About this file

This document is a justification and authorization for other than full and open competition on a federal contract. The contract is for the acquisition of a ballscrew assembly identified as a critical safety item by the Department of Defense. The assembly is required for the V-22 aircraft program managed by Naval Air Systems Command. Triumph Gear Systems is identified as the only approved source for this item in the Joint Deficiency Reporting System due to its designation as intellectual property of Triumph and importance to the integrity of the V-22 system. The justification cites 10 USC 3204(A)(1) and FAR 6.302-1 as the statutory authority to acquire the item from the sole source. Market research found no other potential sources and no requests from companies interested in qualifying as an alternative supplier. The anticipated cost to the government is determined to be fair and reasonable.

4. Statutory Authority Permitting Other Than Full & Open Competition

5. Rationale Justifying Use of Cited Authority

6. Description of Efforts Made To Solicit Offers From as Many Offerors as Practicable

Line of Accounting

This J&A is based upon the authority of 10 USC 3204(A) (1), only one or a limited number of responsible sources will satisfy agency requirements, as implemented by FAR 6.302-1

A/RMC 3

Acquire, for the second or subsequent time, directly from the actual manufacturer.

A/RMSC C

This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability, engineering skills, and manufacturing/repair knowledge by the qualified source(s) require acquisition/repair of the part from the approved source(s). The approved source(s) retain data rights, manufacturing/repair knowledge, or technical data that are not economically available to the Government, and the data or knowledge is essential to maintaining the quality of the part. An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. If one source is approved, A/RMCs 3, 4, or 5 are valid. If at least two sources are approved or if data is adequate for an alternate source to qualify in accordance with the design control activity's procedures, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

Triumph Gear System Inc. (82402), as they are identified in the Joint Deficiency Reporting System (JDRS) as the owner of the Technical Data for the Ballscrew Assembly, part number 42555-78. Even though is identified as the OEM in JDRS, the attached Sourcing Letter “Triumph Park City” date 11/17/2022, prevents from quoting or selling this Item to parties other than Triumph Gears System. This item is identified as a Critical Safety Item (CSI) in JDRS, and defined by the current version of DoD-STD-100, which limiting procurements to qualified sources. Only the V-22 Prime Contract Bell (97499) in conjunction with NAVAIR PMA-275 Basic Design Engineering (BDE) authority, can approve new or alternate sources for manufacture. This would entail finding a Company willing and capable of prototyping a new Ballscrew Assembly, which would have to meet the form, fit and function requirements. The new Ballscrew would then be subject to functional and flight testing in accordance with V-22 Prime Contractor Bell (97499) standards and specification. Once the new item is qualified, this would drive an ECP to completion at the Program Office. Which would then allow the New Vender Cage and Part Number, to be added to the LSA- 151 Data. All this would have to be completed prior to contract award.

15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement

The proposed contract action was synopsized on the government-wide point of entry on 05/22/2023 and as a result

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

The latest configuration has been checked and all records (ITIMP, JDRS/ASE, etc.) have been properly aligned, identified, and documented. This item has been deemed as a Critical Safety Items (CSI), thus limiting qualified sources. Per, Triumph Gear Systems Inc. (82402) Sourcing Letter, date 7 Nov 2022, prevents their sub-contractor from quoting or selling this Ballscrew Assembly to any party other than Triumph Gears System Inc. (82402). There by limiting the Government’s ability to procure this Item for sources other than Triumph Gears Inc. (82402). As it is the Intellectual Property of TRIUMPH, and the integrity of the system, this PN must come through TRIUMPH and not direct to the Navy from our sub-tier, which would void warranty and system level usage and support. The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source. Triumph Gear Systems (82402) is the only approved source at this time.
