About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for the acquisition of a HEAT EXCHANGER, FLUID component. The J&A cites the authority of 10 USC 3204(A)(1) to negotiate and award a contract to Sikorsky Aircraft Division (78286), the only approved source of supply for this component.
The CH-53K program is in the initial phases of its development, and the aircraft's technical data and configuration have not been fully delivered to the government. As a result, Sikorsky maintains the specialized engineering skills and knowledge required to successfully manufacture and integrate these critical flight components. The contracting officer determined the anticipated cost to the government will be fair and reasonable, and future requirements will be advertised on the government-wide point of entry as the program matures and technical data becomes available for potential new sources.

History
Acquire, for the first time, directly from the actual manufacturer.
A/RMSC H
The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part/contract repair from other than the current source(s).
This code is applicable only to parts under immediate buy/repair requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different A/RMSC. If one source is available, A/RMCs 3, 4, or 5 are valid. If at least two sources exist, A/RMCs 1 or 2 are valid.
This acquisition will be solicited to
Sikorsky Aircraft Division (78286). This has reached MSD and the initial item criticality has not yet been determined. Sikorsky Aircraft (SAC) is the Prime for the CH-53K and the only approved source of supply per NAVAIR. The CH-53K program is currently MSD and the aircraft physical configuration audit has not been completed. Since the configuration and provisioning data have not yet been completely delivered to NAVAIR, all configuration changes are routed and approved via SAC. Presently, Technical Data (TD) is being updated as the platform configuration evolves, and the procedures, requirements, and instructions required to execute a competitive spares contract have not been fully developed. Technical Data (TD) in any form will not be fully developed/delivered until the program on or about the time of MSD. SAC maintains all existing TD (drawings, repair manuals, depot level maintenance plans), specialized engineering skills, and the knowledge of the item(s) on this J&A. The components to be purchased are highly specialized, flight critical parts that must meet critical operational and reliability requirements. SAC is the only integrator able to coordinate successful manufacture of these components and conduct detailed analyses of systems in order to integrate reliability improvements while maintaining configuration control prior to delivering the configuration to NAVAIR.
15 MAR 2019 Class Waiver of the Requirement to Post a Request for Information or Sources Sought Notice applies to this requirement
The proposed contract action was synopsized on the government-wide point of entry on 10/25/2023 and as a result
Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows
Competition cannot be supported for this platform (CH-53K) since SAC still owns the configuration, and the Technical Data (TD) in any form. The CH-53K program is currently MSD/initial Operation Capability (IOC) phase of its development. The aircraft physical configuration audit has not been completed. Since the aircraft has reached MSD all AMC/AMSC will be re-evaluated based on Item Criticality and the availability of technical data provided to the government by SAC. The available technical data is insufficient for the development of new sources. Sikorsky (78286) is the only approved source at this time. The available technical data is insufficient for the development of new sources. Source Development Department files indicate no Source Approval Request (SAR) has been received from any party interested in becoming an approved source. Pending design stability, Sikorsky (78286) is the only approved source.
The contracting officer determines that the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
For reasons set forth in Paragraph (5 & 6), NAVSUP WSS has no plans at this time to compete future contracts for the subject item covered by this document. If another potential manufacturing source emerges, NAVSUP WSS will assess whether competition for future requirements is feasible. Also, future requirements will be advertised on the government-wide point of entry.
