A002) of the attachment "A" which criticality has been undetermined, thus limiting qualified sources. The repair of the items will be solicited to because they are currently the only capable source with the technical data required to repair, test and certify these items prior to unit delivery and is the sole approved repair source identified in JDRS/ASE. All alternate sources must qualify IAW the DCA's procedures, as approved by NAVAIR/NAVSUP WSS Source Development Department prior to contract award. Since the Navy does not possess sufficient rights to information such as drawings, specifications, and/or test equipment/procedures. NAVSUP- WSS must repair the items from This J&A will cover the following 16 items, listed on the attached E hibit A, for repair by W1 ANTENNA 015929284 P/N 5217009-110 FEE,TOP ASSEMBLY 016292014 P/N 5204580-105 WINDOW AY 016170785 P/N 5212400-100 RCVR MAINFRAME ASSY 016102276 P/N 5204375 IGITAL RECEIVER MO 015991106 P/N 5204400-105 PDM 015991096 P/N 5214700-100 FRONT END OPTICS,AI 015628682 P/N 5214410-100 CONTROL AND STATUS 015827988 P/N 5204500-100-105 DISTRIBUTION MODULE 015612406 P/N 5204440-100 PTS WRA 015929276 P/N 5212100-100 LSA 015929271 P/N 5211865-100 TCA 015927961 P/N 5211890-100 CABLE ASSEMBLY,ROTA 016617957 P/N 5217008-110 W2 CABLE 015929281 P/N 5217008-100 POWER SUPPLY 016717779 P/N 5211912-2 POWER SUPPLY 015929292 P/N 5211912

History
The latest configuration has been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. These items in the attachment "A" have all been deemed Critical Application Items except for line (A002) which criticality has not been determined thus limiting qualified sources. Per JDRS/ASE, is the only approved source at this time. The data necessary to solicit these items from sources other than is not physically available and is uneconomical to obtain. The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source.
is the only approved source at this time.
The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
