About this file

This is a Sole Source Justification document for a commercial item procurement by NAVSUP WSS Philadelphia for 15 CYLINDER ASSEMBLY, ACTUATING, LINEAR units (NSN: 1650-015743797, P/N: 1FA14012-8) with required delivery by 12/01/2026. The justification cites 41 U.S.C. 1901 and FAR 13.5 as the authority for other than full and open competition.

The document explains that Triman Industries Inc. (CAGE: 0ZBE8) is the authorized spares source per a distribution agreement dated April 23, 2024. The items are components for the P-8A aircraft's CFM56-7B series turbofan engines, which were commercially certified by FAA and EASA. The Navy does not possess manufacturing data, test equipment, or specifications required to manufacture the item, necessitating procurement through Triman Industries. The action was synopsized on 11/20/2024, and includes approvals from technical, legal, contracting, and competition advocacy authorities completed between November-December 2024. This procurement supports an FMS requirement under PD# N0038324X2123.

List of Items/Item Description

CYLINDERASSEMBLY,ACTUATING,LINEAR

This justification is based upon the statutory authority of 41 U.S.C. 1901, as implemented by Federal Acquisition Regulation Subpart 13.5

A/RMC 3

Acquire, for the second or subsequent time, directly from the actual manufacturer.

A/RMSC Z

This part is a commercial/nondevelopmental/off-the-shelf item. Commercial item descriptions, commercial vendor catalog or price lists or commercial manuals assigned a technical manual number apply. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources are available, A/RMCs 1 or 2 are valid.

This acquisition will be negotiated with

Triman Industries Inc., (0ZBE8) This Acquisition will be solicited to Triman Industries Inc., (0ZBE8) is the authorized spares source for these items, per distribution agreement dated 23 April 2024. The U.S. Navy procured modified Boeing 737-800's as the P-8A aircraft from Boeing Defense and Space (BDS) systems, who in turned purchased the air vehicle from Boeing Commercial Aircraft (BCA) Company. Although the P-8A Program is a military program, the CFM56-7B series turbofan Engines were commercially certified by the Federal Aviation Administration and European Union Aviation Safety Agency (EASA) (Europe’s FAA equivalent). To maintain commonality with the commercial configuration, and to derive the full benefits of cost and experience, the Navy agreed to FAA certification as its means of qualification. However, NAVAIR retains Technical Authority for Airworthiness of all Propulsion Systems. The Navy does not currently have in its possession any manufacturing data, supporting test equipment and associated specifications required to manufacture the item. Since the Navy does not own sufficient information such as any drawings, specifications, test equipment/procedures, a full and open competitive solicitation cannot be supported. NAVSUP-WSS must procure spares of the item from Triman Industries Inc., (0ZBE8).

The proposed contract action was synopsized in the government-wide point of entry on

The following sources have expressed an interest, in writing, in this acquisition

The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.

For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential spares source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
